MOTOR VEHICLE SAFETY ACTMotor Vehicle Safety Regulations
(Section 5) Noise Emissions (Standard 1106) 1. The definitions in this section apply in this Schedule and in the documents referred to in this Schedule. "dBA" « dBA » "dBA" means the A-weighted sound level in decibels, measured using a sound level meter or a sound data acquidition system referred to in Appendix A of Test Method 1106-Noise Emission Tests (August 2005) that uses the values set out in Table 1 of that Appendix.
"decibel" or "dB" « décibel ou dB » "decibel" or "dB" means 20 times the logarithm to the base 10 of the ratio of the measured sound pressure relative to a reference sound pressure of 20 mPa.
"rated engine speed" or "maximum rated engine speed" « régime maximal nominal, rated engine speed ou maximum rated engine speed » "rated engine speed" or "maximum rated engine speed" means the rotational speed of an engine in revolutions per minute (RPM) at which the maximum horsepower of the engine is attained.
"sound level" « niveau sonore » "sound level" means the root-mean-square of the values measured in dBA that are recorded during testing conducted pursuant to this section. 2. Every vehicle, other than a motorcycle or a vehicle referred to in section 4, shall be so constructed that

Every truck or bus with a GVWR of more than 4 536 kg (10,000 lb.) shall be so constructed that, where tested in accordance with section 4 of Test Method 1106-Noise Emission Tests (August 2005), the interior sound level at the driver's seating position does not exceed 90 dBA when a value of 2 dBA is subtracted from the average sound level obtained in accordance with the test. SOR/89-279 25 May, 1989 pursuant to section 9 of the Motor Vehicle Safety Act Portion of subsection 1106(1) of Schedule V preceding paragraph (a); paragraph 1106(1)(b) of Schedule V; and section 1106 of Schedule V by adding subsection (1.1) immediately after subsection (1). SOR/97-141 11 March, 1997 pursuant to section 5 and subsection 11 (1) of the Motor Vehicle Safety Act. Section 1106 of Schedule V is revoked and replaced by Schedule IV.1. SOR/97-421 28 August, 1997 pursuant to subsection 5(1) and section 11 of the Motor Vehicle Safety Act, in force August 28, 1997 Schedule IV.1 is renumbered Schedule V.1. SOR/2002-55 31 January 2002 pursuant to section 5 and subsection 11(1) of the Motor Vehicle Safety Act, comes into force February 13, 2003. The portion of section 4 of Schedule V.1 before paragraph (a) is replaced. SOR/2005-342 15 November, 2005 pursuant to section 5 and subsection 11(1) of the Motor Vehicle Safety Act, comes into force 15 November, 2005 The expression "(October 15, 1996)" is replaced with the expression "(August 2005)" wherever it occurs in the following provisions: (a) the definition "dBA" in section 1 of Schedule V.1; (b) subparagraph 2(b)(i) of Schedule V.1; and (c) section 5 of Schedule V.1.
