Introduction

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions up to February 2006. To assist you in tracking changes to this report from the previous month, the new text will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force between January 2006 and February 2006. These amendments have been incorporated in the respective legislation by CCOHS staff. They will appear on subsequent issues of the Canadian enviroOSH Legislation.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2006. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (Governing Act).

4. New documents for the 2006-1 Issue of the Canadian enviroOSH Legislation CD

Documents that will be on the 2006-1 Issue of the Canadian enviroOSH Legislation CD-ROM series. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Section 2.A Acts

Agricultural Operation Practices Act: As a consequential amendment of 2003, c. 26, now proclaimed in force, minor changes are made to section 1(b)(ii) &(c.1).

Public Health Act: The part of 2005, c. 13 (Bill 7) which amends the Act is now proclaimed in force, which repeals sections 1(ee.1), 11, and 66(1)(aa) - (cc). 2002, c. 20, now proclaimed in force, changes an Act name in clause 1(g).

Section 2.B Regulations

Firefighters' Primary Site Cancer Regulation (Workers' Compensation Act): Alta. Reg. 249/2005 replaces section 1 (adds definition of "non-smoker"), and amends the table in section 2.

Workers' Compensation Regulation (Workers' Compensation Act): Alta. Reg. 250/2005 adds sections 20.1 (appointment of counsel) and 20.2 (counsel must consult with claimant), and replaces section 21 (legal costs).

Coal Act: clause 2(3)(e) (right of entry on Crown land by recorded holder) is brought into force because section 7 of 2003, c. 74 is now proclaimed in force.

Forest and Range Practices Act: As a consequential amendment of 2003, c. 74, now proclaimed in force, the definition "objectives set by government" in subsection 1(1) is amended.

Forest Practices Code of British Columbia Act: As a consequential amendment of 2003, c. 74, now proclaimed in force, sections 3 to 5, 9 and 9.1 are repealed.

Land Act: Sections of 2003, c. 74 now proclaimed in force, adds sections of new Part 7.1 - Land Designation and Establishment of Objectives: sections 93.01 to 93.02 and 93.4 to 93.81.

Workers' Compensation Act: 2005, c. 41 (Bill 11) now proclaimed in force, replaces the definition of "occupational disease" in section 1 and adds section 6.1 (firefighters' occupational disease presumption). The amendments are made retroactive to April 11, 2005.

Section 2.A Acts

Workers' Compensation Act: Most 2005, c. 17 amendments are now proclaimed in force. The majority of the changes apply to work-related injuries or diseases occurring on or after January 1, 2006. Other changes, largely related to coverage and return to work, are to be implemented following further consultation with affected industries, employers and workers. The amendments affect the following matters: employer pays for day of injury; no reduction in wage loss benefits after 24 months; no maximum insurable earnings; top ups: workers may top up their wage loss benefits to 100% of net regular take home pay through income from other sources; wage loss benefits for injured workers earning minimum wage or less; wage loss benefits for older workers; re-employment: certain employers will have an obligation to re-employ injured workers - this obligation will not come into effect until after a WCB consultation process; permanent impairment awards; survivors' benefits and date of death; compensation and costs payable on the death of a worker; age-related reductions to permanent impairment awards and survivor benefits; individuals in work experience or job training programs; claims suppression. Man. Reg. 186/2005 adjusts the dollar amounts in sections 28, 29, 31, 38, and 68 for 2006.

Section 2.B Regulations

Electricians Licensing Regulation (Electricians' Licence Act): Man. Reg. 195/2005 is amended in several places, including: section 2 (qualifications of licence applicants), 10 (licence expiry date), 15 & 16.1 (fees). A Schedule is added (limited specialized trade electrician's licence).

Livestock manure and Mortalities Management Regulation (Environment Act): Man. Reg. 194/2005 replaces the definition of "pollution" in section 1, replaces subsection 13(7) (qualifications to prepare a manure management plan) and makes other housekeeping changes.

Prescribed Spraying Equipment and Controlled Products Regulation(Pesticides and Fertilizers Control Act): Man. Reg. 189/2005 replaces section 4 (products prescribed as controlled products for purposes of Act) and subsection 6(1) (missing inventory to be reported).

Provincial Land Use Policies (Planning Act): Man. Reg. 193/2005 amends the Schedule: in "General Scope and Application" the exception for the City of Winnipeg is removed; definitions are added; Policy #2 is amended (Agriculture); an Appendix is added (Siting and Setback of Livestock Operations).

Wildlife Protection Regulation (Wildlife Act): Man. Reg. 2/2006 makes changes to the regulation, including: adding a general heading "Wildlife Health and Genetic Integrity" with new section 6.3 (powers of director - wildlife health surveillance); adding Schedules A (Diseases and Parasites), B (Wildlife Control Zones), and C (Mandatory Testing Schedule).
