Appendix B – Transaction Approval Limits and Conditions

A minister may transact in real property when the consideration paid or received does not exceed the limits and conditions set out in the tables below. Unless specifically mentioned or otherwise previously approved, the general rule applies. These approval levels do not apply to custody transfers, as defined in this policy, as custody transfers are effected at nominal value.  The transaction approval limits and conditions of the Minister of Public Works and Government Services, set out in the tables, also apply to transactions where the Minister of PWGS has been, legally and in writing, empowered to exercise the powers of the custodial minister including the signing of the final conveyancing document on behalf of the custodial minister.  GST should be excluded for the purposes of the approval levels.

Explanatory notes on conditions: 1. If the consideration for the option exceeds $1,000, the Minister of Justice must be satisfied that the person granting the option has valid title to the optioned real property. 2. Levels also apply to the surrender of a lease and to the relinquishment of a licence where the amount represents either the consideration payable under the entire lease or licence, or the value of the Crown's interest in the unexpired term of the lease or licence. 3. Includes the transfer of administrative responsibility for a licence with respect to private or provincial real property from another minister. 4. For acquisitions made to pursue security investigations that the minister determines require a special degree of confidentiality. 5. Provided the portion attributable to each unit does not exceed the previously listed amounts. 6. Where property is to be used for settlements under the Comprehensive Claims Program. 7. For leases and licences other than single-family residences. 8. For leases and licences other than single-family residences and in response to an initial authorized operational deployment abroad. 9. For acquisitions made to pursue security or criminal investigations that the minister determines require a special degree of confidentiality. 10. For leases and licences with a province, municipality or local airport authority for the purposes of providing policing services.

The option to sell must expire within six months. 2. Levels also apply to the acceptance of surrender of a lease or relinquishment of a licence where the amount represents either the consideration payable under the entire lease or licence, or the value of the Crown's interest in the unexpired term of the lease or licence. 3. Includes the transfer of administrative responsibility for a licence with respect to private or provincial real property to another minister 4. Where the transfer is to the Minister of Indian and Northern Affairs for settlements under the Comprehensive Claims Program. 5. For lands administered by the Director of the Prairie Farm Rehabilitation Administration under the Prairie Farm Rehabiliation Act where the term does not exceed 21 years. 6. For dispositions of property acquired to pursue security investigations that the minister determines require a special degree of confidentiality. 7. For fast track disposal flexibilities and program transfer flexibilities approved for program review-related divestitures and for the new Divestiture Program initiative. 8. Subject to the TB Secretariat, the custodian or PWGSC identifying the need for Treasury Board approval for reasons other than the financial limit of the transaction. 9. For dispositions of property acquired to pursue security or criminal investigations that the minister determines require a special degree of confidentiality. 10. For leases and licences in air terminal buildings where the consideration is based solely on cost recovery rates, as determined under Transport Canada's Terminal Building Rental Rates Policy. 11. For all other leases and licences in air terminal buildings. 12. For all other airport-related purposes.
