2. AMENDMENTS

The following list contains information about amendments which have come into force between March 2001 and April 2001, and have been incorporated in the respective legislation by CCOHS staff. The amended legislation will appear on subsequent issues of the Canadian enviroOSH Legislation

2. CANADA
ACTS

Canada Oil and Gas Operations: As a consequential amendment of 1998, c. 5 now in force, sections 3 and 5.01 are amended.

Mackenzie Valley Resource Management Act: As a consequential amendment of 2000, c. 32, the Act is amended in various sections to change references to the new Canada National Parks Act.

Northwest Territories Waters Act: As a consequential amendment of 2000, c. 32, section 2(1) is replaced.

Territorial Lands Act: As a consequential amendment of 2000, c. 32, section 3(3) is replaced.

REGULATIONS

Domestic Substances List (Canadian Environment Protection Act, 1999): Regulation SOR/2001-77 adds 20 chemicals to Part I, one chemical to Part II, and deletes 10 chemicals from Part II. SOR/2001-78 adds 94 chemicals to Part I and 51 chemicals to Part II of the DSL. SOR/2001-109 adds 1 chemical to Part I of the DSL. SOR/2001-110 adds 6 chemicals to Part I and 10 chemicals to Part II of the DSL.

Migratory Birds Regulations (Migratory Birds Convention Act): Regulation SOR/2001-90 replaces Table I.2 (Overabundant Species) in Schedule 1 for Quebec and Manitoba and adds same for Saskatchewan and Nunavut.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Regulation SOR/2001-116 amends Schedule IV by specifying new expiration dates for sections 108 (lighting systems and retroreflective devices), 131 (school bus pedestrian safety devices), and 206 (door locks and door retention components). Regulation SOR/2001-117 amends definitions in section 2(1) to relieve power-assisted bicycles from having to comply with federal safety standards, provided they possess certain technical characteristics.

National Energy Board Act Part VI (Oil and Gas) Regulations (Miscellaneous Program) (National Energy Board Act): Regulation SOR/2001-120 corrects non-substantive problems (previous amendments omitted and now restored to sections 23 and 29; section 16 corrected).

National Energy Board Cost Recovery Regulations (National Energy Board Act): Regulation SOR/2001-89 amends the regulation in several sections in order to integrate commodity pipelines (pipelines which carry a commodity other than oil or gas) into the National Energy Board cost recovery methodology.

REGULATIONS

Code for Plumbing Services (Environmental Protection Act): Regulation 2001-86 adopts the National Plumbing Code of Canada 1995 Edition as the plumbing code for PEI, and makes amendments reflecting this.

Ozone Depleting Substances and Replacement Regulations (Environmental Protection Act): Regulation 2001-61 amends the regulation in several places in order to comply with the "National Action Plan for Recovery, Recycling and Reclamation of CFCs" developed by the Canadian Council of Ministers. Included in the amendments is an addition to Schedule A (Category III Perfluorocarbons (PFCs)).
