Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2004. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between August and September 2004. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2004. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2004-3 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2004-3 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Edmonton Restricted Development Area Regulations (Government Organization Act): Alta. Reg. 133/2004 changes the following sections in the Schedule: item 1 (s. 27); item 3 (ss. 8 &9); item 5 (ss. 31 & 32); item 6 (ss. 3, 4 & 9); item 10 (ss. 27 & 34).

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 119/2004 replaces sections 16.040 (oil sands projects classifications), 16.080 (administration fees for oil sands projects), 16.081 (annual adjustment factor), 16.100 (fiscal year of the Board).

Ozone-depleting Substances and Halocarbons Regulations (Environmental Protection and Enhancement Act): Alta. Reg. 132/2004 adds definitions to section 1; replaces section 2 (general prohibition); replaces subsections 4(3) & (4); adds section 9.1 (refrigerant and halon take back); replaces section 10 (offences).

Passenger Ropeways Standards Regulation (Safety Codes Act): Alta. Reg. 125/2004 adds Canadian Standards Association (CSA) standard Z98S1-02 as a requirement, and adds an expiry date to the regulation (new section 3.1).

Waiver Regulation (Public Health Act): Alta. Reg. 108/2004 updates a reference to another regulation in clause 1(1)(a).

Section 2.A Acts

Commercial River Rafting Safety Act: B.C. Reg. 215/2004 repeals the following sections: 2 - 8, 9(1)(b) & (c) and 9(2), 11(3) - (5), 11(8) & (9), and 13(2)(a) & (b) and 13(3). Retroactive to April 1, 2003.

Motor Vehicle Act: Several sections are amended consequentially as the result of the proclamation of the Youth Justice Act (2003, c. 85); the amendments concern driving prohibitions, fees, licence suspensions and surrender.

Protected Areas of British Columbia Act: 2004, c. 52 (Bill 50) replaces Schedules A, B, C, and D.

Wildlife Act: As a consequential amendment of 2003, c. 85, now proclaimed in force, section 24 is amended (convictions, sentencing).

Workers Compensation Act: The remainder of 2004, c. 23 (Bill 18) is now proclaimed in force, which amends section 231, adds subsection 241(6) and section 244.1 (appeal rights to workers for decisions pre-dating 2004 amendments), and amends clauses 249(5)(b) and 257(2)(a).

Section 2.B Regulations

Motor Vehicle Act Regulations: B.C. Reg. 227/2004 repeals Divisions 12 (Interim Vehicle Licence) and 13 (Interim Licence). B.C. Reg. 228/2004 repeals various subsections and clauses in sections 27.06, 27.07, 27.09 and 27.10.

Petroleum and Natural Gas General Regulation (Petroleum and Natural Gas Act): B.C. Reg. 196/2004 replaces section 2(e).

Waste Management Permit Fees Regulation (Waste Management Act): Among other changes, B.C. Reg. 149/2004 replaces section 2 (permit application fees), repeals section 6, and replaces the Schedules (contaminant fees for: air emission permits or approvals, effluent permits or approvals &refuse permits or approvals).

Wood Residue Burner and Incinerator Regulation (Waste Management Act): B.C. Reg. 150/2004 amends subsection 2(8) (fees).
