Traffic on the Land Side of Airports Regulations

SOR/2006-102



TRAFFIC ON THE LAND SIDE OF AIRPORTS REGULATIONS

 

INTERPRETATION

1. The following definitions apply in these Regulations.

 

"airport"

«aéroport»

"airport" means an aerodrome in respect of which an airport certificate issued under section 302.03 of the Canadian Aviation Regulations is in force.

 

"airport operator"

«exploitant de l'aéroport»

"airport operator" means

(a) in the case of an airport set out in Schedule 1, the Minister; and

(b) in the case of an airport set out in Schedule 2, the person or organization that has been issued an airport certificate under section 302.03 of the Canadian Aviation Regulations in respect of the airport.

 

"land side"

«côté ville»

"land side", in respect of an airport, means an area that is on airport property, that is not intended to be used for activities related to aircraft operations and to which the non-travelling public has access. 

 

"Minister"

«ministre»

"Minister" means the Minister of Transport. 

 

"parking area"

«aire de stationnement»

"parking area" means any area on airport property designated by a sign as an area for parking vehicles.

 

"road"

«route»

"road" means a highway, street or work designed and intended for or used for the circulation of vehicles, excluding a parking area and a sidewalk.

 

"sign"

«panneau de signalisation»

"sign" means a sign, device or pavement marking communicating instructions that is erected or placed under the authority of the airport operator. 

 

"vehicle"

«véhicule»

"vehicle" means

(a) an automobile, over-snow vehicle, truck, commercial passenger vehicle or any self-propelled vehicle or device and includes an air cushion vehicle as defined in section 2 of the Air Cushion Vehicle Regulations but does not include a wheelchair or other similar device or an aircraft; and

(b) a bicycle or any cycle, regardless of the number of wheels it may have.

 

APPLICATION

2. These Regulations apply in respect of the land side of an airport set out in Schedule 1 or 2.

 

GENERAL

3. The parking fine category applicable at an airport set out in column 1 of an item of Schedule 2 is the category set out in column 3 of the item.

 

PART 1

OPERATION OF VEHICLES - VEHICLE TRAFFIC AND PARKING

4. (1) An airport operator may, in order to ensure the safety of persons and goods and the efficient operation of the airport, erect or have erected or place or have placed signs

(a) regulating

(i) the rate of speed of vehicles or classes of vehicles, and

(ii) the load limit or dimensions for vehicles or classes of vehicles;

(b) regulating or prohibiting

(i) the parking or stopping of vehicles or classes of vehicles, and

(ii) the movement of vehicles or classes of vehicles; and

(c) designating

(i) areas for the parking of vehicles or classes of vehicles,

(ii) areas for the loading or unloading of vehicles or classes of vehicles, and

(iii) roads as one-way roads.

(2) An enforcement officer authorized under section 21 may, for the purpose of ensuring the safety of persons and goods and the efficient operation of the airport, give instructions for directing or controlling traffic.

5. No person shall operate a vehicle at a rate of speed greater than

(a) the speed specified by the airport operator on a sign; or

(b) if no speed is specified by the airport operator, 50 km/h.

6. No person shall operate a vehicle unless

(a) the person holds all licences, permits and certificates required by the laws of the province and the municipality in which the airport is located for the operation of the vehicle in that province and municipality; and

(b) the vehicle is registered and equipped as required by the laws of the province and the municipality in which the airport is located.

7. (1) Subject to subsection (2), no person shall operate a vehicle elsewhere than on a road or in a parking area.

(2) An airport operator may authorize a person to operate a vehicle elsewhere than on a road or in a parking area, subject to any conditions that are necessary to ensure the safety of persons and goods and the efficient operation of the airport.

8. (1) Subject to subsection (2), the operator of a vehicle shall obey

(a) any instructions displayed on a sign that are applicable to the vehicle; and

(b) any instructions given by an enforcement officer in accordance with subsection 4(2) that are applicable to the vehicle.

(2) In case of conflict between the instructions referred to in paragraphs (1)(a) and (b), the operator of a vehicle shall obey the instructions given by an enforcement officer.

(3) Subject to these Regulations, the operator of a vehicle shall, in respect of the operation of the vehicle, obey the laws of the province and the municipality in which the airport is located.

9. (1) No person shall

(a) park a vehicle outside a parking area; or

(b) stop a vehicle outside a parking area in order to load or unload persons or goods except where it is permitted by a sign.

(2) No person shall park or stop a vehicle in a manner that obstructs traffic.

(3) Despite subsections (1) and (2), an airport operator may authorize a person to park or stop a vehicle in a place where there is no sign authorizing the parking or stopping of vehicles, subject to any conditions that are necessary to ensure the safety of persons and goods and the efficient operation of the airport.

(4) An airport operator may move and store in a suitable place, at the risk and expense of the vehicle's owner or operator, a vehicle that has been parked or stopped in contravention of this Part or of a notice prohibiting that vehicle from entering or parking on airport property.

10. (1) An airport operator may issue or authorize the issuance of a permit in respect of the parking of a vehicle in a specified parking area and may, in respect of the permit, specify a period of validity and any conditions necessary for the safety of persons and goods and the efficient operation of the airport.

(2) An airport operator may revoke a permit if the permit holder fails to comply with a condition of the permit.

11. No person shall park a vehicle in a parking area reserved for permit holders unless the person holds a permit authorizing them to park in that area and they park the vehicle in accordance with the conditions of the permit.

12. (1) No person shall park a vehicle in a parking area where parking spaces are marked so as to wholly or partially occupy more than one space.

(2) No person shall park a vehicle in a parking area

(a) during the hours within which parking is prohibited in the parking area; or

(b) for a period greater than that indicated on a sign or greater than that for which a fee has been paid.

(3) No person shall park a vehicle in a parking area reserved

(a) subject to paragraph (b), for a certain person or a specified class of person or vehicle unless the person is the person or a person of the specified class or is operating a vehicle of the specified class; or

(b) for persons with disabilities unless the vehicle is identified by a sign issued by a government agency responsible for such signs as a vehicle used for the transport of a person with a disability and a person with a disability is using the vehicle at the time.

13. The operator of a vehicle shall, at the request of an enforcement officer authorized under section 21, produce

(a) any permit issued by the airport operator under this Part;

(b) any licence or permit authorizing them to operate the vehicle;

(c) any certificate of registration of the vehicle under the person's control; and

(d) any other certificate required in respect of the vehicle by the laws of the province and the municipality in which the airport is located.

14. The operator of a vehicle that is involved in an accident shall report the accident as required by the laws of the province and the municipality in which the accident occurred.

 

PART 2

PEDESTRIANS, ANIMALS AND LITTERING

15. (1) An airport operator may, in order to ensure the safety of persons and goods and the efficient operation of the airport,

(a) erect or have erected or place or have placed signs

(i) regulating or prohibiting the movement of pedestrians and persons using a wheelchair or other similar device,

(ii) designating areas for the use of pedestrians and persons using a wheelchair or other similar device,

(iii) prohibiting animals from being at large without the prior authorization of the airport operator, and

(iv) prohibiting littering; and

(b) mark any portion of a road for the use of pedestrians and persons using a wheelchair or other similar device.

(2) An enforcement officer authorized under section 21 may, for the purpose of ensuring the safety of persons and goods and the efficient operation of the airport, give instructions for directing or controlling pedestrian traffic and that of persons using a wheelchair or other similar device.

Pedestrians

16. (1) Subject to subsection (2), pedestrians and persons using a wheelchair or other similar device shall obey

(a) any instructions displayed on a sign; and

(b) any instructions given by an enforcement officer in accordance with subsection 15(2).

(2) In case of conflict between the instructions referred to in paragraphs (1)(a) and (b), pedestrians and persons using a wheelchair or other similar device shall obey the instructions given by an enforcement officer.

17. Pedestrians and persons using a wheelchair or other similar device shall, to the extent possible,

(a) where there is a sidewalk or a portion of a road has been marked or an area designated for their use, use the sidewalk or the marked portion of the road or the designated area; or

(b) where there is no sidewalk and no portion of a road has been marked or area designated for their use, use the shoulder of the road and face oncoming traffic.

18. Where no portion of a road has been marked and no area designated as a pedestrian crossing and no sign prohibits the crossing of the road, pedestrians and persons using a wheelchair or other similar device shall, when crossing that road, yield the right-of-way to vehicles using the road.

Animals

19. (1) No person shall permit an animal to be at large without the prior authorization of the airport operator.

(2) An airport operator may issue an authorization to permit an animal to be at large, subject to any conditions that are necessary to ensure the safety of persons and goods and the efficient operation of the airport.

(3) An airport operator may, at the expense of the owner or the person in charge of an animal found contrary to subsection (1), cause the animal to be driven off the airport property, confined or impounded in accordance with the laws of the province and the municipality in which the airport is located.

Littering

20. No person shall throw, deposit or leave any form of trash or garbage except in a container provided for that purpose.

 

PART 3

ENFORCEMENT

Enforcement Officers

21. The following persons are authorized as enforcement officers for the purposes of these Regulations:

(a) members of the Royal Canadian Mounted Police;

(b) members of the police force of the province or the municipality in which the airport is located;

(c) by-law enforcement officers of the municipality in which the airport is located; and

(d) an airport operator and its agents, contractors and employees assigned to duties related to the enforcement of these Regulations.

Punishment

22. Any person who contravenes a provision of these Regulations is liable on summary conviction to

(a) a fine not exceeding $500;

(b) a term of imprisonment not exceeding six months; or

(c) the fine and the term of imprisonment referred to in paragraphs (a) and (b).

23. (1) Any person who is alleged to have contravened a provision of these Regulations, other than section 5 or 6, subsection 8(3) or section 14, may register a plea of guilty to the alleged offence by making payment in accordance with the terms and conditions set out on a ticket or other notification document in the amount of

(a) $30 in the case of a contravention of subsection 9(1), section 11, subsection 12(1) or (2) or paragraph 12(3)(a) at an airport set out in Schedule 1;

(b) $40 in the case of a contravention of subsection 9(1), section 11, subsection 12(1) or (2) or paragraph 12(3)(a) at an airport in parking fine category 1 set out in Schedule 2;

(c) $40 in the case of a contravention of subsection 9(2) at an airport set out in Schedule 1;

(d) $50 in the case of a contravention of section 13, subsection 16(1), section 17 or 18 or subsection 19(1);

(e) $50 in the case of a contravention of subsection 9(1), section 11, subsection 12(1) or (2) or paragraph 12(3)(a) at an airport in parking fine category 2 set out in Schedule 2;

(f) $50 in the case of a contravention of subsection 9(2) at an airport in parking fine category 1 set out in Schedule 2;

(g) $75 in the case of a contravention of subsection 9(2) at an airport in parking fine category 2 set out in Schedule 2;

(h) $75 in the case of a contravention of subsection 7(1) or 8(1) or section 20; and

(i) $100 in the case of a contravention of paragraph 12(3)(b).

(2) Any person who is alleged to have contravened section 5 or 6, subsection 8(3) or section 14 may register a plea of guilty to the alleged offence by making payment in accordance with the terms and conditions set out on a ticket or other notification document in the amount equal to the lesser of

(a) the fine prescribed under the highway traffic laws of the province or the by-laws of the municipality in which the offence was committed, as amended from time to time, and

(b) $500.

24. If a payment is made in accordance with section 23 by or on behalf of a person who is alleged to have contravened a provision of these Regulations, the payment shall be considered to be in full satisfaction of any penalty that may be imposed on summary conviction of that person for the alleged contravention.

25. If a person is convicted of operating a vehicle in contravention of these Regulations, the convicting court or judge may, in addition to any other penalty imposed, make an order prohibiting the person from operating any vehicle on the airport property where the contravention occurred for a period not exceeding one year after the date of the conviction.

 

CONSEQUENTIAL AMENDMENTS

Airport Traffic Regulations

26. Section 2 of the Airport Traffic Regulations is amended by adding the following in alphabetical order:

"land side"

«côté ville»

"land side" means land side as defined in section 1 of the Traffic on the Land Side of Airports Regulations;

 

27. Section 3 of the Regulations is replaced by the following:

3. These Regulations apply in respect of an area other than the land side of an airport set out in Schedule I or II.

28. Paragraph 39(1)(a) of the Regulations is replaced by the following:

(a) a fine not exceeding an amount equal to the lesser of

(i) the maximum fine, if any, prescribed under the highway traffic laws of the province in which the offence was committed, as amended from time to time, and

(ii) in any other case, $500;

29. (1) The portion of subsection 40(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

40. (1) Toute personne accusée d'avoir enfreint une disposition de la présente partie régissant le stationnement de véhicules à moteur peut, dans les 72 heures suivant la fin du jour où l'infraction est censée s'être produite, jours fériés exclus, déposer un aveu de culpabilité relatif à la présumée infraction et payer au tribunal, soit en personne, soit par la poste :

(2) Subsection 40(4) of the French version of the Regulations is replaced by the following:

(4) Lorsqu'une personne accusée d'avoir enfreint une disposition de la présente partie régissant le stationnement de véhicules à moteur a, conformément au paragraphe (1), payé au tribunal l'amende imposée pour cette infraction, aucune autre sanction ne lui sera imposée pour cette infraction.

30. Section 50 of the Regulations is replaced by the following:

50. Every person who contravenes section 41, subsection 41.1(1) or (2) or section 49 is liable on summary conviction to a fine not exceeding $400.

31. Paragraph 51(1)(g) of the Regulations is replaced by the following:

(g) $75, where the alleged offence relates to smoking or littering in contravention of section 49;

32. Schedule II to the Regulations is replaced by the following:

Government Property Traffic Regulations

33. Paragraph 3(f) of the Government Property Traffic Regulations is replaced by the following:

(f) property to which the Airport Traffic Regulations or the Traffic on the Land Side of Airports Regulations apply.
