Indian Moneys Overview


Indian and Northern Affairs Canada is responsible for the management of Indian moneys provisions of the Indian Act. The Indian Moneys section of Lands and Trusts Services carry out the overall responsibility for the administration of Indian moneys held within the Consolidated Revenue Fund (CRF) for the use and benefit of Indians or bands. Indian moneys are managed pursuant to sections 61 to 69 of the Indian Act which defines the collection, maintenance, expenditure and accounting of Indian moneys.

Capital moneys are derived from the sale of surrendered lands (from an interest in land), or from the sale of the non-renewable resources of a band. These moneys include oil and gas royalties, bonus payments and other proceeds from the sale of timber, oil and gas or gravel. Revenue moneys are defined as all Indian moneys other than capital moneys. Revenue moneys may include, but are not limited to, proceeds from the sale of renewable resources, rights-of-way, fines and interest earned on capital and revenue moneys held in the CRF.

Indian moneys are also held within the CRF on behalf of individuals pursuant to sections 51 and 52 of the Indian Act. Indian and Northern Affairs Canada may choose to administer the property of on-reserve minors, adoptee and dependent adults (referred to as “mentally incompetent” within the Indian Act). The Indian Moneys section is also responsible for the delivery of Treaty annuity payments on a national basis to individuals belonging to bands who have signed Treaties with the Crown. The department has been reporting in the Public Accounts an amount of $1.7 million spent annually in Treaty annuity payments.
