HOSPITAL FOUNDATIONS
REGULATION
1 In this Regulation,
(a) “Act”
means the Hospitals Act;
(b) “Benefits
Regulations” means the Alberta Hospitalization Benefits Regulations
(Alta. Reg. 355/73);
(c) “discretionary
revenue” has the same meaning as in section 2(2)(g.1) of the Benefits
Regulations;
(d) “hospital operating surplus” has the same
meaning as in section 2(2)(h.4) of the Benefits Regulations.

2 A board may transfer the
following types of property to a foundation:
(a) donations
or gifts, subject to or bearing trust conditions imposed on the board;
(b) unappropriated
annual hospital operating surpluses accumulated prior to April 1, 1958;
(c) subject to the prior approval by the
Minister for each transfer discretionary revenue not required for any of the
purposes prescribed in section 21.3 of the Alberta Hospitalization Benefits
Regulations (Alta. Reg. 355/73).

3 Before commencing to wind‑up a foundation
pursuant to section 59 of the Act, a board shall forward to the Minister, for
approval by the Lieutenant Governor in Council, a plan for the winding‑up
of the foundation.
