Intervention by Third Parties Prior to Advertisement

The Trade Marks Act does not provide for intervention by third parties prior to advertisement. After advertisement any interested person may intervene pursuant to the opposition procedure set out in the Trade-marks Act and the Trade-marks Rules. The Office does not maintain a notice service; the responsibility for maintaining a watching brief on the application rests with the potential opponent. Therefore, any letter of Iintervention received by the Office prior to advertisement will be returned to the sender.
