Final Report

Transforming Relationships Through Participatory Justice

Acknowledgments

The Law Commission of Canada acknowledges the contributions of many people. In preparing this Report, it has benefited from the counsel and advice of numerous Canadians. Citizens active in restorative justice and in mediation programs, both advocates and critics, and many community groups involved in justice initiatives have participated in a variety of conferences, workshops, or discussion forums organized or supported by the Commission over the last three years. This Report could not have been written without their input.

Over the years, many members of the Advisory Council of the Law Commission have been involved in discussions of restorative justice and the Commission has been enriched by their wise comments. Thank you to Wendy Armstrong, Jacques Auger, Darin Barney, Lorraine Berzins, Céline Bureau, Dave Cassels, Dan Christmas, June Callwood, Bradley Crawford, Ervan Cronk, Janet Dench, Margaret Denike, Irène d’Entremont, Priscilla De Villiers, Wilma Derksen, Emerson Douyon, Leena Evic-Twerdin, Dave Farthing, Gerry Ferguson, Jean-Pierre Gariépy, Vinh Ha, Mavis Henry, Bernice Hollett, Andrée Lajoie, Alcide Leblanc, Wade MacLauchlan, Hans Mohr, Michael Morrison, Irma Murdock, Katherine Peterson, Alan Reynolds, Morris Rosenberg, Jennifer Stoddard and Mary-Ellen Turpel-Lafond.

The work of many scholars has inspired this Report: Jennifer Llewellyn and Robert Howse, Gerry Ferguson, Joan Ryan, Brian Caillou, Wendy Stewart, Audrey Huntley and Fay Blaney. The Commission benefited from the work undertaken in the context of its partnership with the Social Sciences and Humanities Research Council (Relationships in Transition 2000): Augustine Brannigan, Erin Gibbs Van Brunschot, John A. Baker, Julie Macfarlane, Paule Halley, Rebecca Hagey, Lucie Lamarche, Francine Tougas, Georges Legault and Lucie Lalonde.

Many commentators were asked to review different drafts, comment on our work or provide us with information. We wish to thank Kent Roach, Jamie Scott, Robert Cormier, Justice Louise Otis, David Daubney, Peter Bruer, Wilma Derksen, Mylène Jaccoud, Serge Charbonneau,

Jane Miller-Ashton and Johanne Vallée for their time and conscientious review of the work.

This Report is accompanied by a DVD, Community Mediation: Two Real-Life Experiences, produced by the National Film Board of Canada. Our partnership with the National Film Board has been very rewarding and we thank Stéphane Drolet, Yves Bisaillon, Jack Horwitz, David Boisclair and Christian Madagawa. Our thanks as well to the producer of the brochure accompanying this Report, Gaston St-Jean, and to the translators and production team.

Our Virtual Scholar in Residence for the year 2002–2003, Dr. Julie Macfarlane, is the primary author of this report. We owe her an enormous debt of gratitude.

The Commissioners want to thank in particular the director of research, Dr. Dennis Cooley, for his leadership in carrying this project forward. Dr. Cooley wrote the initial discussion paper From Restorative Justice to Transformative Justice; coordinated the production of the video, Communities and the Challenge of Conflict: New Perspectives on Restorative Justice; orchestrated the consultations and engagement strategies surrounding this project; and finalized the report—all while fulfilling his responsibilities as research director. We want to thank him very much for his dedication.

Other members of the team from the Commission to be thanked include: Maryse St-Pierre and Jocelyne Geoffroy (administrative support), Lise Traversy and Stéphane Bachand (communications) and Lorraine Pelot, Karen Jensen and Steven Bittle (research). Our co-op research students, Drew Mildon and Jennifer Schmidt, also contributed to finalizing the report. Thanks go as well to the Executive Director of the Commission, Bruno Bonneville, for supervising the production of the report.

Our past president, Roderick A. Macdonald and past Commissioners Alan Buchanan, Gwen Boniface and Stephen Owen all contributed to the early stages of this project. We acknowledge their contribution.

The final product is a joint effort of the staff and Commissioners of the Law Commission of Canada.
