TRAFFIC AND TRANSPORTATION
208.
- Westbank First Nation has jurisdiction in relation to the regulation
and control of ground traffic and transportation, and the design, construction,
management and maintenance of the ground transportation infrastructure
on Westbank Lands.
- For greater certainty, the exercise of the jurisdiction referred
to in subsection 208(a) shall be designed to be at least equivalent
in effect to federal and provincial regulations, safety standards and
technical codes for the same subject matter.
209. For greater certainty, the jurisdiction referred to in section 208
does not include jurisdiction in relation to navigation and shipping.
210. Until such time as the coming into force of the first Westbank Law
enacted pursuant to the jurisdiction described in this Part, paragraph
73(1)(c), and any regulations made thereunder, of the Indian Act
shall continue to apply.
211. In the event of a conflict between federal law in relation to traffic
and transportation and Westbank Law enacted in accordance with any of
the provisions of this Agreement, the federal law shall prevail to the
extent of the conflict.
