Anishnaabe Government Agreement

Part 14 - Liability

  1. On the coming into force of this Agreement, the United Anishnaabeg Councils and First Nations shall not be liable for:

    1. any actions of Canada, its employees, officers and agents;

    2. any failure on the part of Canada to comply with applicable laws and other legal obligations;

    3. any injury, including death to persons, damage or loss to property or infringement of rights related to actions pursuant to this Agreement by an agent of Canada;

    4. any omission or wrongful act of Canada or its officers, employees, agents or entities;

    5. any claim, demand, action and cost whatsoever that may arise out of any omission or wrongful or negligent act of Canada, its officers, employees, agents or entities in the performance of this Agreement; and
    6. the failure of Canada to fulfill its obligations under this Agreement, unless the said failure is due in whole or in part to the failure of a First Nation or the United Anishnaabeg Councils to fulfill their obligations as set out in this Agreement.

  2. On the coming into force of this Agreement, Canada shall not be liable for:

    1. any actions of a First Nation or the United Anishnaabeg Councils, their employees, officers and agents;

    2. any failure on the part of a First Nation or the United Anishnaabeg Councils to comply with applicable laws and other legal obligations;

    3. any injury, including death to persons, damage or loss to property or infringement of rights related to actions pursuant to this Agreement by an agent of a First Nation or the United Anishnaabeg Councils;

    4. any omission or wrongful act of a First Nation or the United Anishnaabeg Councils or their officers, employees, agents or entities;

    5. any claims, demand, actions and cost whatsoever that may arise out of any omission or wrongful or negligent act of a First Nation, the United Anishnaabeg Councils, their officers, employees, agents or entities in the performance of this Agreement; and

    6. the failure of a First Nation or the United Anishnaabeg Councils to fulfill their obligations under this Agreement, unless the said failure is due in whole or in part to the failure of Canada to fulfill its obligations as set out in this Agreement.
