Lands
The mandate of the Lands Branch is primarily to manage land-related statutory duties under the Indian Act, as well as concurrent obligations under the First Nations Land Management Act (FNLMA) to transfer land management services to First Nations, while developing First Nation land management institutional and professional capacity. This branch is responsible for the following business lines:
- provision of land research, title clarification, Indian land registration and surveys;
- implementation of the First Nations Lands Management Initiative (FNLMI) and coordination with the First Nations Lands Advisory Board;
- provision of policy and advice on land management, natural resources (minerals and timber, except oil and gas);
- additions to reserve (ATR), including input, communication materials and advice on issues such as urban reserve additions/creations;
- policy support to regions and processing of Ministerial Orders and Orders in Council for additions to reserve, pre-reserve designations and second referendums related to surrenders and designations;
- provision of input for, or managing the design of First Nation lands management capacity building programs, tools and training (including delegation of Indian Act authorities to First Nations);
- negotiations to settle issues such as tax/title issues involving railway rights of way and other linear utilities and Soldier Settlement Board Mineral Titles.
