Waste Management Must Sell Ridge Landfill

OTTAWA, November 23, 2004 – The Federal Court of Appeal has dismissed the latest attempt by Waste Management of Canada Corporation (formerly Canadian Waste Services Inc.) to overturn a Competition Tribunal order requiring the firm to divest its Ridge Landfill in Chatham, Ontario. If the landfill is not sold by January 4, 2005, then Deloitte and Touche Inc. will takeover the sales process as trustee appointed by the Tribunal.

The divestiture order was originally obtained by the Competition Bureau, in October 2001, to address competition concerns resulting from the merger of Canadian Waste Services Inc. and Browning Ferris Industries Ltd. in 2000. Selling the landfill to a competitor will preserve competition for commercial waste disposal in the Greater Toronto Area and elsewhere in southern Ontario.

The Competition Bureau is an independent law enforcement agency that promotes and maintains fair competition so that all Canadians can benefit from competitive prices, product choice and quality service. It oversees the application of the Competition Act, the Consumer Packaging and Labelling Act, the Textile Labelling Act and the Precious Metals Marking Act.
