The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2004. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. 1A. Acts
Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.
Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).
Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.
1B. Regulations
List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.
2. Amendments
Contains information about amendments which have come into force between January and March 2004. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.
3. Repealed Legislation
Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2004. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

Canada Labour Code, Part I: As a consequential amendment of 2002, c. 8 now in force, minor amendments are made in subsections 22(1), 23(3) and 58(3)(name of court).
Canada Labour Code, Part II: As a consequential amendment of 2002, c. 8 now in force, section 152 is replaced (injunction proceedings).
Canada Labour Code, Part III: As a consequential amendment of 2003, c. 15 now in force, section 206.3 is added (compassionate care leave).
Canada Marine Act: As a consequential amendment of 2002, c. 8 now in force, a minor amendment is made in the definition of "court" in section 103.
Emergencies Act: As a consequential amendment of 2002, c. 8 now in force, a minor amendment is made in subsection 52(3) (name of court).
Employment Equity Act: As a consequential amendment of 2002, c. 8 now in force, minor amendments are made in subsections 30(3) and 39(8)(name of court).

Section 2.B Regulations
Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2003-456 adds 5 substances to Part 1 of the DSL and deletes 2. SOR/2003-457 adds 30 substances to Part 1; adds the following substances to Part 2 (CAS number): 3115-49-9 N-S, 90076-69-6 N-S, 149879-98-1 N-S, 164462-16-2 N-S; adds 23 substances to Part 3 of the DSL.
Notice with Respect to Substances in the National Pollutant Release Inventory for 2003 (Canadian Environmental Protection Act, 1999). The January 17, 2004 edition of the Canada Gazette Part I amends the 2003 Notice: the definitions of release and disposal have been changed so that substances sent to landfill, land application or underground injection are treated consistently whether they occur on site or off site; this change reclassifies the activities that have been reported to the National Pollutant Release Inventory. The new format for reporting information is as follows: a) Releases include releases to air and water and those releases that disperse material on land, such as spills and leaks; and b) Substances sent to landfill or land farm or underground injection on site are grouped together with transfers off site, with or without treatment, destined for a similar fate as disposals. The reporting requirement for characterizing the reactivity of the volatile organic compounds (VOCs) that are not reported individually as either high, medium, low, or unknown is repealed. The amendment removes the previous specifications that total phosphorus (TP) is to be reported as phosphate. The calculation of the mass reporting threshold and reporting for TP would be consistently expressed as phosphorus.

Drinking Water Protection Act: As a consequential amendment of 2003, c. 52 (Bill 76) now proclaimed in force, the definition of "local authority" in section 1 is amended and subsections 27(4) and 38(4) are amended.

Gas Safety Act: As a consequential amendment of 2003, c. 52 (Bill 76) now proclaimed in force, the definition of "municipality" in section 1 is repealed.

Administrative Remedies Regulation (Forest Practices Code of British Columbia Act): B.C. Reg. 466/2003 (Sch. A) changes the penalties outlined in the Schedule for the following: Forest Practices Code of British Columbia Act, Forest Fire Prevention and Suppression Regulation, Forest Road Regulation, Timber Harvesting and Silviculture Practices Regulation, Woodlot Licence Forest Management Regulation.
Bark Beetle Regulation (Forest Practices Code of British Columbia Act): B.C. Reg. 466/2003 (Sch. B) replaces the definition "commencement date" in section 1, adds subsection 7(5.1) and sections 7.1 (site plan for previously exempted areas) and 7.2 (consolidation of areas harvested in exempted area).
Contaminated Sites Regulation (Waste Management Act): B.C. Reg. 419/2003 repeals and adds definitions in section 1; repeals subsection 8(3); replaces sections 9 (fees) and 10 (review of report or plan by external contract reviewer), and subsection 52(1). In addition, Tables 1 and 2 of Schedule 3 are replaced (fees for: site profiles, information, allocation panels, determination of contaminated site, reviews of reports, etc.).
Emission Inspection Exemption Regulation (Motor Vehicle Act): B.C. Reg. 454/2003 amends section 2(d).
Forest Road Regulation: (Forest Practices Code of British Columbia Act): B.C. Reg. 466/2003 (Sch. C), among other changes, replaces the definition of "major culvert" in section 1; replaces sections 2.1 (exemption from needing road use permits) and 20 (notice required for construction and modification); adding subsection 8(4) (information for reports) and 15(1.2) to (1.3) (exemption from requirements).
Motor Vehicle Act Regulations: B.C. Reg. 472/2003 replaces section 24.01 (Prohibition - snow vehicle or snowmobile).
Operational and Site Planning Regulation (Forest Practices Code of British Columbia Act): B.C. Reg. 466/2003 (Sch. D) replaces clause 18(1)(n)(i) and repeals 18(1)(k) and 18.1(1)(b)(vi).
Timber Harvesting and Silviculture Practices Regulation (Forest Practices Code of British Columbia Act): B.C. Reg. 466/2003 (Sch. E) replaces paragraphs 46(a) and (b) (cutblocks) and section 58 (notice required for timber harvesting).
Water Regulation (Water Act): B.C. Reg. 456/2003 amends subsection 2(1) (application for licence) and repeals subsection 2(2); repeals sections 6, 7(7) & (9), and 34.
Woodlot Licence Forest Management Regulation (Forest Practices Code of British Columbia Act): B.C. Reg. 466/2003 (Sch. F) replaces the definition of "major culvert" in section 1, and amends subsections 12(1), 47.1(3)(a), and 48(1)(i).

Safety Act: 2003, c. 25 now proclaimed in force, among other changes: clarifies the Act's application by amending the definitions "employer" and "worker" (section 2); provides that the principal contractor or owner of an establishment shall coordinate the activities of all employers at the establishment (s. 4); imposes duties on suppliers of things used by workers or at establishments (new s. 6.1); provides for the establishment of safety programs (this amendment not yet in force, replacing s. 7); amends the provision relating to disclosure of information (s. 6); enables safety officers to issue directions to address potential dangers (s. 12 & new s. 12.1); enables the Chief Safety Officer to issue codes of practice with respect to the requirements of the Act and the regulations (s. 18); provides for the establishment of a Safety Advisory Committee to make recommendations respecting amendments to the Act and regulations (s. 26).

Blue Box Waste (Waste Diversion Act): O. Reg. 451/03 adds section 2 (Stewardship Ontario is continued and designated as the industry funding organization).
Motor Vehicles (Environmental Protection Act): O. Reg. 445/03 Repeals subsections in sections 9, 9.1, 10, and 12; amends subsections 11(2) and 12(2).
General Regulation (Nutrient Management Act): O. Reg. 447/03 makes extensive amendments to the regulation. Regulation respecting occupational health and safety in mines (Act respecting occupational health and safety): O.C. 42-2004 amends the regulation in several areas, including: adding definitions in section 1; replacing sections 89 (when reused air to ventilate is permitted), 160 (equipping and designing of fuel supply system), 185 &188 (standards for protection of motorized vehicles), 288.1 (formula for minimum safety factor of a new hoisting rope), 432 (explosives), 465 (before underground firing); adding sections 124.1 (evacuation drill), 174.02 (maintenance of diesel or electric motor), 267.1 (establishment of voice communication system), 418.2 & 418.3 (storage of explosives). In Schedule II, signalling for shaft sinking/bucket is added; Schedule III is amended.
