Canada Occupational Safety and Health Regulations (SOR/86-304): Proposed new regulation on diving operations (to form Part XVIII of the regulations). Canadian Environmental Protection Act Schedules I & II: Recommendation to add (4-Chlorophenyl)cyclopropylmethanone, O-[(4-nitrophenyl)methy]oxime to the Schedules. Text in Canada Gazette, Part I, October 4, 1997, p. 3200. Recommendation to add 18 chemicals to Schedule I. Text in Canada Gazette, Part I, April 4, 1998, p. 762.

Energy Efficiency Regulations (Energy Efficiency Act): The proposed amendments will introduce minimum energy efficiency standards for 15 energy-using products and increase the existing energy efficiency standard for 2 products. Text in Canada Gazette, Part I, July 4, 1998, p. 1615.

Gasoline Regulations (Canadian Environmental Protection Act): The purpose of the proposed regulations is to allow an exemption, until December 31, 2002, for all competition vehicles from the restriction on the use of leaded gasoline. The text of the regulations may be found in the Canada Gazette Part I, 25 October, 1997, page 3423.

Migratory Birds Regulations (Migratory Birds Convention Act, 1994): Item 1 of Schedule II would raise the cost of the Migratory Game Bird Hunting Permit to $8.00. Text in Canada Gazette, Part I, April 4, 1998, p. 764.

Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations: A proposed amendment may be found in the Canada Gazette, Part I, June 27, 1998, p. 1564 affecting sections 14(1) and 18(2).

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): Regulation SOR/98-125 amends sections 2, 6, 8, 9 and section 208 of Schedule IV (all related to vehicle overloading). In addition, there is a new section 5.2 (Gross Vehicle Weight Rating). These are final version changes , effective April 1, 1999. They are found in the Canada Gazette, Part II, Vol. 132, No. 5, p. 738. A proposed amendment may be found in the Canada Gazette, Part I, June 27, 1998, p. 1562 affecting sections 10(1) and 15(2).

Motor Vehicle Tire Safety Regulations, 1995: A proposed amendment found in the Canada Gazette, Part I, July 27, 1998, p. 1563 affects sections 11(1) and 15(2).

Pest Control Products Regulations (C.R.C. 1978) (Pest Control Products Act): The proposed amendments are intended to reduce overlap by exempting disinfectant uses of some control products from the Pest Control Products Act in order to consolidate their regulation under the Food and Drugs Act (FDA). Draft Regulation - Plumbing Code (An Act respecting piping installations): The purpose of the Draft Regulation is to adopt the 1995 edition of the National Plumbing Code of Canada with certain amendments intended to make its application easier. Draft Regulation: Safety Standards for Road Vehicles (Highway Safety Code) replaces the Regulation respecting the inspection and safety standards for road vehicles and the Regulation respecting the mechanical inspection reciprocal agreement between the Government of Quebec and certain North American jurisdictions. It is intended to harmonize Quebec standards with those of other North American jurisdictions, to improve the mechanical inspection program, and to propose standards for installing compressed natural gas or propane fuel supply systems for vehicle engines. 2. AMENDMENTS

The following list contains information about amendments which have come into force between July and August 1998, and have been incorporated in the respective legislation by CCOHS staff. The amended legislation will appear on the 98-4 issue of the Canadian enviroOSH Legislation series.

2. CANADA

ACTS

Canada Labour Code: As a consequential amendment to 1998, c. 20 (Senate Bill 2) section 127(2)(a) is amended.

Canada Shipping Act: Sections of 1998, c. 6 (Senate Bill 4) in force replace sections 574 to 577 and 579 to 583 (limitation of liability for Maritime claims); sections 565(4), 584 and 587 are repealed. Schedule VI is added (text of Articles 1 to 15 of the Convention of Liability for Maritime Claims, 1976 as amended by the Protocol of 1996). The section of 1998, c. 16 (Bill C-15) in force adds Part XVI.1 (Lower St. Lawrence Pilot's Pensions), sections 727.1 to 727.7.

Canadian Transportation Accident Investigation and Safety Board Act: 1998, c. 20 (Senate Bill 2) amends the Act in several places. It implements recommendations made by the Canadian Transportation Accident Investigation and Safety Board Act Review Commission established to review the Act. It allows the Board to enter into agreements with the provinces relating to transportation occurrences coming within provincial legislative authority. It also increases the protection given to information provided to the Board in the course of its investigations, and makes some technical amendments.

Manganese-based Fuel Additives Act: SOR/98-393 amends the Schedule to the Act by deleting "Methylcyclopentadienyl manganese tricarbonyl"

REGULATIONS

Transportation of Dangerous Goods Regulation (Transportation of Dangerous Goods Act, 1992): Regulation SOR/98-371 amends the regulation in several sections to introduce the following standards revisions: (1) CSA B339-96 (Cylinders, Spheres, and Tubes for the Transportation of Dangerous Goods), (2) CSA B340-97 (Selection and Use of Cylinders, Spheres, Tubes and Other Containers for the Transportation of Dangerous Goods, Class 2), (3) CGSB 43.150-97 (Performance Packagings for the Transportation of Dangerous Goods), (4) CGSB 43.146-94 (Intermediate Bulk Containers for the Transportation of Dangerous Goods), (5) 43.151-97 (Packing of Explosives (Class 1) for Transportation, (6) CGSB 43.147-97 (Construction and Maintenance of Tank Cars and Selection and Use of Tank Cars, Portable Tanks and Rail Cars for the Transportation of Dangerous Goods). As well, several standards are repealed.

2. ALBERTA

ACTS

Environmental Protection and Enhancement Act: Amendments by 1998, c. 15 (Bill 33) change the Act in several places, including: replacement of section 10 (committees to review Act); new section 62.1 (refusal of approval or registration because of unpaid debts); replacement of section 99(1) (duty to report environmental release); replacement of section 127(2)(a) (environment protection orders regarding conservation and reclamation); new section 205.1 (costs incurred by Director, investigator or inspector); new section 210.1 (registration of orders).

Oil and Gas Conservation Act: As a consequential amendment of 1998, c. 23 (Bill 43) section 77(c) is amended (reference to Public Trustee Act).

REGULATIONS

Edmonton Restricted Development Area Regulations (Government Organization Act): Regulation 133/98 makes a minor amendment to the Schedule.

Hydro and Electric Energy Regulation (Hydro and Electric Energy Act): Regulation 144/98 amends section 8; adds section 8.1 (report to Board by electric utility operator); replaces section 15 (small power plants); adds new section 15.1 (reports to Board relating to small power plants); repeals section 16.

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Regulation 143/98 adjusts the fiscal year of the Board and the annual adjustment factor (sections 16.081 and 16.100).

Public Vehicle Weight Regulation (Motor Transport Act): Regulation 127/98 repeals all of the regulation except 6(1) - (3) (fees for overload permits). (Regulation 127/98 is the replacement regulation).

2. BRITISH COLUMBIA

ACTS

Land Act: As a consequential amendment of 1998, c. 18 (Bill 23) section 6(3) is replaced (minister may make regulations prescribing fees).

Waste Management Act: 1998, c. 21 (Bill 17) amends the act in several places: it replaces two definitions in section 1 ("district director"; "recyclable material"); replaces the definitions in section 17 (for MUNICIPAL WASTE MANAGEMENT Part); replaces section 18(9); replaces section 19 (authority to manage municipal solid waste and recyclable material in regional districts); adds 19.1 (municipal solid waste disposal fees); adds sections 24.1 - 24.4 (disposal of municipal solid waste in Greater Vancouver and other regional districts; bylaws).

Workers Compensation Act: Regulation 214/98 contains the July 1, 1998 Consumer Price adjustments for various sections of the Act.

REGULATIONS

Forest Road Regulation (Forest Practices Code of British Columbia Act): Regulation 183/98 amends the regulation in sections 1, 4, 6, 8, 11 and 16. The major changes relate to: riparian management areas; terrain stability field assessments for road layout and design; water quality in a community watershed).

Motor Carrier Regulation No. 2 (Motor Carrier Act): Regulation 239/98 amends section 2(2)(a) (exemption for Canada Post Corporation) and section 23(1).

Motor Vehicle Act Regulations: Regulation 229/98 adds the definition "approved driver education course" to section 27.01 and amends sections 27.07, 27.08, and 27.09; and replaces section 27.10(2)(e) (permitted endorsements by driver training schools).

Open Burning Smoke Control Regulation (Waste Management Act): Regulation 262/98 amends the regulation in several places, including adding the definition "prescribed burning" in section 1; adding section 3.1 (open burned prohibited material); replacing section 5 (offence and penalty).

Operational Planning Regulation (Forest Practices Code of British Columbia Act: Regulation 184/98 amends the regulation in several places: sections 1 (definitions), 3, 7, 12, 16-18, 20, 23, 37, 47-48, 68-69, and 72. Among other areas, the changes affect ungulate winter ranges, archaeological impact assessments, terrain stability, cutblocks, treatment standards.

Silviculture Practices Regulation (Forest Practices Code of British Columbia Act): Regulation 185/98 replaces the definition of "silviculture treatment" in section 1; adds section 4(2) & (3) (riparian classification); amends section 10; replaces section 13(9) (coniferous trees); and amends sections 22, 25, and 32.

Timber Harvesting Practices Regulation (Forest Practices Code of British Columbia Act): Regulation 186/98 replaces section 3(1) with 3(1) & (1.1) (marking of wildlife trees); replaces section 6 (harvesting adjacent to unidentified or incorrectly classified streams, wetlands and lakes); replaces section 9 (harvesting adjacent to recently harvested cutblocks); replaces section 22(2).

2. MANITOBA

ACTS

Environment Act: As a consequential amendment of 1997, c. 61 (in force on July 1, 1998), the definition of "fund" in section 1 is repealed, as are sections 4, 45.1 and 45.2 (references to Sustainable Development Innovation Fund and State of the Environment Report).

2. NEW BRUNSWICK

REGULATIONS

General Regulation -- Motor Vehicle Act: Regulation 98-57 replaces section 7(10.1) (special permits issued to residents of the State of Maine).

General Regulation -- Workers' Compensation Act: Regulation 98-60 repeals sections 17.1 (indemnification of Board employee or member), 17.2 (Board member conflict of interest), and 17.3 (disclosure to Board by Appeals Board member).

2. NORTHWEST TERRITORIES

ACTS

Explosives Use Act: As a consequential amendment to the Budget Measures Implementation Act 1996-97 (c. 9, Sch. I), sections 1, 5, 11, and 12 are amended (replacement of reference to "Commissioner" with "Board" (i.e. Workers' Compensation Board).

Mine Health and Safety Act: As a consequential amendment to the Budget Measures Implementation Act 1996-97 (c. 9, Sch. I), several sections are amended to replace "Minister" with "Board" (i.e. Workers' Compensation Board); new section 37.1 is added (fees); 39(2) is added (application of fines); section 48(1.1) is added (chairperson of Mine Occupational Health and Safety Committee).

Safety Act: As a consequential amendment to the Budget Measures Implementation Act 1996-97 (c. 9, Sch. I), the Safety Act is amended to replace "Commissioner" with "Board" (i.e. Workers' Compensation Board) in several sections; 11(4) is replaced with 11(4) & (5) (liability of government employees); a new section 21.1 is added (fees); section 22(6) is added (application of fines).

Workers' Compensation Act: As a consequential amendment to the Budget Measures Implementation Act 1996-97 (c. 9, Sch. I), sections 1, 6, 57, 61 and 62 are amended. The amendments relate to the Workers' Compensation Board administering three acts (Explosives Use; Mine Health and Safety; Safety) and the Accident Fund.

2. ONTARIO

REGULATIONS

Fire Code (Fire Protection and Prevention Act, 1997): Regulation 393/98 revokes articles 2.13.1.1 and 6.3.3.1 and substitutes "RESERVED". Regulation 428/98 replaces article 1.1.6.2 (hotels).

2. QUEBEC

ACTS

Conservation and Development of Wildlife: 1998, c. 29 (Bill 421) transfers to the Minister powers concerning the establishment of wildlife areas and the determination of standards relating to the conditions for the harvesting of wildlife. Under the amendments, the Minister may, for scientific, educational or wildlife management purposes, issue a licence authorizing a person to disregard a prohibition of the law concerning the modification of a wildlife habitat component. Other amendments include new sections 84.1 - 84.3 (Territories Delimited for Wildlife Harvesting).

Electrical Installations: As a consequential amendment of 1998, c. 46 (Bill 445) section 35 is amended (reference to Corporation des maitres electriciens du Quebec).

Industrial Accidents and Occupational Diseases: As a consequential amendment to 1998, c. 28 (Bill 420) section 11(2) is replaced (persons deemed employed by the government). As a consequential amendment to 1998, c. 39 (Bill 404) section 195 has a paragraph added at the end.

Mining Act: Certain sections of 1998, c. 24 (Bill 182) came into force on June 17, 1998. Sections affected include: 112, 113, 115, 260, 375 (repealed); sections 114, 266, 287, 374 (replaced); new sections 115.1 (lands in public domain subject to mining concession), 364.1, 374.1 to 374.3 (deeds of alienation).

Occupational Health and Safety: As a consequential amendment of 1998, c. 39 (Bill 404) the definition of "regional board" in section 1 is amended.

Piping Installations: As a consequential amendment of 1998, c. 46 (Bill 445) section 12 has a paragraph added (reference to Corporation des maitres mecaniciens en tuyauterie du Quebec).

Public Health Protection Act: As a consequential amendment of 1998, c. 39 (Bill 404) the definition of "regional board" in section 1 is amended.

REGULATIONS

Plumbing Code (Act respecting Piping Installations): Regulation 567-98 makes a minor amendment to section 1.2.2 of the Plumbing Code (R.R.Q., 1981, c. I-12.1, r.1). Regulation 567-98 is the replacement Plumbing Code; despite this, sections 1.2.2, 1.2.5, 1.3.1 to 1.3.3, Subdivision 1.4 and sections 1.4.1 to 1.4.4 of R.R.Q., 1981, c. I-12.1, r.1 shall continue to apply after August 4th , 1998; also, the old Plumbing Code may apply to plumbing systems and alterations forwarded to the Board prior to August 4th 1998.
