The following list contains information about amendments which have come into force between May and June 2001, and have been incorporated in the respective legislation by CCOHS staff. The amended legislation will appear on subsequent issues of the Canadian enviroOSH Legislation

2. CANADA
ACTS

Canada Labour Code, Part III: 2000, c. 14 replaces section 206.1 (entitlement to leave - new- born or adopted child) and adds section 206.2 (aggregate leave - maternity and parental).

Canada Marine Act: Item 3 of the Schedule (Hamilton Port Authority) is now in force.

Canadian Environmental Protection Act, 1999: SOR/2001-147 adds 5 toxic substances (#s 48 to 52) to Schedule 1 of the Act.

REGULATIONS

Domestic Substances List (Canadian Environmental Protection Act, 1999): Regulation SOR/2001-139 adds 2 substances to Part I of the DSL. SOR/2001-140 adds 15 substances to Part I and 11 substances to Part II of the DSL. SOR/2001-165 adds one substance to Part I of the DSL. SOR/2001-166 adds 17 substances to Part I of the DSL and 12 substances to Part II.

Energy Efficiency Regulations (Energy Efficiency Act): Regulation SOR/2001-150 increases the existing energy efficiency standards for refrigerators, combination refrigerator-freezers and freezers. It also updates the energy performance test procedures referenced for electric ranges and ice makers to the latest version of the appropriate Canadian Standards Association (CSA) standard.

Labour Standards (Canada Labour Code, Part III): Regulation SOR/2001-149 replaces section 33 (expands the list of the members of the employee's immediate family, and changes the definition of "common law" partners).

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Regulation SOR/2001-152 clarifies and updates the requirements governing the integrity of motor vehicle fuel systems. These requirements are contained in subsection 2(1), which sets out the pertinent definitions;

section 301 "Fuel System Integrity"; section 301.1 "LPG Fuel System Integrity"; and section 301.2 "CNG Fuel System Integrity".

New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): Regulation SOR/2001-180 replaces Schedule IX (Types of Polymers) and Schedule X (List of Reactants and their Chemical Abstracts Service Registry Number).

2. BRITISH COLUMBIA
REGULATIONS

Forest Practices Board Regulation (Forest Practices Code of British Columbia Act): Regulation 76/2001 amends sections 5(a) (days for release of final audit report) and 10(1) (submission of Annual Report).

Motor Vehicle Act Regulations: Regulation 89/2001 amends sections 37.03, 37.07, 37.29, 37.33 and 37.331; adds section 37.061 (safety ratings assigned by Insurance Corporation of British Columbia). Regulation 90/2001 makes a minor change to the "SCHOOL AREA (Warning)" wording in Schedule 1 of Division 23. Regulation 91/2001 amends section 43.05 (money amounts changed).

Operational Planning Regulation (Forest Practices Code of British Columbia Act): Regulation 76/2001 adds section 1.1 (criteria for giving effect to operational plans).

Power Engineers, Boiler, Pressure Vessel and Refrigeration Regulation (Power Engineers and Boiler and Pressure Vessel Safety Act): Regulation 92/2001, among other changes, adds provisions for "antique show boiler", "greenhouse plant", and "oilwell plant"; replaces section 4 (duration of certificates); adds sections 23.1 to 23.5 (various operator certificates).

2. MANITOBA
REGULATIONS

Operations of Mines Regulation (Workplace Safety and Health Act): Regulation 56/2001, among other changes, replaces section 29(6) & (7) (lifelife / fall arresting devices), section 111(4)(c) (fuel standards required); adds 112(8) & (9) (braking systems), and new section 112.1 (remote controlled equipment).

Threatened, Endangered and Extirpated Species Regulation (Endangered Species Act): Regulation 47/2001 replaces section 1 (list of threatened species).

2. NEW BRUNSWICK
ACTS

Environmental Trust Fund Act: As a consequential amendment of 2000, c. 34, section 1(2) is repealed and section 3(b) is replaced.

Motor Vehicle Act: As a consequential amendment of 2000, c. 28, section 71 is repealed.

REGULATIONS

General Regulation (Electrical Installation and Inspection Act): Regulation 2001-42 changes the modifications to the Canadian Electrical Code in section 1 and amends several sections to accommodate new definitions for "emergency repair", "portable outdoor sign", "service entrance relocation", "sign installer", "sign installer contractor", and "sign installer helper".

General Regulation (Occupational Health and Safety Act): Regulation 2001-33 makes extensive amendments to the General Regulation, including: updating various CSA, CGA, and ANSI standards throughout the regulation; replacing sections: 30(1) & (3) (noise exposure levels), 34 (laser radiation), 301 (divers); adding new sections: 23.1 (TLVs for formaldehyde and lead sulfide), 25.2 (dust), 33.2 (vibration), 129.1 to 129.3 (forklift platforms), 207.1 to 207.2 (mobile cranes), 210.01 (hoisting apparatus), 213.1 to 213.5 (mobile cranes), 216.1 to 216.2 (industrial lift trucks), 229.1 to 229.2 (powered mobile equipment), 230.2 to 230.5 (vehicles), 287.1 to 287.6 (electrical equipment).

Wellfield Protected Area Designation Order (Clean Water Act): Regulation 2001-37 adds Schedule A.1 (Plaster Rock), Schedule A.2 (Town of Shippagan), and Schedule A.3 (Village of Tide Head) (protected areas).

2. NEWFOUNDLAND
REGULATIONS

Workplace Health, Safety and Compensation Regulations (Workplace Health, Safety and Compensation Act): The part of Regulation 34/01 in force repeals section 20 (minimum compensation). The remainder of 34/01 is in force January 1, 2002.

Workplace Health, Safety and Compensation Review Division Regulations (Workplace Health, Safety and Compensation Act): Regulation 33/01 updates references to the Act in various sections, and repeals section 10 (filing of request).

2. NORTHWEST TERRITORIES
ACTS

Workers' Compensation Act: That section of 2000, c. 11 repealing section 7.7(4) (participation of appeals tribunal chairperson in Board decision) is now in force.

REGULATIONS

Boilers and Pressure Vessels Regulations (Boilers and Pressure Vessels Act): Regulation R-053-2001 replaces items 3(1) & (2) of the Schedule (annual fees for boilers and pressure vessels).

2. ONTARIO
REGULATIONS

Mines and Mining Plants (Occupational Health and Safety Act): Regulation 174/01 amends sections 1 (definition of "explosive"), 11, 11.1, 181, and 197. It replaces section 181(1) and adds 181 (1.1) (explosive actuated tools), sections 182(4) (cites 2 CGSB standards), 262(2) (retroreflective clothing mandatory in underground mines), and 263 (illumination on surface).

2. YUKON
ACTS

Workers' Compensation Act: As a consequential amendment of 2000, c. 17, section 11.1(7) is replaced (workers' advocate may employ others).

3. REPEALED LEGISLATION

The following documents were repealed by the respective jurisdictions and are removed from the Canadian enviroOSH Legislation series as of April 2001. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).
