Native Claims Research

Guidelines for
Informal Access to Records



Guidelines

small black diamond Upon arrival at the Indian and Northern Affairs Canada (INAC), the researcher will provide identification, a Band Council Resolution (BCR) or a letter authorizing that person to conduct research and to have access to files pertaining to the First Nation's or Inuit Association's claims research.
small black diamond BCR or a letter identifies:
  • the researcher's name and organization
  • the reserve, the band and the province or territory
  • the requested subjects, clearly specifying the nature of the research
  • the signature of the Chief and Council (in a quorum)
small black diamond Most departmental files are not housed within and must be retrieved in advance. When requesting files, 4 to 6 weeks notice should be given to ensure departmental staff has the opportunity to retrieve and review material prior to release to the researchers. The principles of access to government records will be used to review information. The researcher will be notified of this action, if applicable, upon receipt of the file.
small black diamond The copying of documentation from departmental files is the responsibility of the researcher unless other arrangements have been made.
small black diamond INAC historical records under the control of the Library and Archives Canada (LAC) are to be accessed by researchers directly through LAC, Researcher Services Division (613) 992-3884.
small black diamond A work area will be provided to researchers for examination of departmental files.
small black diamond INAC office hours are 8:30A.M. to 4:30 P.M. (This may vary within each region).
small black diamond Informal Access to Personal Information
  • for researchers involved in the process of researching native claims, paragraph 8(2)(k) of the Privacy Act permits the department to disclose personal information. Since the Act requires that the privacy of individuals be protected, only the information necessary to complete the objective will be made available. Thus, it is very important that your request be specific about the information being requested and the time frame involved.
  • to submit a request for access to personal information via paragraph 8(2)(k), complete the Request for Personal Information by Native Claims Researchers form and send it to:
