Statutory Reports

 

Under the Financial Administration Act, statutory annual reports can be discontinued by Order-in-Council when they contain the same or less information than the corresponding estimate document (DPR or RPP) or Public Account.

For the purpose of consolidation, information contained in the DPR is compared to that contained in the annual statutory report to determine whether the latter may be discontinued.

Some departments and agencies have already consolidated their reports. Hence, it is essential that their performance report contain, in this section, the actual statutory information previously contained in the annual statutory report or a reference as to where such information can be found elsewhere in the DPR.

Departments and agencies that have initiated the consolidation process during the past months should report this information, thus forming the basis for the comparison with the statutory report.

This process can take a complete cycle leading to the required Governor-in-Council approval. Here are several steps to follow in order to reach final approval:

  • a request from the department to the TBS contact is required to initiate the process;
  • the proposed replacement information must be made available in the subsequent DPR and given to TBS;
  • TBS compares the consolidated information to the annual report in order to ensure that Parliament will receive the statutory information that it is supposed to;
  • based on this comparison, TBS receives a letter that the responsible minister agrees to discontinue the report; and
  • TBS then seeks the necessary Governor-in-Council approval on behalf of the department.

The consolidation of a statutory annual report can be initiated any time during the year as the need or opportunity arises.
