The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to January 2003. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. 1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between December 2002 and January 2003. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2002. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2003-1 issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2003-1 issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 AMENDMENTS

Section 2.A Acts

Canada Labour Code, Part I: As a consequential amendment of 2001, c. 27 now in force, subsection 10(4) is amended (reference to another Act).

Canada Shipping Act: As a consequential amendment of 2001, c. 27 now in force, the definition of "qualified person" in section 2, and subsection 125(2) are amended (reference to another Act).

Emergencies Act: As a consequential amendment of 2001, c. 27 now in force, section 4(b) and subsections 30(1)(g) and (h) are amended (reference to another Act).

Marine Liability Act: As a consequential amendment of 2001, c. 27 now in force, subsection 88(4)(b)(i) is amended (reference to another Act).

National Energy Board Act: As a consequential amendment of 2001, c. 27 now in force, subsection 3(4) is amended (reference to another Act).

Section 2.B Regulations

Canada Occupational Health and Safety Regulations (Canada Labour Code, Part II): Regulation SOR/2002-379 makes amendments to reflect the interpretation given in an Ontario court decision with regard to the word "structure" in subsection 12.10(1) (fall protection) of the regulations; the amendments will ensure that employees working on vehicles have the same protection as all other employees under federal jurisdiction.

National Energy Board Cost Recovery Regulations (National Energy Board Act): The regulations were amended in 2001, in part, to provide for a cost recovery cap on the liability of certain pipeline companies. Due to a drafting oversight, no provision was made in the amendments to reallocate the cost recovery shortfall that is created following the application of the cap to qualifying companies. The SOR/2002-375 amendments provide for a redistribution of the shortfall for 2002 and subsequent years. Subsection 10(3) has been repealed.

Environmental Protection Act: As a consequential amendment of 2001, c. 25 proclaimed in force January 1, 2003, section 178 (municipal by-laws) is repealed. 2002, c. 17, (Sch. C and F) (Bill 177) amends the Act in various places to make it consistent with the new Municipal Act, 2001 which comes into force on January 1, 2003. The majority of the changes involve terminology or updating cross-references to refer to the relevant provisions in the new Act.

Fire Protection and Prevention Act: 2002, c. 18 (Sch. N) (Bill 179), among other changes: sections 15 and 31 are amended to allow the removal or dispose of any substance, material or thing from a place if it is necessary in the interest of public safety; sections 33 is amended to deal with explosive materials; amendments to 25 and 26 concern staying the operation of orders if it is in the interest of public safety, As a consequential amendment of 2001, c. 25 proclaimed in force January 1, 2003, among other changes: section 5 is amended (municipalities may establish fire departments) and section 7.1 added (municipality may pass by-laws regarding fire prevention, setting of open fires, and designating fire routes).

Fish and Wildlife Conservation Act, 1997: 2002, c. 18, (Sch. L) (Bill 179) replaces clause 40(2)(b) (animal in captivity for personal education).

Forest Fires Prevention Act: 2002, c. 18, (Sch. L) (Bill 179) adds subsection 5(3) (seizure by officer); amends sections 17, 21 and 30; replaces subsection 18(3), section 19 (Minister may enter into agreements), and 21.1(1) (cost of action re fire).

Forestry Act: 2002, c. 17, (Sch. C) Bill 177, among other changes, repeals sections 14 - 17 and 20; replaces section 5 (Minister may establish programs), 11 (council of a municipality may pass by laws for acquiring lands for forestry purposes), and 12 (council of a municipality may enter into agreements for forestry purposes). In force January 1, 2003.

Healing Arts Radiation Protection Act: 2002, c. 18, (Sch. I) (Bill 179) replaces section 24 (offences and fines).

Health Protection and Promotion Act: As a consequential amendment of 2001, c. 25 proclaimed in force January 1, 2003, among other changes: the definitions of "board of health" and "obligated municipality" in subsection 1(1) are replaced; subsection 49(9) is replaced; section 55 is replaced. 2002, c. 18 (Sch. I) (Bill 179) amendments change court names in various sections and add section 91.1 (medical officer of health may collect personal information).

Highway Traffic Act: As a consequential amendment of 2001, c. 32, now proclaimed in force, section 27 is amended (disabled person parking permit). The part of 2002, c. 18 (Sch. P) (Bill 179) in force repeals subsection 32(8). 2002, c. 17, (Sch. C) (Bill 177) amends section 128 and adds section 128.1; Sch. F amends the Act in various places to make it consistent with the new Municipal Act, 2001 which comes into force on January 1, 2003. The majority of the changes involve terminology or updating cross-references to refer to the relevant provisions in the new Act.

Lakes and Rivers Improvement Act: 2002, c. 18 (Sch. L) (Bill 179) replaces subsection 17(1) (Minister may order the owner of dam to take various actions).

Mining Act: 2002, c. 18 (Sch. M) (Bill 179), among other changes: amends sections 41, 81, 82 and 84 to provide the Minister with a discretionary authority to waive or reduce the interest penalty on overdue rental accounts; section 143 is amended to provide a means of ensuring the timely rehabilitation of mine hazards for which a disclosure plan has been filed under section 147.

Oil, Gas and Salt Resources Act: 2002, c. 18 (Sch. L) (Bill 179) replaces section 7.0.2 (appeal from inspector to Minister or Minister's designee); replaces section 8 (clarifies Commissioner's powers respecting pooling orders, utilization orders); amends section 17 to expand the regulation-making powers of the Lieutenant Governor in Council.

Ontario Heritage Act: 2002, c. 18 (Sch. F) (Bill 179) makes extensive changes to the Act, including: requiring municipalities to keep a register listing heritage conservation districts designated under Part V of the Act; references have been changed to municipal heritage committees; municipal councils will be able to extend the mandate of its municipal heritage committee; provisions relating to the demolition of buildings on a designated property; licensing of archaeological fieldwork; increased fines for demolishing or removing a structure in contravention of the Act.

Ontario Water Resources Act: 2002, c. 17, (Sch. C & F) (Bill 177) amends the Act in various places to make it consistent with the new Municipal Act, 2001 which comes into force on January 1, 2003. The majority of the changes involve terminology or updating cross-references to refer to the relevant provisions in the new Act.

Planning Act: Schedule B of 2002, c. 17 (The Municipal Statute Law Amendment Act, 2002 - Bill 177) updates the Act to conform to the new Municipal Act, 2001. Amendments include: replacing sections 15 (upper-tier municipalities, planning functions), 27 (amendments to conform to official plan); adding sections 39.1 (garden suites) and 77 (County of Oxford). In force, January 1, 2003.

Provincial Offences Act: 2002, c. 18, (Sch. A) (Bill 179) in force provisions make administrative changes to sections 1 and 30.

Public Lands Act: 2002, c. 18 (Sch. L) (Bill 179) replaces subsection 14(7) (convicted person may be ordered to rehabilitate lands); replaces subsections 66(1) & (2) (release of land by Minister).

Public Utilities Act: As a consequential amendment of 2001, c. 25 proclaimed in force January 1, 2003, among other changes: the definition of "public utility" in section 1 is replaced; Parts I - III (sections 2-48) and Parts VI and VII (sections 63 - 64) are repealed; sections 52 - 54 and 66 - 67 are repealed; sections 49 and 57 replaced.

Road Access Act: As a consequential amendment of 2001, c. 25 proclaimed in force January 1, 2003, section 3 is replaced (conditions for judge granting closing order).

Workplace Safety and Insurance Act: In force provisions of 2002, c. 18, (Sch. J) (Bill 179): terminology relating to volunteer ambulance brigades is adjusted throughout the Act; existing section 44(2) is expanded (Board review of payments after 72-month period).

Section 2.B Regulations

Drinking Water Regulation - Larger Water Works (Ontario Water Resources Act): O. Reg. 213/02 provides that on January 1, 2003, Bromate is added to Schedule 4 of the regulation.

General Regulation (Energy Efficiency Act): Parts of O. Reg. 18/02 proclaimed in force December 31, 2002, replace these items of the Schedule: 6, 14, 20 and repeal 14.1; parts proclaimed in force January 1, 2003 replace items 12, 28, and 29. The amendments concern various Canadian Standards Association (CSA) standards.
