The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to June 2003. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between May and June 2003. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of May 2003. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2003-2 issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2003-2 issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 AMENDMENTS

Section 2.A Acts

Arctic Waters Pollution Prevention Act: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to the definition of "analyst" in section 2.

Canada Labour Code: As a consequential amendment of 2002, c. 7, now in force, minor changes are made to paragraphs 123(1)(a) (Canada Labour Code Part II) and 167(1)(a) (Canada Labour Code Part III). The changes affect the English versions only.

Canada Marine Act: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to the definition of "court" in section 103.

Canada National Parks Act: As a consequential amendment of 2002, c. 7, now in force, "Yukon Territory" is replaced with "Yukon" in various places in Schedules 1 and 2.

Canada-Newfoundland Atlantic Accord Implementation Act: As a consequential amendment of 2002, c. 7, now in force, minor changes are made to definitions in subsections 6(1) and 218(1).

Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to the definition of "province" in subsection 223(1).

Canada Water Act: As a consequential amendment of 2002, c. 7, now in force, the definition of "federal waters" in subsection 2(1) is replaced.

Canadian Centre for Occupational Health and Safety Act: As a consequential amendment of 2002, c. 7, now in force, minor changes are made to paragraph 4(b) and subsection 26(4) of the English version of the Act.

Canadian Environmental Assessment Act: As a consequential amendment of 2002, c. 7, now in force, the definitions of "federal authority" and "federal lands" in subsection 2(1) are amended; subparagraph 48(6)(a)(i) is replaced.

Canadian Environmental Protection Act, 1999: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to subparagraph 6(2)(c)(v), and subsection 207(1.1) is added.

Canadian Transportation Accident Investigation and Safety Board Act: As a consequential amendment of 2002, c. 7, now in force, subsection 14(2) is replaced (request by a department or province).

Employment Equity Act: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to the definition of "private sector employer" in section 3.

Fisheries Act: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to the definition of "judge" in section 74.

Government Employees Compensation Act: As a consequential amendment of 2002, c. 7, now in force, a minor changes is made to subsection 5(1).

Hazardous Materials Information Review Act: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to paragraph 28(2)(e) of the English version of the Act.

Mackenzie Valley Resource Management Act: As a consequential amendment of 2002, c. 7, now in force, the definition of "Mackenzie Valley" in section 2 is replaced; section 141 is amended; section 142 is replaced.

Railway Safety Act: As a consequential amendment of 2002, c. 7, now in force, a minor change is made to the definition of "superior court" in paragraph 4(1)(e).

Territorial Lands Act: As a consequential amendment of 2002, c. 7, now in force, the following sections are amended: 2, 3, 4, 6, 9, 13, 23, 30. Sections 17 and 18 are repealed (timber). The main thrust of the amendments is to have the Act cease to apply in the Yukon (instead, the Territorial Lands (Yukon) Act will apply).

Section 2.B Regulations

Domestic Substances List (Canadian Environmental Protection Act): SOR/2003-96 deletes 1 substance from Part 1 of the DSL and adds 13; 7 substances are deleted from Part 3 and 4 are added. SOR/2003-150 adds 1 substance to Part 1 of the DSL. SOR/2003-151 adds 5 substances to Part 1 of the DSL and 5 to Part 3.

Fish Toxicant Regulations (Fisheries Act): SOR/2003-137 amendments are administrative in nature; one series of amendments correct cross references to Fisheries Act sections that have been renumbered.

Section 2.A Acts

Hydro and Electric Energy Act: As a consequential amendment of 2003, c. E-5.1 (Bill 3), section 3 is replaced (guidance to Board); subsection 18(3) is repealed; sections 22, 29, and 37 are amended.

Workers' Compensation Act: 2003, c. 10 (Bill 202) adds section 24.1 (presumption of occupational disease for firefighters).

Section 2.B Regulations

Coal Conservation Regulation (Coal Conservation Act): Alta. Reg. 63/2003 extends the expiry date of the regulation to June 30, 2009 (section 90).

Exploration Regulation (Mines and Minerals Act): Alta. Reg. 63/2003 extends the expiry date of the regulation to June 30, 2009 (section 52).

Metallic and Industrial Minerals Exploration Regulation (Mines and Minerals Act): Alta. Reg. 63/2003 extends the expiry date of the regulation to June 30, 2009 (section 46).

Mines Safety Regulation (Occupational Health and Safety Act): As a consequential amendment of 62/2003, section 260 is repealed (expiry date for regulation provision).

Soil Conservation Notice Regulation (Soil Conservation Act): Alta. Reg. 63/2003 extends the expiry date of the regulation to November 30, 2010 (section 5).

Water (Offences and Penalties) Regulation (Water Act): Alta. Reg. 63/2003 extends the expiry date of the regulation to November 30, 2009 (section 7).

Heritage Conservation Act: As a consequential amendment of 2003, c. 15 (Bill 22), Part 3 is repealed (Heritage Trust), sections 24 to 31.

Ministry of Environment Act: As a consequential amendment of 2003, c. 22 (Bill 23), a minor change is made in subsection 5(b).

Motor Vehicle Act: 2003, c. 11, (Bill 17) now proclaimed in force, among other changes: adds section 116.1 (appointment of Director of Commercial Vehicle Safety); adds Part 2.2 (Show Cause Hearings and Reconsiderations about Commercial Motor Vehicles), sections 118.94 - 118.992; substituting "the director" for "Insurance Corporation of British Columbia" in several sections.

Petroleum and Natural Gas Act: As a consequential amendment of 2003, c. 23 (Bill 30), section 72.1 is added (ministers to appoint royalty administrator and royalty collector); sections 73(3), 76(2), and 77 are amended regarding same.

Section 2.B Regulations

Commercial Transport Regulations (Commercial Transport Act): B.C. Reg. 3/2003, among other changes, adds the definitions "permanently mounted equipment" and "TAC (BC) Vehicle" to section 1.01; makes numerous changes to sections in Division 7 (Size and Weight Regulations); all the appendices of Division 7 have been replaced. B.C. Reg. 110/2003 amends subsection 7.07(1)(b) (removes reference to Insurance Corporation of British Columbia).

Elevating Devices Safety Regulation (Elevating Devices Safety Act): B.C. Reg. 29/2003 amends the regulation in several places to update Canadian Standards Association (CSA) Standards: B311, B355, B44, Z267. In addition, sections 12.1 (owner responsibilities) and 25.1 (hydraulic elevating devices) are added; section 25 (welding) is replaced; section 88 is repealed.

Motor Vehicle Act Regulations: B.C. Reg. 82/2003 amends sections 11.01, 11.04, 11.13, and replaces section 11.16 (mechanical standards). The changes mainly relate to the requirement for conformity to Canadian Standards Association (CSA) standard D250 (School Buses). B.C. Reg. 135/2003, among other changes, replaces "Insurance Corporation of British Columbia" with "director" [Director of Commercial Vehicle Safety] in several sections.

Operational and Site Planning Regulation: (Forest Practices Code of British Columbia Act): B.C. Reg. 123/2003 amends definitions in section 1 regarding various forest regions; replaces subsection 11(1) (maximum cutblock must not exceed ... for various regions and districts).

Post-Consumer Residual Stewardship Program Regulation (Waste Management Act): B.C. Reg. 21/2003, among other changes, adds the definition "brand-owner plan association" to section 1; adds section 5.1 (exemption of paint stewardship program from plan refiling); adding the following product categories to both Schedules 1 and 2: lubricating oil, empty oil container, oil filter, and paint.

Woodlot Licence Forest Management Regulation (Forest Practices Code of British Columbia Act): B.C. Reg. 123/2003 replaces the definition of "Coast" in section 1.

Clean Environment Act: 2003, c. 6 (Bill 19) introduces new sections 6.1 to 6.7 relating to the protection of coastal areas and wetlands. Sections 1, 14 and 32 are also amended in relation to same.

Clean Water Act: 2003, c. 5 (Bill 18) replaces the definition of "alteration" and adds the definition "wetland" in section 1; amends section 14 (parcel identifier numbers); amends section 15 (projects affecting watercourse or wetland); adds paragraph 40(o).
