Negotiations and Implementation

Negotiations and Implementation is responsible for the management and fulfillment of federal obligations, under land claim, self-government and devolution transfer agreements, where INAC has the lead role. This includes Program and Service Transfer Agreements negotiations, Administration of Justice negotiations, and Transboundary claim negotiations.

The Negotiations and Implementation team also houses the interim capacity for concluding agreements that are currently in the ratification process.

Program and Service Transfer Agreements

In each Yukon First Nation's self-government agreement, Section 17 provides for First Nation negotiation of the assumption of responsibility for the management, administration and delivery of any program or service within the jurisdiction of the First Nation. In practical terms, this means the First Nation will manage programs and structure them according to their priorities.


Administration of Justice negotiations

Section 13 of each Yukon First Nation's self-government agreement, it is recognized that the First Nation has jurisdiction to make laws with respect to the administration of justice. Discussions with some self-governing Yukon First Nations on the eventual negotiation of Administration of Justice Agreements have commenced and are at various stages and levels of engagement.


Transboundary claim negotiations

Chapter 25 of the Umbrella Final Agreement and each Yukon First Nation final agreement commits government to negotiate agreements with First Nations from British Columbia and the Northwest Territories, whose traditional territory has been recognized as extending into the Yukon. Interests of Yukon First Nations into British Columbia and the Northwest Territories are also recognized in Chapter 25. The Negotiations and Implementation unit supports the negotiations of these transboundary claims.
