2005 Annual Report to Parliament - Crown Corporations and Other Corporate Interests of Canada

VI. Tabling of Crown Corporations Reports in Parliament

A report on tabling of Crown corporation reports is required under section 152 (1) of the Financial Administration Act (FAA). The report must indicate which corporate plan summaries and annual reports that were to be tabled in Parliament by July 31, were actually tabled.

Notably, Crown corporations report to parliament through the corporate plan summary and the annual report. For each Crown corporation listed in Parts I and II of Schedule III of the FAA, the responsible minister tables a corporate plan summary, a capital budget summary and an annual report in Parliament. In addition, an operating budget summary is tabled for those Crown corporations listed in Part I of Schedule III.^[1] There are a total of 37 Crown corporations who are required under the FAA to submit reports, and therefore only their data has been included in this chapter.

These corporate plan and budget summaries inform Parliament as to the strategic priorities and financial position of each Crown corporation. The summaries are based on the approved corporate plan and budgets, and cover the planned or future businesses, activities and investments of a corporation and, where applicable, of its wholly owned subsidiaries. The follow-up annual report, in turn informs Parliament of the corporation's actual performance relative to the objectives, strategies and activities approved by the government and tabled in the previous corporate plan and budget summaries.

The Deadlines for Tabling in Parliament

The deadlines for tabling, before each House of Parliament, the corporate plan summary, budget summaries and annual report are provided in law as follows:

Corporate Plan or Amended Corporate Plan Summary: 30 sitting days after approval by the Governor in Council of the corporate plan.

Capital and Operating Budget Summaries: 30 sitting days after Treasury Board approval of the budget. Where the operating and/or capital budgets are incorporated into the corporate plan, the deadlines for the budget summaries are the same as those for the corporate plan summary.

Annual Report: A corporation is to submit, to the appropriate minister, an annual report within three months of its financial year-end. The appropriate minister has 15 sitting days to table the annual report in each House of Parliament. The deadlines for annual reports are calculated from the date on which the responsible minister acknowledges receipt of the report, if known, or three months following the fiscal year-end of the corporation, whichever is earlier.

All tabling deadlines are based on actual sitting days, not projected sitting days. Since future sitting days cannot be predicted, deadlines falling after July 31, 2005 have not been included.

This report records the status of Crown corporations' annual reports and summaries of corporate plans and budgets during the period August 1, 2004 to July 31, 2005.

Subsection 152(2) of the FAA requires the Auditor General of Canada to include, in her annual report to Parliament, a statement attesting to the accuracy of the information contained in this chapter. An audit of the information reported in this chapter was performed by the Office of the Auditor General and is included as an appendix of the 2005 Report of the Auditor General of Canada.

During this period, 37% (34% last year) of corporate plan summaries, capital budget summaries and operating budget summaries and 13% (29% last year) of annual reports were tabled late in the House of Commons. Similarly, 21% (10% last year) of corporate plan summaries, capital budget summaries and operating budget summaries and 13% (same as last year) of annual reports were tabled late in the Senate. With respect to the 37 corporate plans needing Governor in Council approval prior to the beginning of each new financial year, only 38% (65% last year) were approved on time. A further 14% (11% last year) received approval within one month of the new fiscal year, and 30% (11% last year) were approved more than one month into the new fiscal year. A full 19% (14% last year) of corporate plans were still not approved by July 31, 2005.

Treasury Board Secretariat recognizes that there exist numerous challenges in meeting the prescribed tabling dates. TBS is currently working with Crown corporations and the portfolio offices who support the responsible Ministers, to reduce late tablings by taking an in depth look at the corporate planning and central review process to determine root causes and a wide range of possible solutions. In this past year, steps were taken to remind Ministers of their responsibility to ensure the timely presentation of corporate plans for Governor in Council approval and timely tabling summaries of the corporate plans and annual reports. Progress continues on the assessment and timing of current processes; next year's report will detail what specific steps will have been taken to address the systemic recurring delays in tabling these important reports before parliament.
