Entry into Force of the Tax Convention Between Canada and the Kyrgyz Republic

Finance Minister Paul Martin today announced that a Convention between Canada and the Kyrgyz Republic for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income and on capital entered into force on December 4, 2000.

The Convention was signed on June 4, 1998, in Ottawa. The Government of the Kyrgyz Republic notified the Government of Canada on December 4, 2000, that it had completed the necessary procedures for bringing the Convention into force. For its part, on November 8, 2000, Canada notified the Kyrgyz Republic that it had completed its own procedures.

Article 29 of the Convention provides that it shall enter into force on the date of the later of these notifications. The Convention therefore entered into force on December 4, 2000, and its provisions will have effect in Canada:

  1. in respect of withholding taxes, on amounts paid or credited to non-residents on or after February 1, 2001; and
  2. in respect of other taxes, for taxation years beginning on or after February 1, 2001.
