Canada Occupational Safety and Health Regulations (SOR/86-304): Proposed new regulation on diving operations (to form Part XVIII of the regulations). Text in Canada Gazette, Part I, October 4, 1997, p. 3202.

Canadian Environmental Protection Act Schedules I & II: Recommendation to add (4-Chlorophenyl)cyclopropylmethanone, O-[(4-nitrophenyl)methy]oxime to the Schedules. Text in Canada Gazette, Part I, October 4, 1997, p. 3200. Recommendation to add 18 chemicals to Schedule I. Text in Canada Gazette, Part I, April 4, 1998, p. 762.

Gasoline Regulations (Canadian Environmental Protection Act): The purpose of the proposed regulations is to allow an exemption, until December 31, 2002, for all competition vehicles from the restriction on the use of leaded gasoline. The text of the regulations may be found in the Canada Gazette Part I, 25 October, 1997, page 3423.

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): Item 1 of Schedule II would raise the cost of the Migratory Game Bird Hunting Permit to $8.00. Text in Canada Gazette, Part I, April 4, 1998, p. 764.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Regulation SOR/98-125 amends sections 2, 6, 8, 9 and section 208 of Schedule IV (all related to vehicle overloading). In addition, there is a new section 5.2 (Gross Vehicle Weight Rating). These are final version changes , effective April 1, 1999. They are found in the Canada Gazette, Part II, Vol. 132, No. 5, p. 738.

Pest Control Products Regulations (C.R.C. 1978) (Pest Control Products Act): The proposed amendments are intended to reduce overlap by exempting disinfectant uses of some control products from the Pest Control Products Act in order to consolidate their regulation under the Food and Drugs Act (FDA). Text in Canada Gazette, Part I, December 6, 1997, page 3750.

Prohibition of Certain Toxic Substances Regulations (SOR/96-237) (Canadian Environmental Protection Act): Recommendation to add (4-Chlorophenyl)cyclopropylmethanone, O-[(4-nitrophenyl)methy]oxime to the list of toxic substances. Text in Canada Gazette, Part I, October 4, 1997, p. 3195.

Draft Regulation - Occupational Health and Safety in Mines (An Act respecting occupational health and safety): The purpose of the draft regulation is to ensure the health and safety of miners and to provide for more appropriate standards in the mining sector. Draft Regulation - Petroleum Products (An Act respecting the use of petroleum products): The purpose of the proposed amendments is to make adjustments in the quality requirements for petroleum products. Text is found in the Quebec Gazette, Part 2, December 3, 1997, p. 5729.

Draft Regulation - Plumbing Code (An Act respecting piping installations): The purpose of the Draft Regulation is to adopt the 1995 edition of the National Plumbing Code of Canada with certain amendments intended to make its application easier. 2. AMENDMENTS

The following list contains information about amendments which have come into force between March and April 1998, and have been incorporated into the respective legislation by CCOHS staff. The amended legislation will appear on the 98-3 issue of the Canadian enviroOSH Legislation series.

Regulations

Domestic Substances List (Canadian Environmental Protection Act): Regulations SOR/98-144 and SOR/98-145 both add chemicals to Parts I and II of the List.

2. ALBERTA

Regulations

Explosives Safety Regulations (Occupational Health and Safety Act): Regulation 39/98 amends and replaces several sections, including 12 - 14 (issuance of valid permit; cancellation or suspension of permit).

Food Regulation (Public Health Act): Regulation 56/98 adds a new section, 19.1 (selling of pasteurized milk past its due date).

Radiation Health Administration Regulation (Government Organization Act): Regulation 38/98 replaces Schedule 2 (Agencies).

2. BRITISH COLUMBIA

Acts

Mines Act: B.C. Regulation 23/98 makes a minor change in the definition of "local union" in section 1.

Regulations

Motor Vehicle Act Regulations: B.C. Regulation 29/98 replaces section 23.11 (protected/permissive left turn signal control system installed by authority).

Occupational Environment Regulations (Workplace Act): Regulation 296/97 (effective April 15, 1998) repeals Division 1 (except the definitions of "Act" and "industrial establishment") and 5 to 11; and revises other sections as sections 4.84 to 4.106 of the Occupational Health and Safety Regulation.

Regulations

Used Oil, Oil Filters and Containers Stewardship Regulation (Waste Reduction and Prevention (WRAP) Act): Regulation 43/98 repeals section 3(4) (charging of amount re retail sale).

2. NEW BRUNSWICK

Acts

Boiler and Pressure Vessel Act: 1998, c. 3 (Bill 20) amends sections 27.2 and 27.3 (Gas Board; examination for degree of competency).

Worker's Compensation Act: 1998, c. 4 (Bill 21) amends and adds several sections, including: adding section 38.11 (compensation provisions are enacted in respect of workers who are injured
or suffer a recurrence of an injury on or after January 1, 1998); section 38.22 (pension benefits are enacted for certain workers); sections 38.51-38.54 (benefits provisions are enacted for surviving dependents of workers who die on or after January 1, 1998); section 38.81 ( a spouse who lost benefits under section 38.6 or 38.8 as a result of the operation of subsection 38.6(7) or 38.8(8)
before its repeal may apply on or before January 1, 2001, to have benefits reinstated under those sections and the Commission may reinstate the spouse; pension benefits under section 38.7 are also reinstated where applicable).

2. NEWFOUNDLAND

Acts

Food and Drug Act: 1997, c. 39 (Bill 7) amends and replaces several sections of the Act, including replacement sections for: inspection; search and seizure; return or destruction of food; food offered as prizes; handling and storage of food; slaughter of animals; sampling of food; division of samples; offence re: inspection; penalties).

Public Health Act: 1997, c. 24 (Bill 43) in force April 1, 1998, changes the name of the Act (now, Health and Community Services Act), replaces sections 3 and 4 (officials of public institutions; regional health and community services boards), 6 (interference with health officer or social worker) and 11(a), (b) and (c).

Wilderness and Ecological Reserves Act: 1997, c. 40 (Bill 40) replaces section 12(2), repeals section 12(3), replaces sections 13 to 15 (duties of minister; provisional reserve; information on reserves) and 18 (reserve established) and amends other sections (references to provisional reserve).

2. ONTARIO

Acts

Building Code Act, 1992: 1997, c. 30 (Bill 152, Sch. B) makes extensive amendments and additions to the Act, including: new sections 3.1 (enforcement, boards of health), 10.1 (sewage systems), 18.1 (qualifications for working on sewage systems); replacement section 19 (obstruction of person performing duties under Act); new sections 32.1 (sewage systems) and 38.1 (suspension of licence).

Highway Traffic Act: Sections of 1996, c. 31, Part IX (Bill 82) now in force amends the heading to Part XIII, repeals section 197, and adds sections 198.1 (licence suspension on direction of Director of Family Responsibility Office), 198.2 (personal information disclosed by Registrar), and 198.3 (protection from personal liability for government employees).

Regulations

General (Pesticides Act): Regulation 129/98 replaces section 94 (certified and assistant agriculturalists; schedule 2 or 5 pesticides).

General -- Waste Management (Environmental Protection Act): Regulation 128/98 adds paragraph 14 to section 2(1); adds paragraphs 3-7 to section 3(2); and adds a definition of "ground cover" to section 3.

Joint Health and Safety Committees -- Exemption from Requirements (Occupational Health and Safety Act): Regulation 131/98 replaces the definition of "ordinary worker". In force, May 1st , 1998.

2. PRINCE EDWARD ISLAND

Regulations

Electrical Inspection Act Regulations: Regulation EC 1998-124 replaces section 5(2) (contractor's license); adds section 5(3.1) (duties of the Board); and adjusts a fee in section 4.1 of Schedule 4.

2. QUEBEC

Regulations

Liquid Effluents of Petroleum Refineries Regulation (Environment Quality Act): Regulation 243-98 deletes a definition in section 1; replaces the table in section 6 (nature of contaminant); and amends various other sections in regard to sampling and analysis (a new sampling method is cited).

3. REPEALED LEGISLATION

The following documents were repealed by the respective jurisdictions and are removed from the Canadian enviroOSH Legislation series as of April 24, 1998. The title of the repealed legislation is given and, in the case of regulations, the authority under which they were made (GOVERNING ACT)
