The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to May 2003. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. 1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between April and May 2003. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April 2003. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2003-2 issue of the Canadian enviroOSH Legislation CD

Division 2 AMENDMENTS

Section 2.A Acts

Canada Wildlife Act: Consequential amendments of 2002, c. 29 are now proclaimed in force: the Governor in Council is allowed to authorize the Minister of the Environment to exercise certain powers over public lands administered by another federal minister; also to make regulations prohibiting access to these lands, prescribing measures for the conservation of wildlife on such lands and respecting the establishment and maintenance of works for wildlife research, conservation and interpretation on such lands. These amendments also allow the Minister of the Environment to delegate any of his powers under this Act to another federal minister. See sections: 4(2), 4.1, 12(a) and 12(i) and (j).

Canadian Environmental Protection Act, 1999: SOR/2003-98 replaces the Mirex and benzidine entries in Schedule 1. SOR/2003-100 replaces the Mirex entry in Schedule 3; the same terminology is now used in both Schedules.

Migratory Birds Convention Act, 1994: Consequential amendments of 2002, c. 29 are now proclaimed in force, adding section 11.1 (delegation by Minister).

Nuclear Safety and Control Act: 2003, c. 1 (Bill C-4) replaces subsection 46(3) to vary the classes of persons that the Canadian Nuclear Safety Commission may order to take measures to reduce the level of contamination of a place.

Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act: Consequential amendments of 2002, c. 29 are now proclaimed in force: subsection 10(4) is added (delegation by Minister), subparagraph 21(1)(c)(v) is added, and section 21.1 is added (Governor in Council may, by order, amend the definition of "animal" or "plant" in section 2 for purposes of subsection 6(2)).

Section 2.B Regulations

Canada Oil and Gas Certificate of Fitness Regulations (Canada Oil and Gas Operations): SOR/2003-81 replaces the definition of "certifying authority" in section 2.

Gasoline Regulations (Canadian Environmental Protection Act, 1999): SOR/2003-106 amends subsection 3(2) (to allow an exemption, until January 1, 2008, with respect to gasoline for use in competition vehicles); section 8 is replaced (standard for measurement of phosphorous); paragraph 11(1)(e) is replaced; subsection 11(4) added (signing of record).

Migratory Birds Regulations (Migratory Birds Convention Act): SOR/2003-84 replaces paragraph 4(9)(b) and amends tables I.2 of Part V and I.2 of Part VIII of Schedule I. The intent of the amendments is to reduce the population size of overabundant snow goose populations.

Steering Appliances and Equipment Regulations (Arctic Waters Pollution Prevention Act; Canada Shipping Act): SOR/2003-86 replaces section 2.1 to correct an error of omission in SOR/2002-426.

Calgary Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 6/2003 amends various sections in Schedule A: Township 22, Range 29, West of the Fourth Meridian; Township 23, Range 29, West of the Fourth Meridian; Township 24, Range 2, West of the Fifth Meridian; Township 25, Range 29, West of the Fourth Meridian; Township 25, Range 1, West of the Fifth Meridian; Township 25, Range 2, West of the Fifth Meridian. In addition, Township 25, Range 28, West of the Fourth Meridian (Section 31) is added.

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 32/2003 adds subsection 11.010(3) (requirements for vialled drill cuttings); replaces and repeals sections in Part 12 - Records and Reports and Part 15 - Certain Applications (these sections now cite the Alberta Energy and Utilities Board Guide 7 and Guide 65 publications, respectively); clauses l and m of subsection 17.010(1) are replaced.

Radiation Health Administration Regulation (Government Organization Act): Alta. Reg. 40/2003 replaces Schedules 1 (Organizations) and 2 (Agencies).

Manifest Regulation (Dangerous Goods Handling and Transportation Act): Man. Health Protection and Promotion Act: 2001, c. 30 proclaimed in force May 1, 2003, adds sections 22.1 (order for blood samples by medical officer of health, as a result of contact with bodily substance of another person by applicant) and 97 (Minister's regulations); and amends clause 96(1)(a).

Workplace Safety and Insurance Act: The remainder of 2002, c. 18, Sch. J which amends section 45 of the Act, is now proclaimed in force. The amendments allow a beneficiary designated by the worker or the worker's estate to receive loss of retirement income benefits when there are no survivors; the Workplace Safety and Insurance Board may withdraw funds set aside for the worker where no benefit is payable and return them to the employer or insurance fund.

Section 2.B Regulations

Endangered Species Regulation (Endangered Species Act): O. Reg. 57/03 adds 1 item to Schedule 1 and 3 items to Schedule 2. O. Reg. 58/03 adds 3 items to Schedule 2.

General (Energy Efficiency Act): Sections of O. Reg. 18/02 in force April 1, 2003 replaces item 40 of the Schedule with items 40, 40.1 and 40.2, and adds item 53. The remainder of O. Reg. 364/00 in force April 1, 2003 adds items 46 to 52 to the Schedule. These additions relate to various Canadian Standards Association (CSA) standards for various electrical appliances.

Hospital Management (Public Hospitals Act): O. Reg. 64/03 amends the regulation in several places, mainly related to administrative matters concerning the position of "chief nursing executive" and "extended class nursing staff"; a new section 7.1 is added (nursing advisory committee).

Safety Helmets (Highway Traffic Act): O. Reg. 38/03 amends section 4 (standards for helmets).

Pesticides Control Act: 2002, c. 18, now proclaimed in force,amends two definitions in section 1 to change the Department and Minister responsible for pesticides control.

Water Well Regulations (Environmental Protection Act): EC2003-107 makes extensive changes to the regulations: it replaces the definitions in section 1; specifies the requirements for a well driller to obtain a licence; removes provisions for a Water Well Advisory Board and adds provisions respecting a well contractor's license; describes requirements for a well construction report; provides that a well permit is not required for an area where a groundwater exploration permit is required; provides requirements for a groundwater exploration permit and a groundwater extraction permit; standards of equipment and materials used in constructing a well; setback distances for a well and adds a requirement that contaminant sources must not be constructed or located nearer than the setback distances; the installation of well casing and grout; well completion requirements; well abandonment; pump installation and clean-up; amends the Schedules.
