APPROPRIATION ACT, 2006

Chapter 12

(Assented to May 24, 2006)

MOST GRACIOUS SOVEREIGN:


Preamble

WHEREAS it appears by Messages from His Honour Norman L. Kwong, Lieutenant Governor of the Province of Alberta, and the Estimates accompanying the Messages, that the sums hereinafter mentioned are required to defray certain charges and expenses of the Legislative Assembly and the Public Service of Alberta not otherwise provided for during the fiscal year ending March 31, 2007 and for other purposes relating thereto:

MAY IT THEREFORE PLEASE YOUR MAJESTY that it be enacted and be it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Alberta, as follows:

Expense and equipment/inventory purchases

1(1)  From the General Revenue Fund, there may be paid and applied a sum of $74 864 000 towards defraying the several charges and expenses of the Legislative Assembly classed as expense or expense and equipment/inventory purchases for the fiscal year ending March 31, 2007, as shown in the Schedule, including the amount of $19 000 000 voted by section 1(1) of the Appropriation (Interim Supply) Act, 2006.

(2)  From the General Revenue Fund, there may be paid and applied a sum of $26 748 531 000 towards defraying the several charges and expenses of the Public Service classed as expense or expense and equipment/inventory purchases for the fiscal year ending March 31, 2007, as shown in the Schedule, including the amount of $5 806 700 000 voted by section 1(2) of the Appropriation (Interim Supply) Act, 2006.

(3)  The sum referred to in subsection (2) includes $1 000 000 000 to be paid into the Alberta Heritage Savings Trust Fund in accordance with section 9.2 of the Alberta Heritage Savings Trust Fund Act.

Capital investment

2   From the General Revenue Fund, there may be paid and applied a sum of $1 175 595 000 towards defraying the several charges and expenses of the Public Service classed as capital investment for the fiscal year ending March 31, 2007, as shown in the Schedule, including the amount of $221 600 000 voted by section 2 of the Appropriation (Interim Supply) Act, 2006.

Non-budgetary disbursements

3   From the General Revenue Fund, there may be paid and applied a sum of $171 693 000 towards defraying the several charges and expenses of the Public Service classed as non‑budgetary disbursements for the fiscal year ending March 31, 2007, as shown in the Schedule, including the amount of $28 400 000 voted by section 3 of the Appropriation (Interim Supply) Act, 2006.

Lottery Fund payments

4(1)  From the Lottery Fund, there may be paid and applied a sum of $1 306 155 000 towards defraying the several charges and expenses of the Public Service classed as Lottery Fund payments for the fiscal year ending March 31, 2007, as shown in the Schedule, including the amount of $328 200 000 voted by section 4 of the Appropriation (Interim Supply) Act, 2006.

(2)  The amount to be paid and applied from the Lottery Fund for the Contingency Allowance identified in the Lottery Fund Estimates shall be increased so that the net revenue of the Lottery Fund at the fiscal year ending March 31, 2007 is nil.

Transfer of appropriations for emerging capital purposes

5(1)  The Minister of Infrastructure and Transportation may, for the purpose described in subsection (3), transfer an amount, not to exceed $50 000 000, from the Expense and Equipment/Inventory Purchases vote administered by that Minister

                                 (a)    to the Expense and Equipment/Inventory Purchases vote administered by any other Minister, or

                                 (b)    to the Capital Investment vote administered by the Minister of Infrastructure and Transportation.

(2)  The Minister of Infrastructure and Transportation may, for the purpose described in subsection (3), transfer an amount, not to exceed $122 000 000, from the Capital Investment vote administered by that Minister

                                 (a)    to the Capital Investment vote administered by any other Minister, or

                                 (b)    to the Expense and Equipment/Inventory Purchases vote administered by the Minister of Infrastructure and Transportation.

(3)  An amount transferred under this section shall be used only for an emerging capital expense or capital investment, as identified by the Minister of Infrastructure and Transportation and as approved by Treasury Board.

Accountability

6   The due application of all money expended under this Act shall be accounted for.
