The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2002. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between July and August 2002. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April 2002. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2002-3 issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2002-3 issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 AMENDMENTS

Section 2.A Acts

Arctic Waters Pollution Prevention Act: As a consequential amendment of 2002, c. 10 (Bill C-33), the definition of "analyst" in section 2 is amended.

Canada National Parks Act: Various sections are amended as a result of the Canada National Marine Conservation Areas Act (2002, c. 18, Bill C-10), including the replacement of section 19 (designation of enforcement officers).

Canada Oil and Gas Operations: As a consequential amendment of 2002, c. 10 (Bill C-33), subsection 5.01(2) is replaced (entry on or use of land).

Mackenzie Valley Resource Management Act: As a consequential amendment of 2002, c. 10 (Bill C-33), subsection 60(3.1) is added.

Northwest Territories Waters Act: As a consequential amendment of 2002, c. 10 (Bill C-33) several changes are made, including: adding section 7.1 (Board may collaborate with other water authorities); replacing section 12 (objects of Board); adding sections 15.1 to 15.6 (licence in respect of a use of waters or a deposit of waste in Inuit-owned land; compensation); replacing section 29 (precedence in issuance of licences or authorizations) and subsection 31(3.4).

Yukon Waters Act: As a consequential amendment of 2002, c. 10 (Bill C-33), subsection 31(3.4) is replaced (mitigation of damages - enforcement of undertaking).

Section 2.B Regulations

Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations (Motor Vehicle Safety Act): Regulation SOR/2002-206 amends the regulation in various places to require that infant and child restraint systems be fitted with lower connector systems with which the restraint systems will be secured to the vehicle's lower anchorages; the amendment also permits, but does not require, other categories of restraint systems as well as booster cushions, to be fitted with lower connectors.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Regulation SOR/2002-205 introduces a new standard: "Canada Motor Vehicle Safety Standard (CMVSS) 210.2 'Lower Universal Anchorage Systems for Restraint Systems and Booster Cushions'" (section 210.2 in Schedule IV). It requires passenger cars, multi-purpose passenger vehicles, trucks, and buses to be manufactured with lower universal anchorage systems for the installation of add-on children's restraint systems. Item 210.2 is also added to the table in Schedule III and section 210.1 of Schedule IV is amended.

Dangerous Goods Transportation and Handling Regulation (Dangerous Goods Transportation and Handling Act): The remaining provisions of Alta. Reg. 220/2001 are in force August 15, 2002. They update references to the recently in force federal Transportation of Dangerous Goods Regulations (SOR/2001-286), as well as Canadian Standards Association (CSA) standards B620-98 and B621-98; section 4 is replaced (dis-application of section 5.14 to old containers) and section 5 amended.

Edmonton Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 91/2002 amends the following items in the Schedule: 1, 2, 5, 6, 7 and 9.

Food Regulation (Public Health Act): Alta. Reg. 125/2002 replaces subsection 7(1) (application for food establishment permit), section 13 (refusal of permit); and adds section 7.1 (renewal of permit).

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 83/2002 adds Part 1.1 (section 1.100): SECURITY DEPOSIT FOR WELLS AND FACILITIES; repeals sections 2.081 and 3.069. Alta. Reg. 136/2002 replaces sections 16.040 (classification of oil sands projects), 16.070 (administration fees for wells), 16.080 (administration fee applicable to operator of an oil sands project), 16.081 and 16.100 (fiscal year of the Board).

Commercial Transport Act: As a consequential amendment of 2002, c. 16, now in force, the definition of Amotor vehicle@ in section 1 is replaced.

Fish Protection Act: As a consequential amendment of 2002, c. 7 (Bill 2), subsections 7(9) & (10) are repealed.

Forest Practices Code of British Columbia Act: As a consequential amendment of 2002, c. 7 (Bill 2), a minor change is made to subsection 70(4).

Motor Carrier Act: As a consequential amendment of 2002, c. 16, now in force, the definition of Amotor vehicle@ in section 1 is replaced.

Motor Vehicle Act: 2000, c. 16 now in force, among other changes, adds section 182.1 (motor assisted cycles). The remainder of 2002, c. 25 (Bill 35) is now in force which adds section 105.95 (early release of vehicle because of economic hardship: unlicensed drivers and prohibited drivers) and subsections 210(3.1)(p) & (q). 2002, c. 49 (Bill 52) now in force, amends subsections 105.94(a) & (b) and adds Part 7: Impounding for Racing (sections 241 to 248).

Waste Management Act: As a consequential amendment of 2002, c. 7 (Bill 2), subsection 56.1(1)(e) is amended (striking out AFisheries Renewal BC@). As a consequential amendment of 2000, c. 16, now in force, the definition of Amotor vehicle@ in section 38 is amended.

Water Act: As a consequential amendment of 2002, c. 7 (Bill 2), subsection 41.1(1)(e) is amended (striking out AFisheries Renewal BC@).

Wildlife Act: As a consequential amendment of 2002, c. 7 (Bill 2), subsection 84.1(1)(e)(i) is repealed.

Workers Compensation Act: Sections of 2002, c. 56 (Bill 49) now in force amend the Act extensively, including adding the following new sections: 5.1 (mental stress), 19.1 (period for making payments under sections 17 to 19), 23.1 (period of payment for total or partial disability), 23.2 to 23.5 (retirement benefits), 25.1 (alternate indexing factor -- death of a worker), 25.2 (variation of dollar amounts for other than fatalities), 25.3 (variation of dollar amounts for fatalities), 31.1 (termination of periodic payments), 33.1 (general rule for determination of average earnings), 33.2 to 33.7 (exceptions to section 33.1), 33.8 (determination of average net earnings -- initial period of injury), 33.9 (determination of average net earnings -- long term injury), 33.91 (schedule or procedure for determining average net earnings), 57.1 (obligation of worker to provide information to Board); section 25 is replaced (general indexing factor).

Section 2.A Acts

Environment Quality Act: 2002, c. 35 (Bill 99) amends the Act to empower the Minister of the Environment to combine all the certificates of authorization issued by the Minister under section 22 and relating to the same works or establishment, the same activity or the same work into a single certificate, on the application of the holder of the certificates. It provides that the Minister may not make any modification to the conditions set out in the certificates of authorization so combined that would have the effect of reducing the protection of the environment ensured by those conditions or subjecting the holder to new obligations. It provides for the incorporation into a depollution attestation issued to an industrial establishment under Division IV.2 of the Environment Quality Act of conditions of operation initially set out in an authorization issued for that establishment under section 22, 32 or 48 of that Act. Lastly, for the purpose of ascertaining compliance with the Environment Quality Act and the regulations made thereunder that govern agricultural activities, it authorizes the disclosure of information between the Minister of the Environment and La Financière agricole du Québec. See new sections 2.0.1, 24.1 to 24.4; sections 31.13, 31.26, 31.41.
