2004

Application for judicial review of Decision 2003 CAPPRT 041 dismissed

The Federal Court of Appeal hearing was held on May 18 and 19, 2004 in Montreal. The Attorney General argued that the Tribunal had erred in including certain professional categories in the bargaining sector for which the federation composed of the Association des professionnelles et des professionnels de la vidéo du Québec and the Syndicat des techniciens du cinéma et de la vidéo du Québec was certified. The Court determined that the Tribunal had not exceeded its jurisdiction and dismissed the application.

2001

Application for judicial review of Decisions 2001 CAPPRT 033 and 2001 CAPPRT 036 discontinued

On October 29, 2001, The Writers’ Union of Canada (TWUC) filed an application for judicial review with the Federal Court of Appeal of Tribunal Decision 2001CAPPRT 033 as modified and made final by Decision 2001 CAPPRT 036. TWUC then applied for a stay of the proceedings. A notice to discontinue the application for judicial review was sent to the Federal Court of Appeal on December 30, 2002.

2000

Application for judicial review of Decision 1998 CAPPRT 028 dismissed

The Federal Court of Appeal hearing was held on November 15, 2000 in Toronto. The Attorney General argued that the Tribunal acted beyond its jurisdiction by declaring the sector suitable for bargaining in a manner which empowered The Writers' Union of Canada (TWUC) to bargain in respect of pre-existing works. The Court dismissed the application for judicial review and upheld the Tribunal's decision.
