Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to March 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between January 2005 and February 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): It is proposed to repeal this regulation and replace it with New Substances Notification Regulations (Chemicals and Polymers) and New Substances Notification Regulations (Organisms). Also, there are proposed amendments to the New Substances Fees Regulations. All can be found in the Canada Gazette, Part I, October 30, 2004, beginning on page 3030.

Notice of Railway Works Regulations (Railway Safety Act): Proposed amendments may be found in the Canada Gazette Part I, November 20, 2004, p. 3394.

Division 2 AMENDMENTS

Section 2.A Acts

Canadian Environmental Protection Act, 1999: SOR/2005-40 adds item 69 (DDT) to the List of Toxic Substances (Schedule 1 of the Act). SOR/2005-46 adds 2-butoxyethanol and 2-methoxyethanol to the List of Toxic Substances.

Section 2.B Regulations

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2005-42 amends Schedule IV to reinstate sections: 108 "Lighting System and Retroreflective Devices (Standard 108)", 122 "Motorcycle Brake Systems (Standard 122)", 131 "School Bus Pedestrian Safety Devices (Standard 131)", 206 "Door Locks and Door Retention Components (Standard 206)", 305 "Electrolyte Spillage and Electrical Shock Protection (Standard 305)" and 500 "Low-speed Vehicles (Standard 500)"; it also makes changes to sections: 105 "Hydraulic and Electric Brake Systems (Standard 105)", 121 "Air Brake Systems (Standard 121)" and 135 "Light Vehicle Brake Systems (Standard 135)". This amendment is being made to extend the expiration date of all the above sections, which incorporate Technical Standard Documents (TSDs). SOR/2005-45 amends Canada Motor Vehicle Safety Standard (CMVSS) 114. All vehicles with a gross vehicle weight rating (GVWR) of less than 4,536 kg, except emergency vehicles, are required to be equipped with an anti-theft immobilization system that, at the option of the manufacturer, meets one of the following standards: 1) National Standard of Canada CAN/ULC-S338-98, or 2) Part III of United Nations Economic Commission for Europe (UNECE) Regulation No. 97.

Notice with Respect to Substances in the National Pollutant Release Inventory for 2004 (Canadian Environmental Protection Act, 1999): Amendments to the footnotes in Schedule 1 are found in the Canada Gazette, Part I, February 19, 2005.

Radiation Emitting Devices Regulations (Radiation Emitting Devices Act): SOR/2005-33 replaces Part XI of Schedule II (Tanning Equipment).

Commercial Vehicle General Equipment and Safety Regulation (Traffic Safety Act): Alta. Reg. 1/2005 repeals sections 8 to 14.

Environmental Protection and Enhancement (Miscellaneous) Regulation(Environmental Protection and Enhancement Act): Alta. Reg. 13/2005 amends section 8 (duration of certificate of qualification).

Forest and Prairie Protection Regulations, Part II (Forest and Prairie Protection Act): Alta. Reg. 11/2005 extends the expiry date of the regulations to 2015.

Forest Resources Improvement Regulation (Environmental Protection and Enhancement Act): Alta. Reg 8/2005 makes a minor correction to subsection 3(1).

Log Haul Regulation (Traffic Safety Act): Among other changes, Alta. Reg. 1/2005 repeals section 5 and various other subsections (securing of cargo); changes log measurements in section 1.

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta. Reg. 17/2005 replaces subsection 16.530(1) (calculation of orphan fund levy).

Rules of Practice of the Natural Resources Conservation Board (Natural Resources Conservation Board Act): Alta. Reg. 8/2005 makes minor corrections to the Schedules.

Heritage Conservation Act: As a consequential amendment of 2004, c. 66 (Bill 68) now proclaimed in force, subsection 32(8) is amended (reference to Land Title and Survey Authority of British Columbia).

Land Act: As a consequential amendment of 2004, c. 66 (Bill 68) now proclaimed in force, sections 54, 55, 76-78, 81, 97, 105, and 109 are amended and section 109.1 is added (fees for services provided by Surveyor General).

Railway Act: As a consequential amendment of 2004, c. 66 (Bill 68) now proclaimed in force, minor changes are made to section 20.

Water Act: As a consequential amendment of 2004, c. 66 (Bill 68) now proclaimed in force, a minor change is made in clause 28(2)(c).

Section 2.B Regulations

Gas Safety Regulation (Safety Standards Act): The remainder of B.C. Reg. 475/2004 comes into force March 1, 2005 by changing the number of "business days" in sections 38 and 39.

Geophysical Exploration Regulation (Petroleum and Natural Gas Act): B.C. Reg. 602/2004 references the new Transportation Act in sections 1 and 6.

Pipeline Regulation (Pipeline Act): B.C. Reg. 601/2004 references the new Transportation Act in section 1.

Highway Traffic Act: The remainder of 2004, c. 11 (Bill 15) is now proclaimed in force. The amendments clarify the investigative tools available to peace officers to investigate offences, notably the authority to ask a driver about the driver's consumption of alcohol or drugs and to require the driver to undergo a field sobriety test, without having to give the driver an opportunity to consult with counsel. The amendments provide for a 24 hour licence suspension for a failed field sobriety test or a refusal to take one. See especially sections 76.1, 76.2 (new), 242.1, 263.1, 264 and 265.

Regional Waste Management Authorities Act: 2004, c. 21 (Bill 26) now proclaimed in force, amends subsection 17(2) (name of an Act).

Designated Substance - Benzene (Occupational Health and Safety Act): O. Reg. 105/04 changes the exposure limits to airborne benzene in subsections 4(1) & (2), effective December 31, 2005. See the Ontario Gazette, issue 19, 2004, p. 831.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): Additional amendments to Part 4 of the Schedule are effective December 31, 2005 and March 1, 2006. See the Ontario Gazette, issue 8, 2005, subsections 1(2) & (3), p. 78.

Division 2 AMENDMENTS

Section 2.A Acts

Fuel Tax Act: Among other changes, 2004, c. 31 (Bill 149) enacts section 5.1 which permits a person authorized by the Minister of Finance to stop and detain a commercial motor vehicle in order to take samples to determine if the vehicle is using coloured fuel or unauthorized fuel. The authorized person may also stop a motor vehicle in order to determine whether the vehicle operator is an interjurisdictional carrier and has complied with section 4.13 of the Act. New section 22.1 authorizes the public disclosure by the Minister of the names and addresses of persons registered or designated under the Act, for the purposes of administering the Act.

Highway Traffic Act: Among other changes, 2004, c. 31 (Bill 149) amends subsection 7.2(1) (retention of records) and 7.7 (makes technical changes relating to the calculation of interest on unpaid amounts owed under the International Registration Plan).

Niagara Escarpment Planning and Development Act: As a consequential amendment of 2005, c. 1 (Bill 135) now proclaimed in force, sections 6.1 and 17 are amended and 19 added (all concerning amendments to Niagara Escarpment Plan); sections 23.1 (regulations), 29 (transition), 30 (limitations on remedies) are added.

Oak Ridges Moraine Conservation Act: As a consequential amendment of 2005, c. 1 (Bill 135) now proclaimed in force, subsection 3(3) is replaced (review of Plan) and clause 23(1)(f) is replaced (requirement to pass by-laws).

Planning Act: The remainder of 2004, c. 18 (Bill 26) is now proclaimed in force, which replaces subsections 3(5) & (6) (policy statements).

Section 2.B Regulations

Food Premises (Health Protection and Promotion Act): The remainder of O. Reg. 74/04 comes into force March 1, 2005. Section 60 is amended (service dogs).

Vehicles for the Transportation of Physically Disabled Passengers (Highway Traffic Act): O. Reg. 49/05 amendments concern rear-entry accessible taxicabs and prescribe Canadian Standards Association (CSA) standard D409-02 (motor vehicles for the transportation of persons with physical disabilities) for new vehicles. See section 1 definitions, sections 8 and 14.
