2. AMENDMENTS

The following list contains information about amendments which have come into force between August and September 2001, and have been incorporated in the respective legislation by CCOHS staff. The amended legislation will appear on subsequent issues of the Canadian enviroOSH Legislation

2. CANADA

REGULATIONS

Controlled Products Regulations (Hazardous Products Act): Regulation SOR/2001-254 amends various sections, including: adding sections 10.1 (mixtures containing non-radioactive carrier materials), 17.1 (radioactive nuclide mixtures), and adds Schedule I.1 (Physical Containment Requirements for Low Individual or Community Risk Agents). The amendments address the gap created by the re-definition of nuclear substance under the new Nuclear Safety and Control Act.

Exclusion List Regulations (Canadian Environmental Assessment Act): Regulation SOR/2001-256 corrects a wording error in section 41(2) of Schedule I..

Law List Regulations (Canadian Environmental Assessment Act): Regulation SOR/2001-257 corrects a numbering error in item 17.1 of Part I of Schedule I..

Radiation Emitting Devices Regulation (Radiation Emitting Devices Act): Regulation SOR/2001-252 replaces Part XII of Schedule II - ADiagnostic X-Ray Equipment@ to make it compatible with internationally accepted standards and reflect the current state of diagnostic x-ray equipment design and technology.

2. BRITISH COLUMBIA
ACTS

Motor Vehicle Act: That section of 2001, c. 32 (Bill 11) now in force replaces section 135.1 (prohibition against obstruction of traffic light safety devices).

REGULATIONS

Fishing Industry Regulations (Workers Compensation Act): Sections 8, 9 and 9.1 are repealed by B.C. Reg. 152/2001 (in effect 90 days after deposition of June 5, 2001).Occupational Health and Safety Regulation (Workers Compensation Act): B.C. Reg. 58/2001 replaces section 4.82(3) (employer must ensure employee does not work indoors where smoking permitted, and exceptions); repeals section 4.83. In force Sept. 10, 2001.

2. MANITOBA
REGULATIONS

Inspection of Motor Vehicles for Registration Purposes Regulation (Highway Traffic Act): Manitoba Reg. 120/2001 amends section 4 (completion time for inspection reduced) and increases fees in section 9 and Schedule B.Periodic Mandatory Vehicle Inspection Regulation (Highway Traffic Act): Manitoba Reg. 121/2001 increases fees in Schedule C (inspection certificates).


2. ONTARIO
ACTS

Conservation Authorities Act: As a consequential amendment of 2001, c. 8 (Bill 45, Part XIV), section 33 is amended (Ontario Property Assessment Corporation re-named).

REGULATIONS

Fire Code (Fire Protection and Prevention Act): Regulation 315/01 replaces article 5.6.1.1. (compressed gases).

2. QUEBEC
ACTS

Conservation and Development of Wildlife:
As a consequential amendment of 2000, c. 8 now in force, section 141 is replaced (Fondation de la faune du Québec, appointment and remuneration of personnel).
As a consequential amendment of 2001, c. 6 (Bill 136) a minor change is made to section 36.1.
An Act respecting la Société québécois de récupération et de recyclage: As a consequential amendment of 2000, c. 8 now in force, section 13 is replaced (staffing and remuneration of the Société) and section 17 amended.
Mining Act: As a consequential amendment of 2001, c. 6 (Bill 136) the following sections are amended: 32, 155, 213, 213.1, 213.2, 232, and 304. The amendments relate to the amendments to the Forest Act.

REGULATIONS

Solid Waste Regulation (Environment Quality Act): As a consequential amendment of the new Regulation respecting the burial of contaminated soils (O.C. 843-2001), the definition of
Asolid waste@ in section 1, and section 54 are amended.

2. YUKON
ACTS

Motor Vehicles Act: Sections of 2000, c. 18 are now in force amending several sections, including: replacing a definition with Aalcohol ignition interlock device@ in section 1; adding and changing references to the Criminal Code in various sections; amending section 9 (learner=s licence); adding section 17.1 (medical condition affects operator=s licence); adding section 226.1 (carrying of firearms by officer); amending section 235 (disqualification order removed).
3. REPEALED LEGISLATION
The following documents were repealed by the respective jurisdictions and are removed from the Canadian enviroOSH Legislation series as of April 2001. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).
