The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2003. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between February and March 2003. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2003. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2003-2 issue of the Canadian enviroOSH Legislation CD

Section 2.A Acts

Workers Compensation Act: The remainder of 2002, c. 56 (Bill 49) is proclaimed in force. Among the changes: sections 81 and 82 are replaced (boards of directors); section 84 is replaced (standard of care of the directors); section 84.1 is added (president of the Board must be appointed). The remainder of 2002, c. 66 (Bill 63) is proclaimed in force (March 3, 2003). The major amendments establish the Workers' Compensation Appeal Tribunal under Part 4 (sections 231 to 260); other changes add sections 96.2 to 96.5 (requests for review of decision). B.C. Reg. 324/2002 and 325/2002 adjust the dollar amounts as a result of changes to the Consumer Price Index.

Section 2.B Regulations

Asphalt Plant Regulation (Waste Management Act): B.C. Reg. 357/2002 amends the regulation in several areas, including: adding section 3.1 (electronic reporting); specifying an in force date for the regulation (June 27, 1997); amending section 13 (stack monitoring); adding section 13.1 (subsequent monitoring requirements if stack monitoring exceeds limits). Also, Schedules C and D are repealed and Schedule B is replaced (Hot Mix Asphalt Plant Limits).

Fishing Industry Regulations (Workers' Compensation Act): B.C. Reg. 383/2002 (effective March 3, 2003) amends section 10 (references to Act).

Gas Safety Regulation (Gas Safety Act): B.C. Reg. 334/2002 replaces section 96 (Class B gas fitter licence qualifications).

Wood Residue Burner and Incinerator Regulation (Waste Management Act): B.C. Reg. 382/2002 adds subsections (2.2) and (2.3) to section 2, and extends certain dates in column 2 of Schedule 1.

Division 2 AMENDMENTS

Section 2.A Acts

Act respecting the conservation and development of wildlife: 2002, c. 82 (Bill 147) amendments recognize the right to hunt, fish and trap (Chapter I.1) It provides for a prohibition against hindering a person who is legally carrying on a hunting, fishing or trapping activity. It also provides for a new prohibition against hunting, trapping or fishing on land under private ownership where the owner is a party to an agreement, for wildlife accessibility purposes, with an association or body whose object is the access by hunters, fishers or trappers to such land, unless so authorized. The bill grants the Soci�t� de la faune et des parcs du Qu�bec the power to recognize that association or body for that purpose, subject to the terms and conditions the Soci�t� may determine. The 2002, c. 68 (Bill 77), 2002, c. 74 (Bill 129), 2002, c. 75 (Bill 131) consequential amendments all make minor housekeeping adjustments to the Act.

Act respecting industrial accidents and occupational diseases: 2002, c. 76 (Bill 133) amends the Act in several sections (reference to new Fonds de la sant� et de la s�curit� du travail). 2001, c. 60 (amended by 2002, c. 69 (Bill 96)) updates a reference to an Act in sections 112, 113, and 189.

Act respecting medical laboratories, organ, tissue, gamete and embryo conservation, ambulance services and the disposal of human bodies: As a consequential amendment of 2002, c. 69 (Bill 96) the title of the Act is changed to remove "ambulance services". Changes throughout the Act also remove references to ambulance services, plus references to various Ministerial or regional/board council responsibilities.

Act respecting the Minist�re de l'Environnement: 2002, c. 53 (Bill 130) adds 2 paragraphs to section 14 (free access to land). 2002, c. 74 (Bill 129) amends section 11(4) and adds section 13.1 (exercise of powers of Minister).

Act respecting occupational health and safety: (2002, c. 76) (Bill 133) provides for the establishment of a social trust patrimony to be known as the Fonds de la sant� et de la s�curit� du travail. The fund will be made up, for the greater part, of the assets of the Commission de la sant� et de la s�curit� du travail, which is to be the trustee of the fund. The patrimony of the fund will be dedicated to the payment of the sums or benefits to which any person may be entitled under the Acts administered by the Commission and to the achievement of any purpose provided for in those Acts. The Commission is obliged to prepare and publish a service statement setting out its objectives as regards the level and quality of the services provided, to prepare a strategic plan, and to adopt policies concerning the terms of its contracts and the security and management of its information resources. The Commission is also made subject to reporting obligations. The amendments eliminate the office of chairman and chief of operations of the Commission. (See new sections 136.1 to 136.13 and 161.1 to 161.5; 163.1; 167.1 and 167.2; 170.1; 176.0.1 and 176.0.2). 2001, c. 60 (amended by 2002, c. 69 (Bill 96)) updates a reference to an Act in section 300.

Act respecting the preservation of agricultural land and agricultural activities: The 2002, c. 68 (Bill 77) consequential amendment makes wording changes in various sections.

Act respecting the Soci�t� qu�b�coise de r�cup�ration et de recyclage: 2002, c. 59 (Bill 102) amends the Act in several sections, in particular to revise the rules governing the composition of its board of directors and its operating procedures (see replacement sections 5 to 16).

Act respecting threatened or vulnerable species: The 2002, c. 68 (Bill 77) consequential amendment makes a minor amendment to section 15.

Building Act: As a consequential amendment of 2002, c. 75 (Bill 131), paragraph 2 of section 65.4 is amended.

Environment Quality Act: 2002, c. 53 (Bill 130) transfers certain powers to determine fees from the Government to the Minister of the Environment; any regulation prescribing fees or charges relating to water must be paid to the Fonds national de l'eau. In force provisions affect sections: 31, 32.9, 46, 118.5, 119, and 121. 2002, c. 59 (Bill 102) amendments allow municipalities to be compensated for the services they provide as regards residual materials recovery and reclamation. The compensation regime is based on agreements between the associations of municipalities and the various associations of enterprises concerned. The role of the Soci�t� qu�b�coise de r�cup�ration et de recyclage is to be one of support provider, trustee and, where required, arbitrator. The measures confer new powers on the Soci�t�, among others the mandate to assist the Minister in the exercise of ministerial powers relating to the residual materials management plans developed by the municipalities pursuant to the provisions of the Environment Quality Act. See new sections 53.31.1 to 53.31.20. 2002, c. 11 (Bill 72) in force March 1, 2003 replaces Division IV.2.1 of Chapter I (sections 31.42 to 31.69). The amendments: establish new rules to promote the protection of lands and their rehabilitation in the event of contamination; clarify the conditions on which a person or municipality may be required to rehabilitate contaminated land; confer on the Minister of the Environment various powers; recognize that leaving contaminants in the land is a possible method of rehabilitation provided that certain environmental protection measures are taken; prescribe publicity measures to inform third persons of restrictions that apply to future use of the land; impose obligations on enterprises in industrial or commercial sectors designated by regulation that apply when the enterprises permanently cease activities, for the purpose of identifying and remedying any contamination. Also, municipalities must draw up a list of contaminated lands situated in their territory and may not issue a building or subdivision permit unless a certificate of an expert states that the project is consistent with the provisions of the land rehabilitation plan. The Government determines by regulation the cases where, the conditions on which and the time limits within which persons engaging in certain designated activities will be required to monitor groundwater quality at the hydraulic downstream of the land. New regulatory powers are introduced as regards the treatment, recovery, reclamation and elimination of contaminated soils. 2001, c. 60 (amended by 2002, c. 69 (Bill 96)) updates a reference to an Act in section 93.

Forest Act: The 2002, c. 68 (Bill 77) consequential amendment makes wording changes in sections 124.18, 124.20, 124.21, 124.22 and 124.23.

Highway Safety Code: 2002, c. 62 (Bill 115) enables implementation of the International Registration Plan: it authorizes the Minister of Revenue to verify the operational records of fleets of road vehicles (new section 13.1) and permits the necessary exchanges of information (new sections 610.1 and 610.2). Also, the amendments allows the person responsible for the maintenance of a public highway to identify certain intersections where making a right turn on a red light is prohibited (new section 359.2). 2002, c. 69 (Bill 96) changes the name of an Act in sections 4 and 439.

Public Health Act: 2001, c. 60 (amended by 2002, c. 69 (Bill 96)) updates references to an Act in sections 169, 171, 173, and 175.

Regulation respecting the recovery and reclamation of discarded paint containers and paints(Environment Quality Act): As a consequential amendment of 2002, c. 59 (Bill 102), section 10 is amended.
