PRODUCT/SERVICE DESCRIPTION
The National Arts Centre (NAC) eMemberList 'Product/Service' provides registered users the ability to opt-in, and receive electronic messages via email over the Internet. These messages have the capability of embedding rich media content, including but not limited to text, images, video, music and sounds and other audiovisual or interactive elements ("Messages"). Unless explicitly stated otherwise, any new features that augments or enhances the current Product, including among other things the release of new Products or Services, shall be subject to the TOS set forth by the National Arts Centre.

EMAIL DELIVERY/RECEIPT
Occasionally circumstances beyond the control of the Product/Service application may create disruptions to the delivery and receipt of Messages. Some of these circumstances may include client side firewalls, network restrictions, software issues, email filters, vacationing email, changed/outdated contact information, etc. As a User you understand you may miss a campaign in which they were subscribed to as a result of circumstances out of your control. Users regularly and frequently manage their profile ensuring timely and accurate delivery of opt-in campaigns to your specified email inbox. Additionally, Users can visit campaign archives and view post published campaigns to ensure information is disseminated to users.

UNSOLICITED MAIL / SPAM
The National Arts Centre and its email marketing Product/Service ONLY supports permission-based marketing practices. The National Arts Centre has implemented various policies and procedures that:

  • Encourage permission-based, opt-in marketing.
  • Help prevent receiving unsolicited email campaigns.
  • Respond to complaints about Product/Service operations.
Spam is considered unsolicited commercial email (UCE), junk mail, or bulk mail that has not been requested by the recipient. In addition to being perceived as intrusive, irrelevant and often offensive, it is also typical that spam emails do not contain an option to unsubscribe from the mailing list. To help better understand, 'Spam' is the opposite of permission-based emails which are requested, anticipated, personal and relevant, based on a users sign-in and statement of preferences.

REGISTRATION OBLIGATIONS
In consideration of Your use of the Product/Service, You agree to: (a) provide true, accurate, current and complete information about yourself as requested from time to time by the Product/Service (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If You provide any information that is untrue, inaccurate, not current or incomplete, our Product/Service has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, and the Product/Service has the right to suspend or terminate Your account and refuse any and all current or future use of the Product/Service (or any portion thereof) by You.

USER PRIVACY
The National Arts Centre considers the Messages to be the private correspondence between the sender and recipient. The NAC will not monitor, edit or disclose the contents of a End User's private communications without End User's prior permission, except that End User agrees NAC may do so: (a) as required by law; (b) to comply with legal process; (c) if necessary to enforce the Terms of Service; (d) to respond to a good faith belief or third party claims that such contents violate the rights or interests of a third party or the Terms of Service; (e) to protect the rights or property of NAC or others. End User understands and agrees that technical processing of the Messages is and may be required (i) to send and receive the Messages; (ii) to conform to the technical requirements of connecting networks; (iii) to conform to the limitations of the NAC Product/Service; (iv) to conform to other, similar technical requirements, or as otherwise stated in the NAC Privacy Policy, as updated from time to time, incorporated herein by reference.
