Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to January 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between December 2005 and January 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 AMENDMENTS

Section 2.A Acts

Canada-Newfoundland Atlantic Accord Implementation Act: As a consequential amendment of 2003, c. 22, now proclaimed in force, subsection 25(4) is amended.

Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act: As a consequential amendment of 2003, c. 22, now proclaimed in force,subsection 26(4) is amended.

Canada Shipping Act: As a consequential amendment of 2005, c. 38 (Bill C-26), now proclaimed in force, minor terminological changes are made to section 472 and clause 596(2)(b).

Employment Equity Act: As a consequential amendment of 2003, c. 22, now proclaimed in force, subsections 4(5) & (6), 6(b) & (c), 33(1)(b) & (c) are replaced in the English version and subsections 6b) and 33(1)b) in the French. French language version.

Feeds Act: As a consequential amendment of 2005, c. 38 (Bill C-26), now proclaimed in force, subsection 6(2) is replaced.

Section 2.B Regulations

Canada Occupational Health and Safety Regulations (Canada Labour Code, Part II): SOR/2005-401 adds Part XIX - Hazard Prevention Program, sections 19.1 to 19.8. The employer will now have to analyze the work environment to identify unsafe conditions and implement preventative measures. French language version.

Precursor Control Regulations (Controlled Drugs and Substances Act): SOR/2005-365 amends various sections to strengthen the regulatory framework and minimize any negative impact of the regulations on the legitimate trade of precursors. Clarification and technical amendments are also made. Part 4 is added "Pharmacists, Practitioners and Hospitals", sections 91.1 to 91.96. Six substances are added to the Schedule: gamma butyrolactone (GBL), 1,4 butanediol (BDO), red phosphorus, white phosphorous, hypophosphorous acid, and hydriodic acid.

Buildings and Mobile Homes Act: 2005, c. 48 (Bill 7) amends section 15 (regulations).

Section 2.B Regulations

Manitoba Building Code (Buildings and Mobile Homes Act): Man. Reg. 177/2005 amends Sentence 2.3.1.3. (1) and adds 2.3.1.3. (2) & (3) (Designers Required - plans, drawings and related documents to be prepared by architect or professional engineer).

Ozone Depleting Substances Regulation (Ozone Depleting Substances Act): Man. Reg. 178/2005 introduces extensive changes to the regulation. The title is changed to "Ozone Depleting Substances and Other Halocarbons Regulation". The new measures require sellers of ozone-depleting substances in aging commercial refrigeration, air conditioning, and fire suppressant equipment to take back and properly manage these substances. They prohibit owners or operators from refilling equipment with chlorofluorocarbons (CFCs), and implement the same handling requirements for the recovery and recycling of replacement products as that used in newer equipment. Refillable containers for all ozone-depleting substances are mandated.

Highway Traffic Act: 2005, c. 46 (Bill 61) amends the Act to abolish the Driver's Licence Suspension Review Board and revoke the appointment of its members (sections 85 - 93). New section 84.1 adds a new provision to provide an appeal from a decision of the registrar to refuse, suspend or cancel a licence or motor vehicle registration to the Trial Division.

Carrier Safety Regulations (Highway Traffic Act): N.F.L. Reg. 106/05 makes extensive changes to the regulations regarding vehicle registration, carrier safety ratings and compliance indicators, interventions when compliance indicators are exceeded, and facility audits. The Schedule regarding offences is also replaced.

Occupational Health and Safety Regulations (Occupational Health and Safety Act): N.L.R. Reg. 110/05 amends section 187.1 (diving standards) to update two Canadian Standards Association (CSA) standards, Z275.4 and Z275.2.

Fire Code (Fire Protection and Prevention Act, 1997): O. Reg. 650/05 amends section 2.13 (installation of smoke alarms), effective March 1, 2006. See the Ontario Gazette, December 31, 2005, p. 3763.

General - Waste Management (Environmental Protection Act): More sections of O. Reg. 461/05 are to come into force in 2006, 2007, and 2009: March 31, 2006 - storage, mixing, and on-site processing approval requirements; January 1, 2007 - new generator requirements; August 31, 2007 - land disposal restrictions: inorganic wastes; December 31, 2009 - land disposal restrictions: organic and mixed wastes & wastes, treated to specified standard and removal of all underlying hazardous constituents. Health Care and Residential Facilities (Occupational Health and Safety Act): O. Reg. 631/05 adds new provisions regarding Confined Spaces, sections 43 to 43.19, effective September 30, 2006. See the Ontario Gazette, December 24, 2005, p. 3686.

Division 2 AMENDMENTS

Section 2.A Acts

Ambulance Act: 2005, c. 31, Schedule 1 (Bill 18) amends section 4 and replaces clause 22(1)(e.6) to provide that one or more corporations without share capital may be designated as having the powers and responsibilities of a base hospital.

Building Code Act, 1992: 2005, c. 33 (Bill 128) replaces subsections 36(3) &(4) (maximum penalties for offences are doubled).

Conservation Land Act: 2005, c. 30 (Bill 16) amends section 3 to allow an easement or covenant under the Act to be for the conservation, preservation or protection of land for agricultural purposes.

Fire Protection and Prevention Act, 1997: 2005, c. 33 (Bill 128) doubles the maximum penalties for offences (see sections 28, 29 & 30).

Fuel Tax Act: 2005, c. 31, Schedule 7 (Bill 18) amends section 2 to clarify the application of tax in respect of clear fuel. Other technical amendments are made, and spent provisions are repealed. See sections 4.8(4), 4.9, 9(3), 8(11), 13(10.5), 21(1) & (2)(d).

Highway Traffic Act: More section of 2002, c. 18, Sch. P are now proclaimed in force. Among other changes, section 19 is replaced (person deemed to be operator), section 23.1 is added (insurance for persons carrying goods for compensation), section 47 is amended (permits, licences, certificates not to be issued), section 124 is replaced (power of officer to have vehicle weighed, examined), sections 191.0.1 (contracts of carriage) and 216.1 (power of officer to examine commercial vehicles) are added; many sections are amended to reflect the repeal of the Truck Transportation Act. 2005, c. 32 (Bill 58) adds subsection 177(3.1) (prohibition of subsection (2) does not apply to fund-raising by charities).

Designated Substance - Silica (Occupational Health and Safety Act): O. Reg. 606/05 replaces clause 4(1)(a) (cristobalite).

General (Energy Efficiency Act): More sections of O. Reg. 384/05 are in force, replacing item 17 of the Schedule (Canadian Standards Association Standard (CSA) C656-05 added), and repealing items 18, 21, and 37 to 39.

Restricted Use of Left Lanes by Commercial Motor Vehicles (Highway Traffic Act): O. Reg. 619/05 amends sections 1 to 3 to accommodate high occupancy vehicle lanes.

Building Act: As a consequential amendment of 2005, c. 32 (Bill 83), amendments of a technical nature are made to section 65.4 ("regional board" replaced by "agency").

Environment Quality Act: 2005, c. 33 (Bill 107), now proclaimed in force, transposes to the Environment Quality Act certain powers originally conferred by the Act respecting the establishment and enlargement of certain waste elimination sites and the Act to prohibit the establishment or enlargement of certain waste elimination sites, which are repealed. The amendments also provide for the arbitration of any disagreement between municipalities concerning the cost of waste elimination services following an order issued under section 61 of the Act. See sections 31.5, 31.6, 61, and 124. 2005, c. 28 (Bill 111) changes a ministerial name in 4 sections French language version.

Highway Traffic Code: The parts of 2005, c. 39 (Bill 129) in force amend section 621 (regulations). French language version.

An Act respecting industrial accidents and occupational diseases: As a consequential amendment of 2005, c. 32 (Bill 83), amendments of a technical nature are made to sections 195, 208, and 229 (reference to another Act). 2005, c. 38 (Bill 126) replaces the definition of "gross wages" in section 289 (applying from January 1, 2006). French language version.

An Act respecting medical laboratories, organ, tissue, gamete and embryo conservation, and the disposal of human bodies: As a consequential amendment of 2005, c. 32 (Bill 83), the definition of "regional board" in section 1 is replaced.

Mining Act: 2005, c. 45 (Bill 121) establishes a classification system for outstanding geological sites where mining activities are to be forbidden. It also provides that the Minister may take the measures needed to ensure the development and preservation of such sites. Amendments clarify the interdiction to prospect on certain parcels of land and the powers granted to inspectors authorized by the Minister. Changes are introduced to the time at which certain reports must be submitted, the length of the temporary suspension of certain rights and the time at which such a suspension takes effect. See sections 27, 30.1, 222, 251, 304.1, 305.1 - 305.5, 321.1.

An Act respecting occupational health and safety: 2005, c. 7 (Bill 85), now proclaimed in force, amends section 176.0.1 (change of citation to another Act). As a consequential amendment of 2005, c. 32 (Bill 83), amendments of a technical nature are made to several sections ("regional board" replaced by "agency"...) French language version.

An Act respecting owners and operators of heavy vehicles: 2005, c. 39 (Bill 129) renames the Act "An Act respecting owners, operators and drivers of heavy vehicles". The amendments harmonize the provisions of the Act with the new provisions of federal road transport legislation and regulations. The changes adjust the scope of the Act, in particular with regard to drivers and to the notions of "heavy vehicle" and "operator of a heavy vehicle". They revise the safety-rating assignment and registration system applicable to operators, as well as the measures concerning the processing and exchange of information for the purpose of rating operators. They also contain provisions intended to facilitate the application of the Act, especially as to the identification of heavy vehicle operators and the powers of the Commission des transports du Qu�bec to ensure that safety standards are met by heavy vehicles and their drivers. Some amendments are yet to be proclaimed. See especially sections 5-7, 12, 16.1-16.3, 26-32.1, 48-48.2 and 48.4.

Public Health Act: As a consequential amendment of 2005, c. 32 (Bill 83), sections 7 and 13 are amended (reference to another Act), and amendments of a technical nature are made to various other sections ("regional board" replaced by "agency").
