Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to September 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between August 2005 and September 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of September 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Final version amendments (Rear Impact Guards) SOR/2004/195 are found in the Canada Gazette, Part II, Oct. 6, 2004, p. 1326. Proposed amendments to Standards 210.1 and 210.2 (User-ready Tether Anchorages for Restraint Systems and Lower Universal Anchorage System for Restraint Systems and Booster Cushions) are found in the Canada Gazette, Part I, November 20, 2004, p. 3385. Motor Vehicle Tire Safety Regulations (Motor Vehicle Safety Act): Proposed amendments are found in the Canada Gazette, Part I, March 26, 2005, p. 1023.

New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): It is proposed to repeal this regulation and replace it with New Substances Notification Regulations (Chemicals and Polymers) and New Substances Notification Regulations (Organisms). Also, there are proposed amendments to the New Substances Fees Regulations. All can be found in the Canada Gazette, Part I, October 30, 2004, beginning on page 3030.

Division 2 AMENDMENTS

Section 2.A Acts

Canadian Environmental Protection Act, 1999: 2005, c. 23 (Bill C-15) now proclaimed in force, amends the Act to: protect the marine environment from the wrongful activities of ships as well as persons; include prohibitions concerning the disposal and incineration of substances at sea by ships; include regulation-making authority to deal with disposals of substances during the normal operations of ships, aircraft, platforms and other structures; expand the enforcement powers to include orders to direct ships found to be in contravention of that Act or its regulations; subject owners of ships and directors and officers of corporations that own ships to a duty of care to ensure that ships comply with the provisions of that Act and its regulations concerning disposal at sea and with orders and directions made under that Act; and expand the jurisdiction of Canadian courts to include the exclusive economic zone of Canada.

Migratory Birds Convention Act, 1994: 2005, c. 23 (Bill C-15) now proclaimed in force, amends the Act to: state that the Act applies in the exclusive economic zone of Canada; protect migratory birds from the effects caused by deposits of harmful substances, such as oil, in the exclusive economic zone of Canada; state that the Act applies to vessels and their owners and operators; subject masters, chief engineers, owners and operators of vessels and directors and officers of corporations to a duty of care to ensure compliance with that Act and its regulations; expand the enforcement powers to include orders to direct and detain vessels found to be in contravention of that Act or its regulations; expand the jurisdiction of Canadian courts to include the exclusive economic zone of Canada; increase penalties; and permit courts to impose additional punishments in the form of orders covering matters such as environmental audits, community service and the creation of scholarships for students enrolled in environmental studies.

Species at Risk Act: SOR/2005-224 adds 39 new species to the Schedules.

Section 2.B Regulations

Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2005-161 deletes one substance and adds 36 substances to Part 1 of the DSL; adds one substance to Part 2; deletes one substance and adds 29 substances to Part 3; adds one substance to Part 4. SOR/2005-199 adds 13 substances to Part 1; 3 substances to Part 2; 10 substances to Part 3 of the DSL.

Inclusion List Regulations (Canadian Environmental Assessment Act): SOR/2005-198 replaces item 54 of the Schedule (updates reference to Migratory Birds Convention Act, 1994).

Law List Regulations (Canadian Environmental Assessment Act): SOR/2005-198 adds item 7.1 (Migratory Birds Convention Act, 1994) to Part I of the Schedule and repeals 23(c) in Part II.

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): SOR/2005-186 amends Schedule I to establish hunting season dates for 2005-2006, and the number of migratory game birds that may be taken or possessed during those dates. SOR/2005-198 amendments are intended to make the regulation consistent with the recent 2005, c. 23 amendments to the Act and the Canadian Environmental Protection Act, 1994. See sections 3, 12(1), 13(3), 22 and 23; section 35 is repealed.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): SOR/2005-216 amends references to the International Maritime Dangerous Goods Code (IMDG Code), the Supplement to the Technical Instructions for the Safe Transport of Dangerous Goods by Air, and the Canadian Standards Association (CSA) that have been revised, for example, to address valve protection on cylinders, spheres and tubes used to transport gases (CSA standards B339 and B340).

Gas Plant Facility Regulations (Energy Resources Conservation Act): N.S. Reg. 137/2005 establishes standards for the design, construction and operation of liquified natural gas terminals. The regulations require measures to protect public safety and establish a code of practice for LNG plants, based on Canadian Standards Association (CSA) standard Z276-01.
