Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to October 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between September 2006 and October 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and citation.

Commercial Vehicle Drivers Hours of Service Regulations, SOR/2005-313 (Motor Vehicle Transport Act): Final version regulations in force January 1, 2007 are available in the Canada Gazette, Part II, November 16, 2005, p. 2424.

Crewing Regulations (Canada Shipping Act): Proposed amendments may be found in the Canada Gazette, Part I, March 27, 2004, p. 921.

Crown Corporations Involved in the Provision of Commercial Loans Environmental Assessment Regulations (Canadian Environmental Assessment Act): Proposed new regulations may be found in the Canada Gazette, Part I, December 31, 2005, p. 4363.

Decision Body Time Periods and Consultation Regulations (Yukon Environmental and Socio-economic Assessment Act): Proposed regulations are found in the Canada Gazette, Part I, September 17, 2005, p. 3113.

Energy Efficiency Regulations (Energy Efficiency Act): Proposed amendments are found in the Canada Gazette, Part I, May 6, 2006, p. 1014.

Feeds Regulations, 1983 (Feeds Act): SOR/2006-147 amends the regulation in various sections to strengthen safeguards against Bovine Spongiform Encephalopathy (BSE). These final amendments come into force on July 12, 2007 and are found in the Canada Gazette, Part II, July 12, 2006, p. 871.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Material Regulations (Canadian Environmental Protection Act, 1999): Proposed replacement regulations for the Interprovincial Movement of Hazardous Waste Regulations are found in the Canada Gazette, Part I, September 2, 2006, p. 2515.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): Proposed amendments are found in the Canada Gazette, Part I, November 19, 2005, p. 3855.

Marine Transportation Security Regulations (Marine Transportation Security Act): Proposed amendments are found in the Canada Gazette, Part I, July 1, 2006, p. 1982 and p. 2009.

Migratory Birds Regulations (Migratory Birds Convention Act): Proposed amendments are found in the Canada Gazette, Part I, December 24, 2005, p. 4293.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Subsections 115(2.2) to (2.4) of Schedule IV as enacted by SOR/2004-250 (vehicle identification number in bar code format) come into force September 1, 2008. Safety Management Regulations (Canada Shipping Act, 2001): Proposed amendments change the wording of the regulation in order to make it consistent with the provisions of the new Canada Shipping Act, 2001 when it comes into force in early 2007. See Canada Gazette, Part I, June 17, 2006, p. 1636.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): Proposed amendments are found in the Canada Gazette, Part I, September 30, 2006, p. 3015.

Section 2.A Acts

Canadian Environmental Assessment Act: The remainder of 2003, c. 9 is now proclaimed in force amending the definition of "federal authority" in subsection 2(1). French language version

First Nations Land Management Act: This amendment to the schedule of the Act adds 11 new First Nations as participants in the Act's alternative land management regime.

Section 2.B Regulations

Fishery (General) Regulations (Fisheries Act): SOR/2006-209 - Sections 6 and 7 are amended to allow fishing restrictions to be adjusted quickly to meet conservation goals when necessary. French language version

Law List Regulations (Canadian Environmental Assessment Act): SOR/2006-223 amendments are of a technical nature, correcting outdated references and restoring the regulation's accuracy. Amendments include the addition of the Aeronautics Act as well as changes concerning the Canada National Parks Act and the Canadian Environmental Protection Act. French language version

Inclusion List Regulations (Canadian Environmental Assessment Act): SOR/2006-223 amendments are of a technical nature to corrects outdated references and restore the regulation's accuracy. French language version

Management of Contaminated Fisheries Regulations (Fisheries Act): SOR/2006-210 - This amendment redefines "Regional Director General" to reflect the current structure of the organization.

Motor Carrier Safety Fitness Certificate Regulations (Motor Vehicle Transport Act): SOR/2006-227 - These amendments are of a technical nature to restore the regulation's accuracy.

Standards and Administration Regulation (Agricultural Operation Practices Act) : Alta. Reg. 215/2006 amends the regulation to update the agricultural operation standards. Section 3 (Minimum distance separation), has been updated with new text outlining broad requirements concerning placement of manure storage or confined feeding facilities. Sections 9 (groundwater resource protection), 10 (manure storage), 24 (manure application limits), 25 (soil protection), and 26 (nutrient management plan) have been replaced. Schedule 1 (Determination of Minimum Distance Separation) details the calculation of minimum distances concerning these feeding and manure facilities. The text of Schedule 2 (Determination of Catch Basin Volume) has been replaced. Schedule 3 (Nutrient Management and Determination of Land Base), which concerns the application of manure to the land, has been updated.
