Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to December 2004. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between September and December 2004. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2004. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2004-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2004-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): It is proposed to repeal this regulation and replace it with New Substances Notification Regulations (Chemicals and Polymers) and New Substances Notification Regulations (Organisms). Section 2.A Acts

Marine Transportation Security Act: As a consequential amendment of 2004, c. 15, section 11.1 is added (permits the minister to enter into agreements or make grants respecting the security of marine transportation). Effective December 1, 2004.

Yukon Environmental and Socio-economic Assessment Act: Section 6, Part 2 (sections 40 - 123), sections 124 - 126 and 131 in force 18 months after Royal Assent (May 13, 2003). See section 134.

Drinking Water Protection Regulation (Drinking Water Protection Act): B.C. Reg. 300/2004 replaces section 14 (well floodproofing), effective November 1, 2005. See British Columbia Gazette, July 13, 2004, p. 843.

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 312/2004 adds Part 28 - Agriculture, effective January 1, 2005. See British Columbia Gazette, July 13, 2004, p. 850. B.C. Reg. 381/2004 amends the regulation and B.C. Reg. 382/2004 replaces Part 7 - Noise, Vibration, Radiation and Temperature, both effective January 1, 2005. Division 2 AMENDMENTS

Section 2.A Acts

Environmental Management Act: 2004, c. 67 (Bill 74) amends clause 109(3)(b) to remove a reference to another Act.

Forest Act: 2004, c. 63 (Bill 65) among other changes: adds section 14.1 (mountain pine beetle salvage area; adds Division 8.3 to Part 3 (Disposition of Timber Acquired under Forestry Revitalization Act - section 47.8 (disposition of timber in a tree farm licence)); replaces definitions in section 80.2, including "group licence interim period" and "timber licence interim period"; adds section 105.3 (small scale salvage costs portion to be paid into special account).

Forest and Range Practices Act: 2004, c. 63 (Bill 65) replaces subsection 54(2) (unauthorized construction and occupation) and clause 87(3)(b).

Forestry Revitalization Act: 2004, c. 63 (Bill 65) adds section 1.1 (allowable annual cut for tree farm licence) and amends section 3 (minister's orders).

Motor Vehicle Act: 2004, c. 57 (Bill 62) amends section 18 (transfer on death if estate small). 2004, c. 67 (Bill 74) extends the date subsections 60(9) & (10) are to be repealed.

Petroleum and Natural Gas Act: As a consequential amendment of 2004, c. 45 (Bill 56) now proclaimed in force, various sections are amended, including: adding subsections 15(2.1) & (2.2) (tape recording a proceeding); sections 14, 23, 24, and 27 are repealed; section 25 is amended (order of board).

Protected Areas Forests Compensation Act: 2004, c. 63 (Bill 65) adds subsections 3(2) & (3) (deletion under section 60 of the Forest Act).

Utilities Commission Act: As a consequential amendment of 2004, c. 45 (Bill 56) now proclaimed in force, various sections are amended, including: replacing section 74 (inspections and depositions); adding section 88.1 (withdrawal of application); repealing sections 6, 86.1, 93, and 94. Other parts of 2004, c. 45 affecting this Act are not yet in force.

Section 2.B Regulations

Commercial Transport Regulations (Commercial Transport Act): B.C. Reg. 447/2004 repeals Division 4 (Temporary Operation Permits).

Contaminated Sites Regulation (Environmental Management Act): B.C. Reg. 322/2004 makes extensive changes to the regulation, including: amending definitions in section 1; changing section references from the old Act to the new Environmental Management Act throughout; substituting "director" for "manager" throughout; replacing sections 11 (definition of contaminated site), 15 (procedures for determination of contaminated site), 16 (remediation options), 49.1 (recommendations of approved professionals), 51 & 52 (approvals in principle; certificate of compliance); Schedule 3 is replaced (Fees). B.C. Reg. 324/2004 replaces the following Schedules: 4 (Generic Numerical Soil Standards), 6 (Generic Numerical Water Standards), 7 (Standards Triggering Contaminated Soil Relocation Agreements); amends Schedule 5 (standards for mercury (inorganic)); adds Schedules 9 (Generic Numerical Sediment Criteria) and 10 (Generic Numerical Soil and Water Standards). B.C. Reg. 346/2004 and 405/2004 make small corrections to Schedules 3 and 6 respectively.

Motor Vehicle Act Regulations: B.C. Reg. 447/2004 replaces sections 14.01 (temporary operation permit), 14.02 (fees, without load), 14.03 (fees, with load), 14.04 (temporary operation permit for inspection); repeals sections 14.011 and 14.012.

Passenger Transportation Regulation (Passenger Transportation Act): B.C. Reg. 414/2004 replaces the definition of "connector bus" in subsection 1(1).

Designated Substance - Benzene (Occupational Health and Safety Act): O. Reg. 105/04 changes the exposure limits to airborne benzene in subsections 4(1) & (2), effective December 31, 2005. See the Ontario Gazette, issue 19, 2004, p. 831.

Division 2 AMENDMENTS

Section 2.A Acts

Ambulance Act: As a consequential amendment of 2004, c. 3 (Bill 31) now proclaimed in force, section 19 is added to allow specified persons to disclose to each other personal health information about an individual without the individual's consent if the disclosure is reasonably necessary for purposes relating to the discharge or exercise of their duties or powers.

Health Protection and Promotion Act: As a consequential amendment of 2004, c. 3 (Bill 31) now proclaimed in force, section 11 is amended (disclosure of personal health information by medical officer of health).

Occupational Health and Safety Act: As a consequential amendment of 2004, c. 3 (Bill 31) now proclaimed in force, subsection 63(6) is added (section prevails in reference to another Act).

Public Hospitals Act: As a consequential amendment of 2004, c. 3 (Bill 31) now proclaimed in force, adds the definition "personal health information" in section 1, and amends sections 14 and 32 to change terminology related to medical records.

Section 2.B Regulations

Hospital Management (Public Hospitals Act): O. Reg. 332/04 amends the regulation in several areas relating to "records of personal health information" (medical records). See sections 20, 22, 23.

Smoke-free Places Act: Subsection 2(3) of the original Act is now proclaimed in force, which repeals section 2 (non-application of Act to "correctional centre").

Section 2.B Regulations

Ozone Depleting Substances and Replacement Regulations (Environmental Protection Act): EC2004-575 makes several changes to the regulation, including: changing the title to "Ozone Layer Protection Regulations"; adding definitions to clarify the meaning of terms; restricting the sale and servicing of chillers (every chiller must have a purge unit designed to expel no more than 0.1 grams of a Category I substance for every gram of air purged); requiring the owner of certain equipment to notify the Department of an accidental release of a regulated substance; clarifying the process for registering a registered handler and increasing the fee payable for registration; making wording corrections to a provision regulating work on air conditioning equipment, refrigeration equipment or fire extinguishing equipment; dealing with the recovery and recycling of regulated substances; restricting the disposal of air conditioning, refrigeration equipment or fire extinguishing equipment; setting time limits on the use of Category I substances; making improvements to a provision dealing with leak testing; dealing with licensing and reporting requirements for wholesalers; requiring the use of approved cylinders; prohibiting the use of portable fire extinguishers containing a Category I substance; replacing Schedule A of the regulations to correct minor errors and to add Category III substances to the Schedule.

Waste Resource Management Regulations (Environmental Protection Act): EC2004-576 amends section 2.1 to add a requirement to complete and submit copies of a prescribed manifest form for shipments of hazardous waste; it also exempt a carrier of hazardous waste from the obligation to complete and submit such manifest forms in respect of shipments of hazardous waste to destinations outside of the province.
