Transport Canada is committed to
modernizing the way it regulates
transportation. The creation of the
Transportation Appeal Tribunal of
Canada contributes to this goal.
The Transportation Appeal Tribunal of
Canada is a multi-modal tribunal. It
provides a recourse mechanism to the
air, rail and marine sectors with respect to certain administrative
actions taken by the Minister of
Transport under various pieces of
federal transportation legislation.
The tribunal will hold review and
appeal hearings at the request of
parties that receive a section 31 Notice
and Order or a section 32 Ministerial
Order, issued under the Railway Safety
Act. This includes federally regulated
railways and municipalities.
The tribunal will replace the review
mechanism under section 31 (9) of the
Railway Safety Act.
A railway that initiates a review is
encouraged to continue
communicating with Transport Canada
throughout the review process to help
settle the issue in dispute.
Parties that want to request a review
should contact the tribunal within 30
days of receiving a Notice and Order or
Ministerial Order at:
