St. John’s Company Pleads Guilty Regarding Jet Fuel Release

St. John’s, Newfoundland and Labrador- July 11, 2003 - Irving Aviation Services Limited appeared in provincial court today and pleaded guilty to a charge regarding a violation of the federal Fisheries Act. The St. John’s company was fined $10,000 and the court assigned $9,500 of the money into the Environmental Damages Fund.

The Environmental Damages Fund is administered by Environment Canada and the money in it is allocated to local organizations, and typically they find various partners that contribute additional money and other resources. The Fund is usually used to fund projects in the same area where the pollution offence occurred.

Environment Canada filed charges against Irving Aviation Services Limited on April 15, 2002 regarding a release of jet fuel into a place where it was likely to enter waters frequented by fish. On March 11th, 2001, an Irving Aviation Services Limited aircraft re-fueling truck released about 4000 litres of jet fuel on the property of St. John’s International Airport. Some of the released fuel spilled into nearby Outer Cove Brook. Section 36(3) of the federal Fisheries Act states that it is an offence to deposit, or permit the deposit of, a deleterious (harmful) substance into waters frequented by fish.

The charges were laid by Environment Canada following an investigation by its Atlantic Region Office of Enforcement. The Enforcement staff investigate potential pollution offences under the Canadian Environmental Protection Act (CEPA) and sections of the federal Fisheries Act. They help ensure that companies, government employees, and the general public comply with legislation and regulations that protect Atlantic Canada's environment.
