The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2003. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. 1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between August and September 2003. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2003. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2003-3 issue of the Canadian enviroOSH Legislation CD

Division 2 AMENDMENTS

Section 2.A Acts

Public Lands Act: R.S.A. 2000, c. 34 (Supp.) now proclaimed in force, amends clause 7(c)(i) and adds subsection 102(1.1) (grazing lease in a heritage rangeland).

Wilderness Areas, Ecological Reserves and Natural Areas Act: R.S.A. 2000, c. 34 (Supp.) now proclaimed in force, changes the name of the Act to "Wilderness Areas, Ecological Reserves, Natural Areas and Heritage Rangelands Act". The Act is amended in several areas to include "heritage rangelands", including adding section 4.1 (designation of heritage rangeland) and 8.1 (other prohibitions and restrictions respecting heritage rangelands only); section 8.1(3) is not yet in force.

Section 2.B Regulations

Elevating Devices Administration Regulation (Government Organization Act): Alta. Reg. 223/2003 updates references to regulations; specifically cites Canadian Standards Association (CSA) standards: B355, B311, B44, and Z185; extends the expiry date of the regulation.

Environmental Protection and Enhancement (Miscellaneous) Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 225/2003 adds section 5.1 (section 30(10)(b) of Act re forfeited security).

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 190/2003 adds sections 8.001 to 8.006 (comprehensive emergency response plan) and replaces section 8.052 (spill response contingency plan). Alta. Reg. 215/2003 replaces sections 16.081 (annual adjustment factor for fiscal year of the Board) and 16.100 (date of fiscal year of the Board). Alta. Reg. 222/2003 replaces subsection 16.530(1) (calculation of orphan fund levy payable by a licensee).

Oil Sands Conservation Regulation (Oil Sands Conservation Act): Alta. Reg. 191/2003 replaces section 47 (in situ scheme reports) and extends the expiry date of the regulation (section 62).

Pipeline Regulation (Pipeline Act): Alta. Reg. 192/2003 replaces section 50 and adds sections 50.1 to 50.3. The amendments relate to the preparation of comprehensive emergency response plans and spill response contingency plans.

Radiation Health Administration Regulation (Government Organization Act): Alta. Reg. 182/2003 changes some references in sections 1 and 2 to reflect the new Radiation Protection Regulation.

Sewage Disposal Regulations (Environmental Protection Act): EC2003-352 amends the definitions in section 1; clarifies the meaning of references to categories of lots (new section 1.1); clarifies the obligations of a licensed contractor, removes a provision respecting the waiver of examinations, and states that the members of Board of Examiners hold office for a period not exceeding three years; requires compliance by contractors, installers and dwelling owners with the requirements and standards prescribed by the regulations; amends the fees payable for applications for licences and permits; extends the time period for a licensed contractor to supply a certificate of compliance; clarifies who is not to construct a sewage disposal system near a beach; amends the provisions respecting septic tanks, sewer lines, and sewage pumping stations and siphon chambers (new section 9.2); amends the provisions respecting disposal fields, sewage holding tanks, and site suitability assessments; clarifies who has the duty to maintain a sewage disposal system and the requirements, such as obtaining a licence, for cleaning one. Changes also prohibit placing septage or sludge in a holding site without approval, and disposing of unstabilized sludge at any place other than a waste treatment system. Minor corrections are made to Appendix A of the regulations. Appendix E is added respecting the methods for calculating the capacity of grease interceptor tanks.
