Enforcement and Emergencies Division
Environment Canada administers two Acts that address pollution: the Canadian Environmental Protection Act (CEPA, 1999) and the pollution provisions of the Fisheries Act. The Region's pollution enforcement function is delivered from the Vancouver Regional Office and district offices located in Prince George, Smithers and Whitehorse in the Yukon. Enforcement officers carry out a comprehensive national and regional program of planned and reactive inspections of facilities and investigations of suspected violations. Enforcement officers are responsible for conducting inspections, responding to tips and complaints and for investigating alleged violations. Inspections are conducted to verify compliance with federal environmental legislation, regulations, permit conditions and orders. CEPA Regulations include:

•  Chlorobiphenyls (PCB) Regulations

•  Fuels Regulations

•  Export & Import of Hazardous Waste Regulations  

•  New Substances Notification Regulations

•  Ozone Depleting Substances Regulations

 

Fisheries Act Regulations include:

•  Pulp and Paper Effluent

•  Metal Mining Effluent

•  Petroleum Refinery Effluent

and various industries subject to the general pollution prevention provisions of the Fisheries Act.  Each year Environment Canada enforcement officers conduct from 400 to 700 inspections and investigations and respond to over 200 tips and complaints in BC and Yukon.

Photo: Emergency responses to spillsInvestigators primary enforcement role is the investigation of alleged offences and the gathering of evidence to support an enforcement action. In cases, where charges are laid, prosecutions are conducted by the Regional Department of Justice.
