Filing an Assignment or Licence

An assignment

An "assignment" consists of selling all or part of your rights in the design permanently to another party. This party or "assignee" assumes your ownership rights to make, use, import, rent or sell products incorporating the registered design and to authorize others to do so.

Assignments may be recorded against pending or registered designs.

A licence

When you license your design, you allow someone else to use it in accordance with the particular terms and conditions set out in the licence agreement as negotiated by the parties involved. In this case, you retain ownership and you can, in some instances, license more than one party.

Payments can be made using:

– American Express, MasterCard or VISA
– CIPO Deposit Account
This is not a debit card account. Please do not include any bank account information on the application. Contact the Client Service Centre for more information.

Fee (CAN$):

Examining an application to register an assignment, or any other document affecting a design, and issuing a certificate of registration:

New fee in force starting January 1, 2004
Recording an assignment or any document affecting a design pursuant to subsection 13(1) of the Act, for each design: $100
