Section 45 Proceedings

On December 20, 1995, the Governor in Council fixed January 1, 1996 as the day of coming into force of Section 200 of the World Trade Organization Agreement Implementation Act. Section 200 amends Section 45 of the Trade-marks Act by changing the period for showing use from two years prior to the date of the notice to three years prior to the date of the notice.

Notice is hereby given that the Trade-marks Opposition Board will apply Section 45 as amended to all Section 45 cases whether they were commenced before or after January 1, 1996.
