The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to December 2001. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between September and December 2001. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2001. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2002-1 issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2002-1 issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Administrative Items Regulation (Safety Codes Act): Regulation 206/2001 amends sections 12 and 13(1) (department name)

Calgary Restricted Development Area Regulations (Government Organization Act): Regulation 198/2001 adds information to Schedule A (land in Township 22, Range 29, west of the fourth meridian). Regulation 206/2001 amends section 2, 4, and 8 (names of ministries).

Commercial Bus Inspection, Equipment and Safety Regulation (Motor Transport Act): Regulation 206/2001 replaces the definition of "Director" in section 1.

Dangerous Goods Transportation and Handling Regulation (Dangerous Goods Transportation and Handling Act): Regulation 206/2001 replaces the definition of "Director" in section 1 and updates a reference to a federal Act (Nuclear Safety and Control Act) for Class 7 nuclear substances in the Schedule.

Design, Construction and Installation of Boilers and Pressure Vessels Regulations (Safety Codes Act): Regulation 203/2001 replaces section 5(1) (updates various codes and standards) and adds new section 5.1 (disclaimer by Crown for codes and standards declared in force).

Edmonton Restricted Development Area Regulations (Government Organization Act): Regulation 199/2001 amends 3 items in the Schedule. Regulation 206/2001 amends sections 2 and 4 (names of ministries).

Exploration Regulation (Public Lands Act): Regulation 206/2001 updates the names of ministries and departments in several sections and replaces section 25(1) (licensee or permittee for a program of exploration in the White Area shall notify).

Food Regulation (Public Health Act): Regulation 206/2001 amends the definition of "approved laboratory" in section 1 and makes changes to ministerial and departmental names in various other sections.

Forest Resources Improvement Regulation (Environmental Protection and Enhancement Act): Regulation 206/2001 amends sections 1(e) and 3(2) (ministerial name changes).

Highway Traffic Regulation (Highway Traffic Act): Regulation 206/2001 amends subsection 38(1)(c) (ministerial name change).

Lubricating Oil Material Recycling and Management By-law (Environmental Protection and Enhancement Act): Regulation 206/2001 amends sections 11 and 12 (departmental name change).

Lubricating Oil Material Recycling and Management Regulation (Environmental Protection and Enhancement Act): Regulation 206/2001 amends sections 1 and 8 (department/ministerial name changes).

Occupational Health and Safety Act: 2001, c. 10 (Bill 16) in force January 1, 2002 amends section 5 to expand the duties of employers in relation to recommendations from occupational health and safety committees and worker health and safety representatives and their participation in workplace inspections; section 7 is amended to require workers to co-operate with occupational health and safety committees and worker health and safety representatives in their workplaces; sections 36.1 and 36.2 are added to require employers with 10 or more workers at a workplace to have an occupational health and safety program and employers with less than 10 workers to have an occupational health and safety policy. The content of the program and policy would be provided for in the regulations; section 38.1 is added to the Act to require employers to provide and pay for training of members of the occupational health and safety committee at their workplaces; section 39 is amended to require that occupational health and safety committees participate in workplace inspections conducted by employers in accordance with the regulations; section 41 is replaced to require employers with less than 10 workers at a workplace to designate and provide training to a worker health and safety representative; section 65 is amended to permit regulations to be made respecting occupational health and safety programs and policies.

Smoke-free Environment Act: 2000, c. 23, in force January 1, 2002, amends section 5 to prohibit smoking in food establishments and public places that are frequented by children; amendments to other sections concern enforcement by owners and employers, prosecution, and regulatory measures.

Workplace Health, Safety and Compensation Act: The remaining amendments of 2001, c. 10 (Bill 16) in force January 1, 2002: section 19 is amended to expand the exclusive jurisdiction of the commission to include determinations respecting labour market re-entry assessment, a worker's return to work and an employer's obligation to re-employ a worker; section 26 is amended to expand the jurisdiction of the review division to include decisions respecting return to work services and benefits and the obligations of an employer and a worker under Part VI of the Act; section 54.2 is repealed; Part VI is replaced (ss. 88-89.4) to provide for a comprehensive program for the early and safe return to work of injured workers. The new Part VI would provide that employers be obligated to re-employ their injured workers in certain circumstances and permit regulations to be made respecting obligations of employers and workers engaged primarily in construction; section 123 is amended to provide for regulations to be made respecting the obligations of employers and workers under Part VI of the Act; section 125 is amended to increase the maximum penalty for an offence and to specifically create certain offences.

The purpose of the draft regulations is to establish the minimum standards applicable to the use of a plumbing system and an electrical installation by an owner to ensure the security of the public.

Division 2 AMENDMENTS

Section 2.A Acts

An Act respecting the conservation and development of wildlife: As a consequential amendment of 2000, c. 56 in force January 1, 2002, amendments of an administrative nature are made to sections 128.16, 132, and 171.7.

Environment Quality Act: As a consequential amendment of 2000, c. 56 in force January 1, 2002, amendments of an administrative nature are made to sections 6.9, 34, 53.5, 53.9, 53.13 and 53.24.

Fire Safety Act: As a consequential amendment of 2000, c. 56 in force January 1, 2002, amendments of an administrative nature are made to section 8.

Forest Act: Sections of 2000, c. 56 in force January 1, 2002 make administrative changes to sections 124.2 and 124.18. In addition, sections 164 to 167 and 173 of 2001, c. 6 (An Act to amend the Forest Act and other legislative provisions) are in force January 1, 2002. These sections are not incorporated in the body of the Forest Act. The relevant sections from 2001, c. 6 are:

APROVISIONAL REGIME APPLICABLE TO TIMBER SUPPLY AND FOREST MANAGEMENT AGREEMENTS ...

164. In order to ensure that the interests and concerns of other users of land in a common area are taken into account, and to prevent disputes concerning the carrying out of forest management activities, agreement holders must invite the following persons and bodies to take part in the preparation of the five-year plan :

(1) regional county municipalities and, where applicable, the urban community whose territories contain part of the common area concerned ;

(2) the Native communities concerned, represented by their band council ;

(3) every person or body that, for the common area concerned, in accordance with the Act respecting the conservation and development of wildlife (chapter C-61.1), has entered into an agreement for the management of a controlled zone, is authorized to organize activities or provide services in a wildlife preserve, or holds an outfitter=s licence ;

(4) every holder of a sugar bush management permit for an area intended for forest production within a management unit and every holder of a lease of land intended for agricultural purposes within the common area.

The agreement holder may also issue invitations to any other person, organization or body to take part in the preparation of the plan.

165. The agreement holder shall transmit to the Minister, with the five-year plan, a report identifying the persons or bodies invited to participate in preparing the plan and those that actually participated in the preparation of the plan, describing the participation process and stating, where applicable, the points on which the proposals of the participants and the provisions of the plan diverged.

The agreement holder shall transmit a copy of the report to the participants.

166. The provisions of section 58.1 of the Forest Act apply to the report referred to in section 165 of this Act, and the provisions of section 58.3 of the Forest Act apply to a dispute between an agreement holder and a participant.

167. The provisions of sections 164 to 166 apply to five-year plans and modifications to those plans submitted to the Minister for approval after (insert here the date of coming into force of this section).

173. The annual report submitted to the Minister by an agreement holder after (insert here the date of coming into force of this section) must include the result of the evaluations referred to in section 170. ...

170. Every agreement shall include an undertaking by the holder

(1) to evaluate the quality of the sylvicultural treatments carried out using the method specified in the Minister=s instructions regarding the application of the ministerial order concerning the value of the sylvicultural treatments admitted as payment of dues ;

(2) to evaluate, using the method specified in the forest management manual, the state of the forest stands resulting from the sylvicultural treatments carried out by the holder, in order to determine their ability to achieve the expected results ;

(3) to evaluate, using the method specified in the Minister=s instructions concerning the inventory of ligneous matter, the volume of ligneous matter left on the harvest site ;

(4) to apply the remedial program referred to in section 171.

Notwithstanding the first paragraph, an agreement holder may, with the authorization of and on the conditions determined by the Minister, carry out an evaluation using any other method of equal or superior effectiveness.

The sampling units and sample design used in an evaluation method must be submitted to the Minister for approval.@
