Entry Into Force of the Tax Convention Between Canada and Romania

December 14, 2004


The Government of Canada notified the Government of Romania on December 1, 2004, that the necessary procedures in Canada for the bringing into force of the Convention between Canada and Romania for the avoidance of double taxation and the prevention of fiscal evasion signed at Ottawa on April 8, 2004, have been completed. The Government of Romania has already notified the Government of Canada on November 17, 2004, that it had completed its own procedures.

Article 29 of the Convention provides that it shall enter into force thirty days after the date of the later of these notifications. The Convention will therefore enter into force on December 31, 2004, and its provisions will have effect:

a)  in respect of tax withheld at the source, on amounts paid or credited to non-residents on or after January 1, 2005; and

b)  in respect of other taxes, for taxation years beginning on or after January 1, 2005.

The Convention replaces the tax treaty signed in 1978 between Canada and Romania.
