Transact Terms of Use

Transact is Transport Canada’s online storefront and e-billing website (the “Website”). Read the following text explaining the rules governing your use of our services carefully.

1. Acceptance of Terms of Use

By accessing or using the Website, you agree, to be bound by these terms and conditions of use (the “Terms of Use”) and such agreement constitutes a binding contract between you and Transport Canada (the “Agreement”). Transport Canada reserves the right to modify the Terms of Use at any time without notice to you. It is your responsibility to keep yourself apprised of the Terms of Use applicable at the time of access or use of the Website. By using the Website after Transport Canada has made modifications, you agree to be bound by such revised Terms of Use.

2. Registering and Opening an Account

Transport Canada allows registration of both individual and organization accounts. By completing a registration application, you declare that you are authorized to open an account. To open an account, you must provide accurate, current and complete information on our registration application. You will maintain and promptly update your information to keep it accurate, current and complete. If you provide any information that is inaccurate, not current or incomplete, Transport Canada reserves the right to suspend your registration and suspend use of this service.

Once registered, you will select or be assigned a unique user name and password. You assume full responsibility for protecting the confidentiality of your user name and password. You also assume full responsibility for all use of your user name and password. You cannot give permission for use of the name and password by a third party without the prior written authorization of Transport Canada. You agree to notify Transport Canada immediately of any unauthorized use.

If you are an organization, you can establish multiple users with unique names and passwords. You must declare that any person who is registered to use your account is a person authorized to do so.

3. Privacy Policy

Necessary measures are being taken to protect the confidentiality of the personal information you provide. The information you provide is collected under the authority of the Financial Administration Act. The information will only be used to support Transport Canada’s on-line transaction processes and to aid in the provision of customer services. Personal information collected will be held in the Transport Canada Personal Information Bank (#DOT PPU 078) for 7 years. Personal information that you provide is protected under the provisions of the Privacy Act.

Under the provisions of the Privacy Act, individuals have the right to protection of, and access to, personal information they submit. For more information about your rights, please see InfoSource. 4. Billing Notifications Options

Transport Canada allows electronic notifications for both individual and organization accounts. The Billing Notifications Options allows you to choose the method for receiving invoices and statements. Paper and electronic billing notification cannot be combined.

The default billing notification method, for existing Transport Canada customers, is paper notification. Should you decide to change to electronic notification, please go to the Update My Account and Billing Profile at www.tc.gc.ca/transact . If you are an existing Transport Canada customer, when registering, you will be asked to select a billing method . Invoices and statements can be sent to you either on paper by Canada Post regular mail or electronically as an email notification.

Note: Electronic notification of invoices and statements is the legal equivalent of paper invoices or statements.

5. Payment

You will pay all charges in a timely manner; otherwise regular interest will apply pursuant to the Financial Administration Act. Online payments must be paid using an authorized credit card (VISA, MasterCard or American Express). Online payment is only available for Canadian dollar amounts and for individual payments of less than $5,000.00. If you are paying by mail or at a Transport Canada office, payment may be made by authorized credit card, debit card, cash or cheque.

6. Remedies

Transport Canada reserves the right to exercise all rights and remedies available at law, including the right of set-off under the Financial Administration Act.

7. Disclosure of Information to Financial Service Provider

All payment information that you provide for credit card payment will be encrypted and transmitted to our Financial Service Provider, which provides banking services and credit card payment processing for the Government of Canada and its departments and agencies.

8. Security

Transport Canada endeavours to protect the security of your credit card payments through use of data encryption and the industry-standard SSL (Secure Socket Layer) secure payment method.

9. Proprietary Rights

All content, software, logos, marks, photographs, graphics, illustrations, material and Products, whether or not protected under legislation, available on the Website (the “Content”) are the property of Her Majesty and/or third parties as the case may be. You may not use the Content except as expressly authorized by Her Majesty and/or a third party as the case may be.

10. Conditions Relating to Transport Canada materials, publications, videos, pamphlets, etc., Available on the Website (the “Product(s)”):

a) Licence

Subject to the terms and conditions contained herein, Transport Canada hereby grants to you a limited, non-exclusive, non-transferable, royalty-free licence to use Products for non-commercial purposes.

Except as expressly authorized by Transport Canada, you may not modify, copy, license, sub-licence, reproduce, distribute, republish, download, display, broadcast, perform, present in public, sell, transfer, compile, post or transmit in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means, any of the Products for any commercial purpose, without the prior written permission of Transport Canada. All requests for Transport Canada’s permission should be sent in writing addressed to the Crown Copyright Office of the Government of Canada (e-mail: copyright.droitdauteur@pwgsc.gc.ca ).

b) Content

The Products are to be used solely as a reference. The information contained in such Products may become obsolete, in whole or in part, at any time without notice. It is your responsibility to contact Transport Canada at 1-866-949-2262 to ensure that you are using the most recent version of any Product.

c) Availability of Products

Transport Canada respects the Official Languages Act and is committed to ensuring all information on this site is available in both French and English. However, users should be aware that some information or Products from external sources is available only in the language in which it was provided.

d) Shipping

Products currently stocked in inventory are normally shipped within 48 hours; Products not currently stocked are normally shipped within two to four weeks. Transport Canada ships via Canada Post - Standard Mail, so please allow normal Canada Post mailing times for actual delivery of your shipment. If you need specific information regarding the status of your order, please visit the Website at http://www.tc.gc.ca/transact/ or contact Sales and Customer Service at 1-866-949-2262.

e) Prices

All prices are shown in Canadian dollars. Applicable sales taxes are not included in the prices shown. Shipping and delivery charges and sales taxes will apply in accordance with your order. Transport Canada reserves the right to change prices at any time and without notice.

f) Product Returns, Etc.

You must verify Products immediately upon receipt. If you are not satisfied with a Product, or a Product is defective, you may return the Product, within thirty (30) calendar days of the date of shipment. You may not return special Products (e.g., PAL, SECAM, etc.) unless they are defective.

In order to return a Product you must ensure the following:

  1. contact the Sales and Customer Service at 1-866-949-2262 to request a Return Material Authorization Number (RMA);
     
  2. indicate the RMA on your return package; and,
     
  3. include a copy of the Packing Slip received with the original order.

Products must be returned to the following address:

Where a Product is returned, Transport Canada’s obligation and your only remedy shall be the replacement of the Product, or reimbursement or credit of the purchase price, at Transport Canada’s option.

Transport Canada shall not be responsible for any damage or loss (including consequential damages) relating to the use of a Product.

11. Disclaimer of Warranties

Except as otherwise provided herein,

  1. your use of the Website, the services, or Products available herein is at your sole risk;
     
  2. services and Products are provided on an “as is” and an “as available” basis;
     
  3. Transport Canada expressly disclaims all warranties of any kind, whether expressed or implied, including but not limited to, the implied warranties of merchantability, and fitness for a particular purpose;
     
  4. Transport Canada makes no warranties about the accuracy, reliability, completeness or timeliness of the information on the Website, the Website, the services, or the Products; and,
     
  5. Products downloaded or otherwise obtained through the Website is done at your own discretion and risk, and you will be solely responsible for any damage or loss that may result from using, downloading or otherwise accessing any of the Products.

12. Limitation of Liability

In no event shall Transport Canada be responsible to you for any direct, general, indirect, incidental, consequential, or special damages of any nature or kind, (including, but not limited to, the loss of revenue, data, or data use, or database use by you or any third party) arising out of or in connection with this Agreement, even if Transport Canada has been advised of the possibility of such damages.

13. Applicable Law

This Agreement shall be construed and enforced in accordance with, and the rights of the parties shall be governed by, the laws in force in the province of Ontario and applicable federal laws.

14. Access to Information, Etc.

You acknowledge that Transport Canada is subject to applicable federal laws, including the Access to Information Act of Canada.
