Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to February 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between January 2005 and February 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2004. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 AMENDMENTS

Section 2.A Acts

Food and Drugs Act: As a consequential amendment of 2004, c. 15 now proclaimed in force, section 30.1 is added (authorizes the Minister of Health to make an interim order to deal with a risk to health, safety or the environment).

Pest Control Products Act: As a consequential amendment of 2004, c. 15 now proclaimed in force, section 6.1 is added (authorizes the Minister of Health to make an interim order to deal with a risk to health, safety or the environment).

Hazardous Products Act: As a consequential amendment of 2004, c. 15 now proclaimed in force, sections 5.1, 16.1, and 27.1 are added (authorizes the Minister of Health to make an interim order to deal with a risk to health or safety). 2004, c. 9 now proclaimed in force, amends sections 3 and 5 and Part I of Schedule I by adding to the list of prohibited products cigarettes that do not meet the flammability standard to be set out in the regulations.

Radiation Emitting Devices Act: As a consequential amendment of 2004, c. 15 now proclaimed in force, section 13.1 is added (authorizes the Minister of Health to make an interim order to deal with a risk to health or safety).

Section 2.B Regulations

Benzene in Gasoline Regulations (Canadian Environmental Protection Act, 1999): SOR/2004-252 replaces subsection 6(3). Other amendments affect the French language version.

Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2004-209 deletes one substance from Part 1 and adds 2 substances to Part 1 of the DSL. SOR/2004-210 deletes 2 substances from Part 1 and adds 18 substances to Part 1 of the DSL; replaces substance 90076-65-6 N-S in Part 2; adds 27 substances to Part 3. SOR/2004-216 adds 71 substances to Part 1. SOR/2004-233 adds 2 substances to Part 1. SOR/2004-234 adds 20 substances to Part 1 and 7 substances to Part 3 of the DSL.

Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations(Motor Vehicle Safety Act): SOR/2004-250 changes the section references in Schedule 10.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2004-250 repeals 2 definitions in subsection 2(1) and amends "power-assisted bicycle"; replaces paragraph 6(1)(c) (national safety mark); amends section 115 of Schedule IV (vehicle identification number); replaces subsection 205(5) of Schedule IV (glazing material); replaces subsection 305(1) of Schedule IV (electrical standard).

Port Authorities Operations Regulations (Canada Marine Act): SOR/2004-255 makes non-substantive changes to the following sections: 7(c), 8, 9(1), 11(3), 12, 13(1) & (2), 15(a), 19(1), 28(1)(a), 31(4), item 16, (Part 4, Schedule 1) & item 28 (Part 15, Schedule1).

Motor Vehicle Propane Conversions Regulation (Safety Codes Act): Alta. Reg. 221/2004 changes the reference to an Act in section 1(f).

Reg. 381/2004 amendments include: replacing sections 6.126 (shut-down device), 17.17 (vessel safety standards), 17.18 (vessel operator requirements), 17.22 (vessel communication), 17.23 (vessel safety preparation), 17.24 (vessel maintenance and inspection), 17.26 (vessel lighting); Table 15-1: Design Factors for Rigging is amended. B.C. Reg. 382/2004 replaces Part 7 - Noise, Vibration, Radiation and Temperature exposure, comprising sections 7.1 to 7.38. B.C. Reg. 420/2004, among other changes, amends and replaces sections dealing with fall protection systems (see new sections 11.4 to 11.10); adds new section 4.58.1 (temporary removal of guardrails). B.C. Reg. 421/2004 replaces sections 4.84 to 4.106 with sections 4.84 to 4.87 (eating areas; washroom facilities; change areas; unsafe water). B.C. Designated Substance - Benzene (Occupational Health and Safety Act): O. Reg. 105/04 changes the exposure limits to airborne benzene in subsections 4(1) & (2), effective December 31, 2005. See the Ontario Gazette, issue 19, 2004, p. 831.

Division 2 AMENDMENTS

Section 2.A Acts

Highway Traffic Act: The part of 2002, c. 18, Sch. P which amends section 111 is proclaimed in force January 1, 2005. This replaces subsections (2) & (3) (securing of loads; regulations respecting securing of loads, inspections).

Planning Act: 2004, c. 18 (Bill 26) changes the criteria that must be met when any decision, comment, submission or advice is made by a municipality, local board, planning board, the provincial government or a board, commission or agency of the provincial government that affects a land use planning matter. The amendments also increase the time period for making decisions before appeals may be made to the Ontario Municipal Board. The right to appeal to the Ontario Municipal Board in respect of amendments to official plans and zoning by-laws is eliminated under certain circumstances. The powers of the Ontario Municipal Board to make an order or decision in an appeal respecting an official plan, amendments to an official plan, a zoning by-law or a holding by-law are restricted if the Minister believes they adversely affect a matter of provincial interest. A new section 70.4 gives the Minister power to make regulations respecting transitional matters. See sections 1(1), 17, 22, 23, 34, 36, 51, 53.

Codes and Standards Order (Fire Prevention Act): EC2004-622 amendments adopt the 2003 edition of the National Fire Protection Association's NFPA 1 Uniform Fire Code and NFPA 101 Life Safety Code. See clause 1(a) & (a.1) and replacement section 2.

Electrical Inspection Act Regulations: EC2004-636 repeals subsections 5(7) &(8) (revoking the bond requirements for a contractor's license; replaces Schedules 1 - 4 (changes the various fees for inspections, licenses and permits). In force January 1, 2005.

Elevators and Lifts Act Regulations: EC2004-637 replaces section 286 (fees for the inspection of elevators and lifts).

Occupational Health and Safety Act Regulations: EC2004-632 changes the title of the regulations to "Occupational Health and Safety Act General Regulations". The amendments extend the application of the regulations to workplaces with fewer than three persons (section 51.3 repealed); they also clarify that the Act and the regulations do not apply to a workplace that is an agricultural operation conducted on farmland (see new sections 1.7 & 1.8); sections 16.1 -16.9, 17.1 - 17.5, 39.1 - 39.5, 45.21, 45.22 - 45.23 are repealed.

Petroleum Storage Tanks Regulations (Environmental Protection Act): EC2004-674 amendments prohibit the delivering of petroleum to outside small capacity storage tanks that are not equipped with a product line protector or that have a combustible tank stand. In addition, these amendments prohibit the sale of a small capacity storage tank to a person who does not hold an HHI license. These amendments also prescribe two forms (Form 6A & 6B) that are required under the regulations. See new sections 3.1 and 12.1.

Section 2.A Acts

Forest Act: As a consequential amendment of 2004, c. 20 (Bill 54) section 32.1 is added which allows municipalities to maintain forest roads constructed in the domain of the State, after being authorized by the Minister responsible.

Highway Safety Code: 2003, c. 5 which adds section 194.3 (amended by 2004, c. 2) is now proclaimed in force (prohibition from putting vehicle into operation, reimbursement).

Mining Act: As a consequential amendment of 2004, c. 20 (Bill 54) section 247.1 is added which allows municipalities to maintain mining roads constructed in the domain of the State, after being authorized by the Minister responsible.

Regulation respecting hazardous materials (Environment Quality Act): O.C. 1091-2004 amendments concern halocarbons. See sections 4 and 9 and new section 7.1.

Regulation respecting the application of the Environment Quality Act(Environment Quality Act): O.C. 1091-2004 replaces paragraph 1(5) (section 22 exemptions re halocarbons).

Solid Waste Regulation (Environment Quality Act): O.C. 1048-2004 amends section 93 (in-trench disposal sites may only be established in these territories); replaces section 94 (maximum population for in-trench disposal site); adds section 115.1 (requirement to accept solid waste).
