Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to November 2005. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between September 2005 and October 2005. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2005. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2005-4 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2005-4 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 AMENDMENTS

Section 2.A Acts

Canada Labour Code: As a consequential amendment of 2005, c. 34 (Bill C-23), now proclaimed in force, subsection 144(5.1) of the Canada Labour Code, Part II is added (disclosure of information); the Act also amends Parts I and III in regard to department and ministerial name changes.

Canada National Marine Conservation Areas Act: As a consequential amendment of 2005, c. 29 (Bill C-3) now proclaimed in force, sections 9 and 16 are amended to transfer the powers, duties and functions from the Minister of Fisheries and Oceans to the Minister of Transport

Canada National Parks Act: Paragraph 17(1)(c) and the description of Gros Morne National Park in Part 10 of Schedule 1 of the original Act is now proclaimed in force.

Canada Shipping Act: As a consequential amendment of 2005, c. 29 (Bill C-3) now proclaimed in force, various sections are amended to transfer the powers, duties and functions from the Minister of Fisheries and Oceans to the Minister of Transport

Canadian Environmental Protection Act, 1999: SOR/2005-262 adds two substances to the List of Toxic Substances in Schedule 1: tetrachlorobenzenes (TeCBs) and pentachlorobenzene (QCB).

Hazardous Materials Information Review Act: As a consequential amendment of 2005, c. 34 (Bill C-23), now proclaimed in force, the name of a Department is changed in paragraph 46(2)(c).

Section 2.B Regulations

Dangerous Chemicals and Noxious Liquid Substances Regulations (Canada Shipping Act): SOR/2005-285 amendments deal with issues raised by the Standing Joint Committee for the Scrutiny of Regulations (SJC). Among the changes: the definitions "waters" is added and "internal waters" repealed in section 2; section 8 is replaced (equipment and construction standards); section 21 is amended (operational requirements of international codes); section 29 is replaced (discharge of noxious liquid substance); sections 31 and 50 are repealed.

Dangerous Goods Shipping Regulations (Canada Shipping Act): SOR/2005-285 replaces section 21 (prescribed pollutants).

Export of Substances Under the Rotterdam Convention Regulations(Canadian Environmental Protection Act, 1999). As a consequential amendment of SOR/2005-149 paragraph 2(2)(b) is replaced (new regulation cited), effective November 1, 2005.

Inclusion List Regulations (Canadian Environmental Assessment Act): SOR/2005-261 adds definitions to section 2 and replaces section 78 of the Schedule. These amendments result from an amendment to the Health of Animals Regulations and the proposed addition of European honeybees to the list of species exempted from requiring an EA prior to their importation.

Law List Regulations (Canadian Environmental Assessment Act): SOR/2005-261 replaces item 10 of Part II of Schedule I.

New Substances Fees Regulations (Canadian Environmental Protection Act, 1999): SOR/2005-286 amends section 2 and replaces sections 5, 11 and Schedules 1 and 2. The amendments are necessary to harmonize the regulation with the New Substances Notification Regulations (Chemicals and Polymers).

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): SOR/2005-279 updates references to revised safety standards regarding highway tanks, portable tanks, and containers, namely Canadian Standards Association (CSA) standards B620, B621, and B622.

Air Pollution - Local Air Quality (Environmental Protection Act): New regulation 419/05 regarding air pollution comes into force on November 30, 2005. It replaces Regulation 346. See the Ontario Gazette, issue 29, 2005, p. 2374.

Designated Substance - Benzene (Occupational Health and Safety Act): O. Reg. 105/04 changes the exposure limits to airborne benzene in subsections 4(1) & (2), effective December 31, 2005. See the Ontario Gazette, issue 19, 2004, p. 831.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): Additional amendments to Part 4 of the Schedule are effective December 31, 2005 and March 1, 2006. See the Ontario Gazette, issue 8, 2005, subsections 1(2) & (3), p. 78.

Farming Operations (Occupational Health and Safety Act): New regulation 414/05 regarding farming operations comes into force on June 30, 2006. See the Ontario Gazette, issue 29, 2005, p. 2365.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2006, 2007, and 2009: March 31, 2006 - storage, mixing, and on-site processing approval requirements; January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. See the Ontario Gazette, 27 August, 2005, pg. 2751.

Division 2 AMENDMENTS

Section 2.A Acts

Conservation Authorities Act: As a consequential amendment of 2004, c. 8, now proclaimed in force, a minor change is made in subsection 38(1) (name of an Act).

Fire Protection and Prevention Act, 1997: As a consequential amendment of 2004, c. 8, now proclaimed in force, a minor change is made in section 70 (name of an Act).

Workplace Safety and Insurance Act, 1997: As a consequential amendment of 2004, c. 8, now proclaimed in force, a minor change is made in subsection 168(3) (name of an Act).

Section 2.B Regulations

Classifications of Proposals for Instruments (Environmental Bill of Rights, 1993): O. Reg. 505/05 adds paragraph 15 to subsection 5(2) (proposal for a certificate of property use).

Designated Substance - Asbestos (Occupational Health and Safety Act): O. Reg. 279/05 replaces the definitions of "asbestos" and "joint health and safety committee" in section 1, effective November 1, 2005.

General Regulation (Nutrient Management Act): O. Reg. 511/05 makes extensive amendments to the regulation. The key changes include: increasing the number of farms practicing nutrient management; maintaining priority standards for the protection of streams and wells; refining requirements for the approval and registration of strategies and plans; simplifying regulations and streamlining the requirements for farmers by allowing more flexibility in the design of their nutrient management strategies and plans; applying the nutrient management regulation to smaller expanding farms; additional requirements for some farms under the regulation that are within 100m of a municipal well; and, requiring approved plans for farms applying non-agricultural source material (eg. biosolids), with an exemption existing for smaller farms that have a valid certificate of approval, unless they are within 100m of a municipal well. Further technical changes to the Regulation include: changes to some construction and siting requirements for small manure storages; record keeping requirement to retain a nutrient management strategy and nutrient management plan (if required) on the farm for compliance purposes; removal of requirements relating to load bearing surfaces in outdoor confinement areas; elimination of requirements for application of agricultural source materials on saturated soils; taking away requirements for sampling and analysis of soil and agricultural source material; removal of requirements for minimum distance separation from surface water based on slope, soil texture and application method, the P-Index and the N-Index; refined certification and licensing requirements for those who prepare plans and strategies.

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 280/05 replaces item 8 in the table to section 7 (pre-start health and safety reviews), effective November 1, 2005.

Agricultural Operations Regulation (Environment Quality Act): O.C. 883-2005 amends section 56 to postpone the date for the ceasing of effect of section 7.O.C. 906-2005 makes several amendments throughout to provide for new solid manure pile storage measures. See especially new sections 9.1 - 9.3, 17.1, 29.1; new Division I.1 (Limited Activity Territories and Solid Manure Storage) - sections 48.1 -48.4; new section 50.4. Schedules II and III are replaced and Schedules IV and V are added (lists of municipalities).

Building Code (Construction Code) (Building Act): O.C. 873-2005 makes amendments to section 3.03 (amendments to the National Plumbing Code).
