The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to January 2004. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between December 2003 and January 2004. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2003. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2004-1 Issue of the Canadian enviroOSH Legislation CD

Division 2 AMENDMENTS

Section 2.A Acts

Marine Liability Act: SOR/2003-353 replaces paragraphs 54(1)(a) & (b) (limitation of liability - convention ships).

Section 2.B Regulations

Domestic Substances List (Canadian Environmental Protection Act): SOR/2003-333 adds one item to Part 1 of the DSL. SOR/2003-334 adds subsection 2(6) ("P" added to substance in Parts 1 to 8 indicates a reduced regulatory requirement polymer or biopolymer); adds 35 items to Part 1; deletes one item and adds 71 items to Part 3 of the DSL. SOR/2003-354 adds 37 items to Part 1 and 27 items to Part 3 of the DSL.

Fishery (General) Regulations (Fisheries Act): SOR/2003-369 amends sections 3, 6, 7, and 37. The amendments mainly concern variation orders.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2003-359 updates and clarifies the safety requirements governing snowmobiles by incorporating by reference the Snowmobile Safety and Certification Committee, Inc. (SSCC) Standards and Supplement into section 1201 of Schedule VI to the MVSR and stipulating those standards and test procedures that are obligatory. Only the testing and construction standards of the SSCC are incorporated into section 1201, the certification requirements being excluded. The amendment also requires that the information specified on the label or plaque affixed to the snowmobiles, as well as any instructions that are provided with snowmobiles, be in both French and English. This amendment also repeals sections 1207, 1208 and 1209 of Schedule VI while adding section 1202, which integrates the existing content of sections 1207 and 1209; in addition, the existing content of 1208 is added as section 906 of Schedule IV, entitled "Snowmobile Trailers". SOR/2003-2, effective January 1, 2004, repeals Schedule V (Vehicle Emissions Standard (Standard 1100)). SOR/2003-2 is a consequential amendment of the On-Road Vehicle and Engine Emission Regulations.

On-Road Vehicle and Engine Emission Regulations (Canadian Environmental Protection Act): The major part of the regulation is in force January 1, 2004 (SOR/2003-2); sections 7 to 9 had already been proclaimed.

Sulphur in Gasoline Regulation (Canadian Environmental Protection Act, 1999): Parts of SOR/2003-319 in force January 1, 2004 replace sections 6 (gasoline-like blendstock) and 7 (retention of records), and amends section 12 (primary supplier's records).

Environment Management Act: As a consequential amendment of 2003, c. 90 (Bill 55) section 21 of the Schedule is amended (name of Act substituted).

Utilities Commission Act: As a consequential amendment of 2003, c. 44 (Bill 39), now in force, subsection 3(2) is replaced (direction to commission by regulation).

Wildlife Act: As a consequential amendment of 2003, c. 90 (Bill 55) several sections are amended and added. Amendments concern the hunting of wildlife, licences, firearms, and offences; new sections 97.1 to 97.6 relate to the seizure of wildlife and its detention and disposition; section 98 is replaced and 98.1 added (disposition of other property seized).

Occupational Health and Safety Act: 2000, c. 15 enacts section 19.3 (private training schools to offer training in ohs principles), effective December 20, 2003.

Sewage Disposal Systems Regulations (Environmental Protection Act): EC2003-427 amends the regulation in several areas, effective January 1, 2004. It amends the definitions in the regulations; clarifies the meaning of references to categories of lots; clarifies the obligations of a licensed contractor, removes a provision respecting the waiver of examinations, and states that the members of Board of Examiners hold office for a period not exceeding three years; requires compliance by contractors, installers and dwelling owners with the requirements and standards prescribed by the regulations; amends the fees payable for applications for licences and permits; extends the time period for a licensed contractor to supply a certificate of compliance; clarifies who is not to construct a sewage disposal system near a beach; amends the provisions respecting septic tanks and sewer lines, sewage pumping stations and siphon chambers, disposal fields, sewage holding tanks, site suitability assessments; clarifies who has the duty to maintain a sewage disposal system and the requirements, such as obtaining a licence, for cleaning one. These sections also prohibit placing septage or sludge in a holding site without approval, and disposing of unstabilized sludge at any place other than a waste treatment system; adds Table A in Schedule I and adds Appendix E respecting the methods for calculating the capacity of grease interceptor tanks.

Section 2.A Acts

Building Act: Section 214 of the Act is now in force concerning the replacement of the Gas Distribution Act by the Building Act, effective December 2, 2003.

Civil Protection Act: As a consequential amendment of 2001, c. 76, section 129 is amended (remedy before the Commission des relations du travail), effective January 1, 2004.

Section 2.B Regulations

Construction Code [Building Code] (Building Act): O.C. 875-2003 (effective December 2, 2003) adds Chapter II - Gas (sections 2.01 - 2.16) concerning approval of appliances and equipment, reporting of work by contractors or owner-builders, inspection fees, and standards. The new chapter makes specific amendments, for the purposes of the regulation, to these CSA standards: B149.1-00, B149.2-00, B108-99, Z662-99, Z276-94.

Regulation respecting the enforcement of certain legislative and regulatory provisions respecting the protection of the environment by wildlife conservation officers (An Act respecting the conservation and development of wildlife): O.C. 1146-2003 amends paragraph 2(1) (enforcement of Environment Quality Act), repeals 2(3) and revokes Division IV (Ecological Reserves) (section 4).

Safety Code (Building Act): O.C. 877-2003 (effective December 2, 2003) adds Chapter III - Gas, consisting of the following Divisions: Interpretation (sections 27 - 29), General (ss. 30 - 38), Gas Installations (ss. 39 - 51), Use, Storage and Distribution of Propane in Containers (ss. 52 - 63.), Distribution of Gas by Pipeline (ss. 64 - 69), Use, Storage and Distribution of Natural Gas in Containers (ss. 70 - 73), Operation Permit (ss. 74 - 85), Contributions [to Board] (ss. 86 - 88), Penal (s. 89).
