Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations (Motor Vehicle Safety Act): Proposed amendments concern: a) new definitions, b) the drawing indicating the profile of the tether strap hook will be updated, and c) an unintended restriction in the performance testing requirements for rear facing child restraint systems is corrected. Text may be found in the Canada Gazette, September 4, 1999, p. 2581.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Proposed amendments affecting
three areas are found in the September 18, 1999 issue of the Canada Gazette, Part I: a) incomplete vehicles (p. 2741), b) liquified petroleum gas (p. 2755), and c) vehicles imported temporarily for special purposes, compliance labels and competition vehicles (p. 2765). Proposed amendments regarding a new class of vehicle, namely low-speed vehicles (LSVs), and their minimum safety requirements can be found in the Canada Gazette, Part I, November 13, 1999, p. 3370. Proposed amendments regarding power-assisted bicycles may be found in the Canada Gazette, Part I, November 20, 1999, p. 3448; a proposed change to the Vehicle Identification Number (VIN) standard as specified in section 115 may be found on page 3456. Proposed amendments affecting Light Vehicle Brake Systems and Roof Intrusion Protection may be found in the Canada Gazette, Part I, February 5, 2000, p. 412 & 419.

Motor Vehicle Tire Safety Regulations (Motor Vehicle Safety Act): Proposed amendments to the Tire Identification Number (TIN) as specified in section 8 and Schedule III may be found in the Canada Gazette, Part I, November 13, 1999, p. 3381.

National Energy Board Act Part VI (Oil and Gas Regulations): Proposed amendments affect exports of light or heavy crude oil from Canada. They may be found in the Canada Gazette, Part I, July 31, 1999, p. 2266.

Nuclear Safety and Control Act: The following proposed regulations may be found in the October 10, 1998 of the Canada Gazette, Part I (Vol. 132, no. 41): Class I Nuclear Facilities Regulations; Class II Nuclear Facilities and Prescribed Equipment Regulations; General Nuclear Safety and Control Regulations; Nuclear Non-proliferation Import and Export Control Regulations; Nuclear Security Regulations; Nuclear Substances and Radiation Devices Regulations; Packaging and Transport Regulations; Radiation Protection Regulations; Uranium Mines and Mills Regulations.

Persistence and Bioaccumulation Regulations (Canadian Environmental Protection Act, 1999): Proposed regulations prescribing the scientific criteria for persistence, bioaccumulation and other properties of substances for the purposes of administering sections 73 to 77 of CEPA, 1999 may be found in the Canada Gazette, Part I, December 11, 1999, p. 3645.

Pleasure Craft Sewage Pollution Prevention Regulations (Canada Shipping Act): Proposed amendments may be found in the Canada Gazette, Part I, March 25, 2000, p. 877.

Radiation Emitting Devices Regulations (Radiation Emitting Devices Act): The proposed replacement of Part XII (Diagnostic X-ray Equipment) may be found in the Canada Gazette, Part I, October 2, 1999.

Railway Safety Management System Regulations (Railway Safety Act): New regulations proposed will require all federally regulated railways to implement a Safety Management System. They may be found in the Canada Gazette, Part I, 26 February, 2000, p. 656.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): The proposed "clear language" version may be found in the Supplement to the Canada Gazette, Part I, August 7, 1999.

Environmental Impact Assessment and Review (Environmental Quality Act): Proposed amendments to the Regulation respecting environmental impact assessments and review may be found in the Quebec Gazette, February 9, 2000, No. 6, p. 825.

Occupational health and safety in mines. Proposed amendments may be found in the Quebec Gazette, September 8, 1999, p. 2855 and Dec 1, 1999, p. 4435.

Quality of the Work Environment (An Act respecting occupational health and safety): The regulation replaces the current Regulation respecting industrial and commercial establishments (R.R.Q. 1981, c. S-2.1, r.9) and the Regulation respecting the quality of the work environment (R.R.Q. 1981, c. S-2.1, r.15). The text may be found in the Quebec Gazette, Part 2, September 16, 1998, No. 38, p. 3777-3878.

Recovery and reclamation of discarded paint containers and paints (Environment Quality Act). The proposed regulation can be found in the Quebec Gazette, October 6, 1999, Vol. 131, No. 41, p. 3596.

Reduction of pollution from agricultural sources (Environment Quality Act): Proposed amendments to the regulation may be found in the Quebec Gazette, November 17, 1999, Vol. 131, No. 47, p. 4158

Solid Waste (Environment Quality Act): Proposed regulations may be found in the Quebec Gazette, December 15, 1999, Vol. 131, p. 4562.

Used Tire Storage and Solid Waste Regulations Environment Quality Act): Proposed amendments may be found in the Quebec Gazette, February 2, 2000, Vol. 132, p. 715.

Waste water disposal systems for isolated dwellings (Environment Quality Act). Proposed amendments to the regulation may be found in the Quebec Gazette, October, 13, 1999, Vol. 131, No. 42, p. 3623.

2. AMENDMENTS


The following list contains information about amendments which have come into force between February and March 2000, and have been incorporated in the respective legislation by CCOHS staff. The amended legislation will appear on the 2000-2 issue of the Canadian enviroOSH Legislation series.

2. CANADA

ACTS

Canada Shipping Act: As a consequential amendment of 1998, c. 30 now in force, four sections are amended by a name change to the Ontario Superior Court of Justice.

Mackenzie Valley Resource Management Act: As a consequential conditional amendment of 1998, c. 15 now in force, sections 51, 60, 78 and 141 are amended (reference to Nunavut) and section 142 replaced (transregional impact).

REGULATIONS

National Energy Board Pipeline Crossing Regulations, Part II (Miscellaneous Program) (National Energy Board Act): Regulation SOR/2000-58 makes a minor change to a definition in section 1 and replaces section 9(1) (location of pipeline company pipes).

2. BRITISH COLUMBIA

ACTS

Commercial River Rafting Safety Act: As a consequential amendment of 1999, c. 38 (Bill 74) now in force, sections 4 (registration or licence) and 7 (permits) are amended.

Forest Practices Code of British Columbia Act: That part of 1999, c. 34 (Bill 82) now in force, adds 2 definitions to section 1.

Land Act: As a consequential amendment of 1999, c. 38 (Bill 74) now in force, sections 18 (land below natural water boundary) and 61 (enforcement of payment) are replaced; other sections have administrative changes made.

Waste Management Act: As a consequential amendment of 1999, c. 38 (Bill 74) now in force, sections 13(8) and 14(1.1) are added (notices/consent by electronic means).

Water Act: 1999, c. 49 (Bill 72) now in force, among other changes, replaces section 10 (procedure to acquire licences); adds sections 12.1 (quick licencing procedures) and 22.01 (beneficial use declaration by licensee); replaces section 48 (protection of officers from actions).

Worker's Compensation Act: B.C. Regulation 39/2000 amends items 12 and 13 of Schedule B (12. Bursitis & 13. Tendinitis, tenosynovitis).

REGULATIONS

Administrative Remedies Regulation (Forest Practices Code of British Columbia Act): Regulation 53/2000 amends the Schedule table in various places (references to Forest Road Regulation).

Commercial River Rafting Safety Regulation (Commercial River Rafting Safety Act): Regulation 15/2000 amends section 5 (fees).

Emergency Vehicle Driving Regulations (Motor Vehicle Act): Regulation 37/2000 replaces a definition in section 1, replaces section 4 (emergency response by peace officer) and amends sections 5 and 7.

Forest Road Regulation (Forest Practices Code of British Columbia Act): Regulation 53/2000 amends the regulation in several places, including: adding sections 2.2 (exemptions from Act requirement for road permit and road use permit), 2.3 (exemption from district manager approval of road layout and design for construction), 2.4 (exemption from district manager approval of road layout and design for modification); replacing sections 22 (hazard warning prior to road deactivation) and 23 (inspection and remedial work after temporary or semi-permanent deactivation).

Motor Vehicle Act Regulations: B.C. Reg. 40/2000 amends sections 19.11 (overload prohibition) and section 25.15 (excess loads on vehicles).

ACTS

Highway Traffic Act: 1999, c. 35 (Bill 35) now in force, mainly amends sections 242.1 (impoundment of vehicles for driving disqualified and alcohol related offences) and 264 (automatic suspension for refusal to provide breath or blood sample). 1999, c.12 (Bill 5) now in force makes several amendments, including replacing section 28.3 (reinstatement of impaired persons), adding section 28.5 (disease or disability discovered through required assessment), replacing sections 225(5.1) (defence of accused re motor vehicle/off-road vehicle); 264(7) (impoundment of driver's licence); 279(1) (restoration of licence, etc. by appeal board).

2. NEW BRUNSWICK

REGULATIONS

Environmental Impact Assessment Regulation (Clean Environment Act): Regulation 2000-6 replaces paragraph (h) of Schedule A (pipelines).

2. NORTHWEST TERRITORIES

REGULATIONS

General Regulations (Workers' Compensation Act): Regulation R-102-99 replaces section 3(4) (change in daily subsistence allowance for worker on Board-related activities).

2. NOVA SCOTIA

REGULATIONS

General Regulations (Workers' Compensation Act): Regulation 17/2000 repeals section 8 (aviation and aerial transportation) and transfers the category to Appendix A.

ACTS

Highway Traffic Act: The section of 1999, c. 12 (Bill 11) enacting section 7.1 (International Registration Plan) is now in force.

REGULATIONS

Spills (Environmental Protection Act): section 16 is amended to clarify the meaning of "spouse" and define "same-sex partner". (In force March 1, 2000).

Electrical Inspection Act Canadian Electrical Code Regulations (Electrical Inspection Act): Regulation EC2000-128 provides for the use of the 18th Edition of the Canadian Electrical Code, Part I, and provides necessary amendments and alterations to the 18th Edition.

2. QUEBEC

ACTS

Environment Quality Act: 1999, c. 76 (Bill 91) adds section 31.8.1 which empowers the Minister of the Environment to make an agreement with the competent authority to coordinate all applicable environmental assessment procedures, where a project is to be carried out partly outside Quebec and is subject to another environmental assessment procedure.

Highway Safety Code: Sections of 1996, c. 56 now in force amend sections 328 and 474. 1999, c. 66 (Bill 58), among other amendments: changes the rules governing the disposal of unclaimed road vehicles after being seized from a driver (Division III - Disposal of the Road Vehicle by the Société, sections 209.17 to 209.22.3 (these sections in force May 1, 2000)); introduces new measures concerning the powers of highway controllers and on-road inspections.

An Act respecting the owners and operators of heavy vehicles: As a consequential amendment of 1999, c. 66 (Bill 58) section 39 is amended (references to Highway Safety Code).

2. YUKON

REGULATIONS

General Regulations (Motor Vehicles Act): Regulation 1999/31 amends section 5 and replaces section 76 (red and orange flashing lights for school buses).
